                                     Auction of Museum Historical Artifacts


Notice is herby given that sealed bids will be received by the El Dorado County Historical Museum, on May 10,
2008 until 2:00 p.m. for the sale of Museum Historical Artifacts. All bids received will be publicly opened and
read aloud at the El Dorado County Historical Museum, 104 Placerville Drive, Placerville, CA.

Any bid, which fails to conform to the essential requirements of the specifications, shall be rejected. In
discretionary cases, the Purchasing Agent shall be the determining factor in whether specifications are met. Bids
must be the exact quantity of the lot(s) required or they will be automatically rejected.

The Museum Artifacts being auctioned are available for viewing on Saturday, May 10, 2008 from 8:00 a.m. to
11:00 a.m. at the El Dorado County Historical Museum located at 104 Placerville Drive, Placerville, CA.
Arrangements to view the Museum Artifacts prior to the auction date of Saturday, May 10, 2008 may be arranged
with Mary Cory, Museum Administrator at (530) 621-5828.

Warranty: All items are “As Is, Where Is”. There are no expressed or implied warranties as to value, working
order, fitness for a particular purpose, or merchantability. All sales are final. No returns will be accepted.

Information: For additional information regarding the County bid process, contact Kristen Whitehouse, at (530)
621-5830 (email:kristen.whitehouse@co.el-dorado.ca.us). Bidders are cautioned that they are not to rely upon
any oral statements that they may have obtained regarding the County bid process. Bidders shall direct all
inquiries regarding the County bid process to the County Procurement and Contracts Division and shall not contact
the El Dorado Count Historical Museum directly regarding any matter related to this sealed bid process.

Award: The award will be made to the highest bidder for each single item, and in the case of lots, to the highest
bidder for each lot. Payment must be submitted at the time of bid. All sales of Museum Artifacts awarded shall be
fully paid for by cash, cashier’s check, or certified check. Any such check must be made payable to El Dorado
County Museum for the full amount bid.

The County reserves the right not to sell any item(s) listed, if in the sole opinion of the County, it is determined to
be in the best interest of the County. The right is further reserved by the County to withdraw any of the Item(s)
listed hereunder from the sale at any time.

Pick-up: All items awarded must be picked-up no later than 3:30 p.m. on Saturday, May 17, 2008. If awarded items
have not been picked-up by the above specified date and time, the items will be awarded to the next highest bidder
unless special arrangements are made for alternate pick-up dates in writing and approved by the Museum Director.
Any payments for items not picked-up by the scheduled date and time will be forfeit. All sales are final. No refunds
will be made,

The successful bidder(s) shall bear the sole responsibility for, and be required to, furnish all labor, materials,
equipments, vehicles, etc. needed and necessary to load and remove the item(s) awarded. The County will not furnish
personnel or equipment to remove items sold.

Incomplete and Altered Bids: Incomplete or altered bids, and bids containing items not called for in the bid may
be rejected. Bids submitted on forms other than those furnished by the County will not be considered. Erasures,
overwrites, and the use of correction fluid/tape are NOT acceptable. Any price changes must be lined out and
corrections inserted adjacent to and initialed by the bidder.

Terms and Conditions: The County will not consider any terms and conditions other than the terms and
conditions contained in the subject bid. Bidders submitting their own terms and conditions will not be considered
and will be rejected.

County’s Rights: The Purchasing Agent reserves the right to cancel or amend this process at any time.

El Dorado County Web Site Requirements: It is the bidder’s responsibility to monitor the County’s website for
possible addenda to this bid to inform him/herself of the most current specifications, terms, and conditions, and to
submit his/her bid in accordance with the original bid requirements and all addenda. All available bids and related
addenda can be found at:

Failure of bidder to obtain this information shall not relieve him/her of the requirements contained therein. Those
bidders not acknowledging and returning Addenda as required will not be considered and will be rejected as “non-
responsive.”

Addenda: Addenda to this bid are valid only if in writing and issued by the Procurement & Contracts Division,
and are required to be acknowledged and returned by participating bidders in order for the bidder to be considered
further in the evaluation process. Those bidders not acknowledging and returning Addenda as required will not be
considered and will be rejected as “non-responsive.”

Non-Collusion: The bidder certifies that this bid response is made without any previous understanding,
agreement or connection with any person, firm or corporation making a bid for the same project, and is in all
respects fair, without outside control, collusion, fraud or otherwise illegal action.

Bids must be submitted in a sealed container or envelope clearly marked on the outside: “Museum Auction, Bid”.

It is the responsibility of the bidder to assure that the bid is received at the El Dorado County Historical Museum
prior to the bid opening deadline date and time. Bids received beyond the bid opening deadline will not be
accepted and will be returned unopened. The time stamp clock located in the office of the El Dorado County
Historical Museum will serve as the official time clock.

Late bids, unsealed bids, unlabeled bids, incomplete bids, or bids otherwise not in compliance with the terms and
conditions of this Invitation to Bid, will be rejected.

By submitting a response, bidder acknowledges all terms and conditions contained in this Invitation to Bid.
