AN ORDINANCE GRANTING A CORRECTED QUIT CLAIM DEED TO I & M MACHINE & FABRICATION CORPORATION FOR THE NORTHERN HALF OF THE OLD RECYCLING CENTER PROPERTY LOCATED AT 400 SOUTH 4TH STREET. WHEREAS, The City of St. Joseph sold the northern half of the old recycling center property located at 400 South 4th Street to I & M Machine & Fabrication Corporation by Special Ordinance Number 7215 which passed City Council on November 19th, 2007; and WHEREAS, The acceptance of this Corrected Quit Claim Deed will correct an error made by the Union Pacific Railroad Company when railroad staff placed the incorrect legal description in a Quit Claim Deed accepted by the City Council by Special Ordinance No. 6344 and passed on May 24, 2004; and WHEREAS, The execution of this Corrected Quit Claim Deed will conclude the sale of the northern portion of the property to I & M Machine & Fabrication Corporation by making the company the legal owner of record. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. JOSEPH, AS FOLLOWS: SECTION 1. That the Corrected Quit Claim Deed by and between the City of St. Joseph, Missouri and I & M Machine & Fabrication Corporation for real estate be, and hereby is, approved and that a true and accurate copy of said Corrected Quit Claim Deed be, and hereby is, attached hereto and incorporated herein by reference as though fully set out herein. SECTION 2. That the City Manager be, and hereby is, authorized to execute said Corrected Quit Claim Deed by and on behalf of the City of St. Joseph, Missouri, said real property real property is described as follows: Lots 7, 8, 9, 10, 11 and 12 of Block 37 in the Original Town now City of St. Joseph, Buchanan County, Missouri and the Alley adjacent to said Block 37 and the north one-half of that portion of Angelique Street lying west of Fourth Street and east of the west line of said Alley as said Alley and Street were vacated by Ordinance No. 4364 dated March 23, 1906. SECTION 3. That the Corrected Quit Claim Deed shall be recorded by I & M Machine & Fabrication Corporation (Buyer) with the Recorder of Deeds of Buchanan County, Missouri, with the cost of recording to be borne by the Buyer.

EXPLANATION TO COUNCIL BILL ORIGINATING DEPARTMENT: Public Works & Transportation Administration – Legal PURPOSE: To convey a Corrected Quit Claim Deed from the City of St. Joseph to I & M Machine & Fabrication Corporation for the northern half of the property formerly occupied by the City’s Recycling Center at 400 S. 4th Street. REMARKS: I & M Machine & Fabrication Corporation has purchased the property (the south half by Special Ordinance No. 6655 on August 29th, 2005 and the north half by Special Ordinance No. 7215 on November 19th, 2007). The purpose of the sale was to allow I & M Machine & Fabrication Corporation to expand their business. An incorrect legal description from the Union Pacific Railroad Company has since been discovered in the Quit Claim Deed accepted by the City Council by Special Ordinance No. 6344 and passed May 24, 2004. By companion ordinance, the City will accept the Corrected Quit Claim Deed from the Union Pacific Railroad, thereby permitting the City to convey the property to I & M Machine & Fabrication Corporation, making them the legal owner of record.
