1. INTRODUCTION

Consultants who wish to offer services to the Tasmanian Government for civil works
consultancies must be pre-qualified with the Department of Infrastructure, Energy and
Resources (DIER).

The aim of pre-qualification is to classify consultants according to their expertise and
capability in specific work categories.

Consultants satisfying pre-qualification criteria are registered and become eligible to tender
for design works in their designated fields of expertise up to a specified category.

For the purposes of this application, a consultant is an individual or organisation engaged
under contract to provide civil design works contracts.

The requirement to be pre-qualified is applicable to any design contract with the DIER for
any civil or maintenance projects.

DIER maintains a register of pre-qualified consultants. The register provides a record of
consultants’ expertise, experience, capacity to perform and a history of their performance on
Government projects.

Pre-qualification means that the consultant has:
•    expressed interest in undertaking particular categories of design work; and
•    been assessed as being capable of undertaking specific categories of design work.


Pre-qualification does not guarantee that a consultant will be invited to undertake work for
the Government.

This document describes the Consultants’ Pre-qualification Scheme and the process for
registration, assessment, approval and review.



2. SCOPE OF REGISTRATION

2.1 Registration Categories

Registration categories are as follows:
•    Road works – Design and documentation
•    Bridge works – Design and documentation
•    Other – contract administration, contract claim consultant, planning, landscaping,
     archaeological, botanical, value management services and other.

2.2 Subconsultants

Consultants shall ensure that their sub-consultants are registered in the appropriate category
and for the estimated cost of the subcontracted part of the project.

Consultants entering into a subcontract with a sub consultant for which there is no
registration category are responsible for the competence of that sub-consultant and must
therefore satisfy themselves that the sub-consultant has appropriate qualifications, expertise
and experience.

2.3 Specialised Services

Consultant pre-qualification is not required for specialised services that are not encompassed
by the registration categories in this document. Government agencies entering into a direct
contract with a specialised consultant not encompassed by one of the registration categories
should satisfy themselves that the consultant has appropriate qualifications, expertise and
experience to carry out the work required.



3. REGISTRATION PROCESS

Consultants shall submit an application that addresses all the criteria set out in these
documents, including:


•    business information;
•    registration categories;
•    quality assurance;
•    company organisation;
•    personnel;
•    project experience and performance;
•    financial information;
•    occupational heath and safety information; and
•    environment.

Submissions shall be sent to DIER, Contract Services Section, Level 4, 10 Murray Street,
Hobart, Tasmania, 7000, for the attention of the Manager Contract Services.

Consultants are assessed for their suitability to undertake contract works in the category for
which they have applied. The assessment will determine if a consultant has satisfactorily
demonstrated relevant experience and appropriate performance in the categories for which
pre-qualification is being sought. As a result the consultant may, in any category, be
assessed as being:
•    pre-qualified for a particular category(s);
•    pre-qualified as above, but with restrictions applied; or
•    unsuitable for registration in a particular category.

Consultants will be advised of the assessment results in writing.

Consultants may apply, at any time, for pre-qualification, or to change an existing
pre-qualification.

The registration is for two years. Consultants will be advised, in writing, when registration is
due for renewal.

DIER undertakes to treat all the information contained in the application for registration as
‘confidential’ and ‘commercial in confidence’

DIER reserves the right to provide information from Applications for Registration to
consultants engaged for the purpose of technical and financial assessment. The same
confidentiality binds these consultants.

Treasury maintains a computerized database that contains information on all consultants
registered to tender for Government projects. Selected information from this database is
made available for use by agencies, it is password protected and is intended solely for use by
agency officers engaged in project procurement.

Application documentation submitted by the consultant is retained by DIER and by no other
party.


4. ASSESSMENT CRITERIA

The assessment process examines the type of work previously undertaken by the consultant
and the consultant’s performance record with regard to time, cost and quality.

DIER will only register those consultants that satisfy the criteria for pre-qualification. The
assessment criteria includes:
•    company structure;
•    financial background;
•    experience with similar projects;
•    past performance on those projects;
•    time management;
•    Quality assurance; Occupational Health & Safety and Environment systems
•    management, supervisory and construction personnel;
•    capability for the co-ordination of sub-consultants;
•    affiliations and sub-consultant arrangements;
•    commitment to best practice;
•    duration of operation as a consultant; and
•    other pre-requisite criteria as set out below.

5. NATIONAL CODE OF PRACTICE FOR THE CONSTRUCTION INDUSTRY

All consultants must comply with the National Code of Practice for the Construction
Industry and the Tasmanian Annexure to that Code. Lodgement of an application constitutes
the consultant’s agreement to comply with the Code for the duration of the pre-qualification
period. If a consultant fails to comply, the failure may be taken into account by the Principal
and may involve:
•    a formal warning;
•    partial exclusion from tendering opportunities; or
•    preclusion from all contracts for a specific period.


6. APPLICATION

6.1 Application Declaration

By making an application for pre-qualification the consultant declares the following:

•    that the particulars in all the documentation are true and correct in every detail; and
•    that none of the proprietors, directors, trustees, managers or their spouses is or has ever
     been bankrupt, or a director, manager or secretary of a company that is being or has been
     wound up (whether voluntarily or otherwise), and that the business is not trading under:
                      - an arrangement and/or restructuring; or
                      - receiver and management; or
                      - official management; or
                      - an arrangement with creditors without sequestration; and

The consultant also undertakes to:

•    advise any changes to the circumstances of the information contained in this application
     during the duration of the pre-qualification period should pre-qualification be granted in
     any category; and
•    provide details of any adverse change affecting the financial position contained in this
     application and/or supplied by the company accountant as soon as practicable after the
     change in circumstances become known.

6.2 Business Information

The consultant shall provide the following information:

•    company and business trading names;
•    business and postal addresses;
•    contact officer; telephone, facsimile and mobile numbers and email address;
•    Australian company number and business registration number;
•    Tasmanian Corporate Affairs registration number;
•    associated companies, both in Tasmania and on the mainland;
•    directors and managers of the company;

•    other businesses that the directors and managers has involvement with;
•    registrations held with other authorities; and
•    membership of industry associations.

6.3 Registration Categories

The consultant shall nominate the categories for which registration is requested.

6.4 Quality Assurance

Quality Assurance through third party audited management system or integrated
management system is mandatory.



DIER requires that consultants, seeking registration maintain a Third Party quality system
that has procedures that satisfy the following key system elements of AS/NZS ISO
9001:2000:
•    management responsibility;
•    contract review;
•    document and data control;
•    purchasing;
•    corrective and preventative action;
•    control of quality records;
•    internal quality audits;
•    training; and
•    quality system.

Procedures must be documented, implemented and verified by external audit.

Consultants can satisfy the quality assurance requirement by having an approved external
auditor verify that quality plans are used and the above key system elements have been fully
documented and implemented. Names of approved auditors may be obtained from the
Principal Contracts Officer, Department of Treasury and Finance.

6.5 Organisation

The consultant shall include the following information:
•    brief history of the company;
•    management structure and how responsibilities are allocated;
•    affiliated consultants in Tasmania or on the mainland; and
•    location of offices in Tasmania.

6.6 Personnel

Personnel include all permanent full time and permanent part time employees of the
company in Tasmania.
Casual and contract employees are not to be included.

Management
Provide the following information on management personnel including all Directors,
Managers and other key management persons:
•    name;
•    position held in company;
•    qualifications; and
•    years of experience.

Designers/Planners

Provide the following information on all design personnel including Engineers, Planners and
Design Drafters.
•    name;
•    position held in company; and
•    years of experience.

Office Personnel

The consultant shall include the following information for office personnel, and apprentices:
•    occupation; and
•    number of persons.

Do not provide detailed curriculum vitae for employees. This information will be requested
as necessary during the assessment process.

6.7 Project Experience and Performance

The application must include details of projects that are directly relevant to each category for
which registration is being sought and that have been completed in the past two years.

Projects undertaken should be of a type to provide justification for registration in each
category.

Details required for each project include the following:

•    registration category
•    project title;
•    project cost/component cost;
•    year project completed;

•    description of project;
•    name and contact details of client’s Project Manager.

Client Project Managers may be asked to comment on the performance of the consultant.



7. FINANCIAL

DIER will undertake an assessment of the financial background of the company applying for
pre-registration.

Financial information should be compiled and forwarded with the application for
registration, either electronically, by e-mail or in printed form.

Information that is required for the financial assessment includes:


Following subject to revision by KPMG
•    audited accounts where these are required under Australian Securities Legislation; or
•    Balance Sheet/Profit and Loss Statements in the format specified in Schedule 5 of the
     Company Law Regulations or audited accounts where required under Australian
     Securities Legislation;
•    annual turnover for:
          a) second last full financial year;
            b) most recent full financial year; and
            c) current financial year (estimate).
•    if operating an overdraft, please state the overdraft limit and whether the security for the
     overdraft is company or personal;
•    the value of any current bank guarantees or insurance bonds;
•    contact details at the applicant’s bank and the name of the consultant’s accountant.
•    authorisation for the applicant’s bank to supply the Department of Infrastructure, Energy
     and Resources with a reference regarding your financial position, if required.

8. APPEALS

The applicant may seek an appeal or review of any assessment decision by writing to the
Department of Infrastructure, Energy and Resources, Contract Services Section, Level 4, 10
Murray Street, Hobart, Tasmania, 7000, for the attention of the Manager Contract Services.
