NOTICE INVITING TENDER
No: CD-7/Tender/TRC Vouchers/2009-10/9 Dated at Ambala the 27 .08.2009
Sealed tenders are invited by GMTD Ambala on behalf of Bharat Sanchar Nigam
Limited for Manual Feeding of TRC Vouchers & Data Feeding Works in a year in Ambala
SSA.
The estimated cost of work is Rs 5, 91,000/-
Earnest Money Deposit = Rs 14,775/-
Last Date of sale of Tender Form = Up to 1500 Hrs. of dtd 16/09/2009.
Submission of Tender Form = Up to 1500 Hrs. of dtd 17/09/2009.
Date of opening of Tender = At 1530 Hrs. on dtd 17/09/2009.
Tender form containing terms, conditions and technical specification
can be obtained from SDE (Plg) of this office on any working day up to 15.00
hrs of 16/09/2009 on production of Cash Receipt or Crossed Demand Draft of
Rs 1125/- (Inclusive of VAT @12.5%) in favor of A.O. (cash), BSNL, o/o GMTD,
Ambala for the cost of tender form. The tender is to be submitted in two
separate sealed envelopes labeled as under: -
1 Technical Bid (Envelope no 1) :-
a) Copy of latest Partnership Deed or Memorandum of Article of Association as the
case may be duly attested. However, in case of individual/Sole proprietor, an
affidavit to this effect shall be submitted.
b) Tender document duly signed by the tenderer on each page.
c) Attested copy of Experience Certificate of satisfactory performance of
completion of two similar nature work done in BSNL/MTNL/DOT, each costing
not less than 50% of the tender cost during the last 3 years from officer not
below the rank of Divisional Engineer.
d) Attested copy of certificate of registration of EPF & ESI.
e) Affidavit on stamp paper Rs 5/- regarding declaration of No Relative working
anywhere in BSNL/DOT/MTNL.
f) Cost of tender form in shape of D.D. in favour of AO cash o/o GMTD Ambala,
in case of download.

g) Original receipt of Earnest Money Deposit of Rs 14,775/- deposited with AO
(Cash), Ambala or Crossed Demand Draft in favour of AO(Cash) BSNL o/o
GMTD, Ambala.
h) Attested copy of certificate of registration of Service Tax.
2. Financial bid (Envelop no. 2)
The financial bid containing the Annexure-II of bid
document i.e. Schedule of rates duly signed by the bidder.
The envelop No. 1 & 2 should be placed in one separate sealed envelop and
superscribed as “Tender for manual feeding of TRC vouchers in SSA Ambala”
accompanied by all the relevant documents and Earnest Money addressed to AGM (Plg)
o/o GMTD, Ambala should reach him upto 15.00 hrs of 17/09/2009, which shall be opened
on the same day at 15.30 hrs. (Next working day if it happens to be a holiday) in the
presence of such tenderer who may wish to be present at their own expenses. Only
technical bid will be opened. The financial bid will be opened only of those bidders who
qualify in the technical bid.
The tender document can be downloaded from the website. The cost of the
tender document shall be submitted along with the down loaded Tender document in the
form of D.D. in favour of AO (Cash) BSNL, GMTD, Ambala for Rs 1125/- (inclusive of
VAT @12.5%) separately.
Tenders received without EMD or if the D.D. not found in order would be
summarily rejected and financial bid will not be opened of such tenderers. If any
document/certificate found false/fake at any stage, the EMD/Performance Bank Guarantee
shall be forfeited.
The GMTD, Ambala reserves the right to reject any or all the tenders without
assigning any reason.

SCOPE OF WORK
1) Manual Feeding of TRC has to be completed on day-to-day basis. Any failure would
attract a liquidated damage of 10 % per day of delayed work delayed in the calendar
month subject to maximum of 10 % of total contract value.
2) Any delay due to Departmental reasons would not be counted. Otherwise liquidated
damages would be the same as in Clause I.
3) At least three Data entry operator input in the data feeding will be provided by the
Contractor to the Department during the period of feeding of TRC vouchers. At least
3000 TRC vouchers are required to be fed per day including Sundays & holidays by the
contractor so that the work of TRC feeding may be completed well within time fixed
for preparation of sub ledger.
4) Contractor would supervise all the backup of important data. Storage media for the
backup would be provided by BSNL. Unit officer who will be fully responsible for
record or data up keeping will preserve backup.
5) If the system is upgraded during the feeding period then the Contractor will work on the
upgraded system.
6) The Contractor shall be given full access to the equipment for Data feeding. The
contractor shall have to take care of equipment as well as the related software and will
keep it in suitable working conditions.
7) Department shall be free to move the equipment, within its offices. The intimation in
this regard shall be given to the contractor. No extra charge on the system, on account
of such movements shall be payable to the contractor.

TERMS AND CONDITIONS
1. The tenders should be submitted in Selaed Cover addressed to AGM (Planning) O/o
GMTD, Ambala subscribed “Tender for Feeding TRC vouchers” in SSA Ambala, The
same shall be delivered either in the person or by Registered Post so as to reach this office
latest by 15.00 hrs on 17/09/2009. The tenders received by post or Courier service after due
date and time will not be entertained. The submission of more than one tender and under
different names shall be outrightly rejected.
2. The tender will be opened at 15.30 hrs on 17/09/2009 in the chamber of AGM (Plg.) O/o
GMTD, Ambala in the presence of tenderers or their representatives who wish to be present
at their own cost.
3. Each tenderer shall have to deposit an Earnest Money as mentioned in the NIT with A.O.
(Cash) O/o GMTD, Ambala either in cash or in form of Demand Draft drawn on any of the
Nationalised bank or scheduled bank payable at Ambala in favour of A.O. {Cash} O/o
GMTD Ambala and cash receipt in original issued by A.O. (Cash) O/o GMTD Ambala
should be attached with the Tender Form. The tender without Earnest Money receipt will
be rejected out rightly.
4(a). The rates shall be quoted in figures as well as words and should be inclusive of all
taxes, duties and other levies etc but excluding of service tax. Correction if any, must be
signed in full by the tenderer, otherwise the tender is likely to be rejected. The conditional
and incomplete tenders are liable to be rejected. The contractor will obtain the Service Tax
Registration Number as per rules of Govt, as applicable.
4(b). The contractor will take labour licence, if required, under the rules and he will be
responsible for deposit of all statutory dues to the Govt in r/o the persons engaged for the
work in BSNL. BSNL will not take any responsibility for employment or any statutory
dues for the same.
5. The rates accepted will ordinarily be operative for a period of one year only from the
date of agreement. However, the GMTD Ambala reserves the right to extend or reduce the
period, if necessary according to requirement from time to time. Total quantity of TRC
vouchers is appx 7 Lacs in number during the year.
6. If the tender is withdrawn before the expiry of validity or after the acceptance of tender,
the Earnest Money / Security deposit of the tenderer is liable to be forfeited. The Earnest
Money shall be returned to the tenderer in accordance with the departmental rules for
which a pre – receipt should be submitted with the tender form in duplicate.
7. The successful tenderer shall have to deposit security as performance security money
equal to 10% of the approved value of the Contract and earnest money deposited shall be
converted into security deposit and balance amount of security deposit will be deposited i.e.
in cash or in shape of Bank Guarantee valid for 18 months from scheduled / Nationalised
Bank. The security money shall be refunded to the contractor after expiry of the Contract
agreement on obtaining NO objection / No Dues Certificate from the concerned officer
incharge. The Contractor shall have to enter in to signing of contract agreement before
issue of work order for implementation.

8. The Department will not be liable to pay any interest on the Earnest Money or security
deposit that is in its custody. BSNL also reserves the right to forfeit the earnest money /
Security deposit. If the tenderer before or after acceptance of the tender fails to comply
with any terms and conditions set out above or in any other contract agreement which may
be drawn as a consequence of this tender.
9. If any information furnished by the tenderer is found to be false or incorrect at any time,
the contract is liable to be terminated without any notice.
10. The successful tenderer should clarify and offer his signature on each and every page of
the tender document and return it along with this tender offer as a token of his
acceptance of each of the conditions specified on each page of the tender document.
11. Any attempt to negotiate directly or indirectly on the part of the Tenderer with the
authority to whom he has submitted the tender to the authority who is competent to
finally accept the offer or endeavors to secure interest for the acceptance of the
particular tender will render the tender exclusion from consideration.
12. The successful tenderer (Contractor) shall not assign as sub – contract for the whole or
any part of the works carried by this contract or any benefit thereof without prior
written approval of the GMTD Ambala.
13. There is no any near relative of the tenderer is of BSNL employees and also no
Gazetted officer retired from the Govt. service is allowed to work as a contractor as per
performa attached.
14. The tender document should accompany by the following documents:
a) Copy of latest Partnership Deed or Memorandum of Article of Association as the
case may be duly attested. However, in case of individual/Sole proprietor, an
affidavit to this effect shall be submitted.
b) Tender document duly signed by the tenderer on each page.
c) Attested copy of Experience Certificate of satisfactory performance of

h) Attested copy of certificate of registration of Service Tax.

15. Payment:
A.O. (Cash) O/o GMTD Ambala shall make the payment to the contractor on monthly
basis i.e. after every month of completion of job. The contractor shall raise the bill for the
work executed which shall be duly checked and verified by the concerned authority.
16. Other Conditions:
A. The GMTD, Ambala reserves the right to carry out this work in part or full through
department or through any contactor or agency of contractors for any of the
prescribed work. The authority also reserves the right to appoint one or more
contractors for the job.
B. Successful tenderer has to sign the agreement within a week’s time from the date of
accepting the tender by competent authority of the department.
17. Additional Charges recoverable from the contractor:
In case of loss to the Govt. Property caused by the contractor during the maintenance
of the system, it shall be made good by the contractor by replacing the damage part by
good one or delay on the part on the contractor shall also attract penalty clause.
18. Termination:
If the contractor commits any breach of this agreement or provides unsatisfactory
service during the implementation period, the GMTD, Ambala may by a written notice,
terminate this agreement. On termination under this clause, the contractor has to refund
any amount due to GMTD, AB. In such an event the GMTD, Ambala shall forfeit the
security amount.
19. Arbitration
ARBITRATION- In respect of any dispute arising out in connection with the
interpretation of any clause in the terms of contract/agreement or otherwise the matter
shall be referred for arbitration to the CGMT Haryana, Ambala who shall appoint an
arbitrator to decide the case. The appointment of such arbitrator shall not be questioned
by the contractor on the ground that the arbitrator belongs to BSNL/Department of
Telecommunication. The provision of the arbitration & reconciliation Act 1996 or any
statutory modification or enactment there of and the rules there under and for the time
being in force shall apply to the arbitration proceedings under this clause.
Even during the arbitration, the work can not be stayed because it pertains to the
essential public utility service. The Department reserves the right to get the work
completed either departmentally or through any other contractor at the cost of the
contractor. All disputes will be settled with in the court jurisdiction of AMBALA SSA
only.
20. In case of breach of any tender condition, delay or non-performance of work
or supplies, poor quality of work, submission of fake documents/certificates BSNL may
take all or any of the following actions at any stage of bid:
i) Forfeiture of E.M.D,
ii) forfeiture of S.D.,
iii) cancellation of contract,

iv) Barring in participation of all future tenders of BSNL/MTNL/DOT for a
period of 3 years or more.
21. LABOUR WELFARE MEASURES AND WORKMAN COMPENSATION:
21.1 Obtaining License before commencement of work:
The contractor shall obtain a valid Labour License under the Contract Labour
(R&A) Act 1970 and the contract labour (Regulation and Abolition) Central Rules 1971
before commencement of the work & till completion of work. The contractor shall also
abide by the provisions of the Child Labour (Prohibition and Regulation) Act 1986. Any
failure to fulfill, this requirement shall attract the penal provisions of resultant this contract
arising out of the non-execution of the work.
21.2 CONTRACTORS LABOUR REGULATIONS :
21.2.1 Labour records:
21.2.1.1 The contractor shall maintain a register of persons employed on work on
contract in Form XIII of the Contract Labour (R&A) Central Rules 1971.
21.2.1.2 The contractor shall maintain a Muster Roll register in respect of all workmen
employed by him on the work under contract in Form XVI of the CL(R&A) Rules-
1971.
21.2.1.3 The contractor shall maintain a Wage Register in respect of all workmen
employed by him on the work under contract inform XVII of the CL (R&A) Rules-
1971.
21.3 Inspection of Books And Slips :
The contractor shall allow inspection of all the prescribed labour records to any of
his workers or to his agent at a convenient time and place after due notice is received
or to the labor officer or any other person, authorized by the Central B.S.N.L. on his
behalf.
22. COMPLIANCE WITH LAWS AND REGULATION:
22.1 During the performance of the works the contractor shall at his own cost and
initiative fully comply with all applicable laws of the land and with any and all
applicable by-laws rules, regulations and orders and any other provisions having the
force of law made or promulgated or deemed to be made or promulgated by the
B.S.N.L., Govt. agency or department, municipal board, Govt. of other regulatory or
Authorized body or persons and shall provide all certificates of compliance
therewith as may be required by such applicable law. By-laws, rules, regulations,
orders and/or provisions. The contractor shall assume full responsibility for the
payment of all contributions and pay roll taxes, as to its employees, servants or
agents engaged in the performance of the work specified in the contractor
documents. If the contractor shall require any assignee or sub-contractor to sham any
portion of the work to be performed hereunder may be assigned, sub-leased or sub-
contracted to comply with the provisions of the clause and in this connection the
contractor agrees as to undertake to save and hold the B.S.N.L. harmless and
indemnified from and against any/all penalties, actions, suits, losses and damages,
claims & demands and costs (inclusive between attorney & client) charges and
expenses whatsoever arising out or occasioned, indirectly or directly by failure of the

contractor or any assignee or sub-contractor to make full and proper compliance with
the said by laws, Rules, Regulations, Laws and Order and provisions as aforesaid.
22.2 Contractor will be responsible for any accident, mishap and injury to his workers
while carrying out the work. Compensation to the affected worker, if any, will be
the liability of the contractor.
22.3 No labour below the age of eighteen years shall be employed on the work.
22.4 The contractor shall comply with the provisions of the payment of Wages Act,
1980, Minimum Wages Act, 1948, Employees Liabilities Act, 1988. Workmen
Compensation Act, 1923 etc. as amended from time to time.
22.5 The BSNL may required the contractor to remove from the site of work any person
or persons in the contractor’s employment for the work, who are found to be
incompetent, or whose conduct is not found satisfactory and the contractor shall
forthwith comply with the requirement.
22.6 Any notice requiring to be served upon the contractor shall be deemed to be
sufficiently served if handed over to the contractor or to the authorized
representative of the contractor personally or addressed to the contractor (Regd.
Post) at the actual or last known place of the contractor’s business/residence.
