Criminal Law Check List Actus Reas: Voluntary Act, omission Mens Rea: Mental State Common Law: Specific Intent (has future purpose/actual knowledge) Or General Intent (aware of conduct but no desire/purpose to bring about new circumstances MPC: Purpose: Conscious objective/desire as to conduct & result, awareness/belief as to circumstance Knowledge: Awareness as to conduct & circumstance, practically certain as to result Recklessness: Default Level. Subjective awareness of substantial & unjustified risk that’s a gross deviation from what a law abiding person would do Negligence: Objective/reasonable person would have been aware of substantial & unjustified risk that’s a gross deviation from what a law abiding person would do (gravity of foreseeable harm; probability of harm; burden to in not engaging in risk) Mistake of Fact /Mistake of Law Common Law: Mistake of Fact Specific Intent: Honest mistake is a defense when it overcomes mens rea General Intent: Honest & reasonable mistake is a defense Common Law: Mistake of Law Specific Intent: Honest mistake of law is a missing element General Intent: Mistake ≠ defense MPC: Ignorance/Mistake of fact/law is a defense if it negatives req’d culpability level, the law allows it. Defense isn’t allowed when would have been guilty of a different offense if circumstances had been as thought they were; ↓ grade. Mistake of law is a defense only where it’s unpublished or later deemed invalid Strict Liability Common Law: “Wrong in itself” no need for mens rea MPC: Only where explicitly stated in the statute Homicide Common Law W/Malice Aforethought: Premeditation (First Degree); Not Premeditated: F-M, Abandoned/Malignant Heart Killing (Second Degree) • Premeditation can be formed immediately (Carroll); Need time (Guthrie) No Malice Aforethought: Manslaughter: Voluntary (in heat of passion); Involuntary MPC Murder: Purpose/Knowing; Reckless w/extreme indiff (inc F-M for robbery, rape, arson, etc…) Manslaughter: Recklessness (Risk w/awareness) Negligent Homicide: Risk w/inattention Provocation: Reduces MurderManslaughter Common Law: Can’t have both malice aforethought & heat of passion. Categories v. None MPC: No need for provocation, just EED (if subj. exists, obj determination of reasonableness) F-M: Common Law: Inherently dangerous exception; Killing “in Furtherance (Agency/Prox Cause); Killing by nonfeelo Excuses Duress Common Law: Person of ordinary reasonableness would yield to immediate threat (no homicide) MPC: Coercion by use/threat of unlawful force against ; & in ’s situation; a reasonable person would be caused to act Mental Disorder & Legal Insanity Common Law: M’Naughten Rule: suffered disease that caused her to commit crime either ‘cause she didn’t know what she was doing was wrong or didn’t know nature/quality of act. couldn’t control her conduct; must be sudden lack of volition MPC: has mental disease & subj lacks substantial capacity to appreciate wrongfulness of conduct, conform conduct to law Justification Self-Defense: Actual/Apparent threat of force, immediate & unlawful, subj & obj believed threat, ’s response proportional to threat Choice of Evils: violation of crim prohibition to prevent greater harm Attempts Common Law: Reduced punishment. Mens Rea: Specific Intent. Actus Reas: Dangerous Proximity, Equivocality MPC: Same punishment; Mens Rea: purpose as to conduct, target offense mens rea as to circumstance, knowledge as to result. Actus Reas: substantial step corroborative of crim purpose; allows complete & voluntary abandonment defense Larceny: Common Law: trespassory taking (carrying away) w/o consent; MPC: Exercise of unlawful control Corporate Crime: Can punish corp or individ agent w/in scope of employment, intent to benefit
