Victoria
The cap means that any shop can trade on Christmas Day if the number of persons employed and working in the shop on 25 December 2006 does not exceed 20 and at any time in the 7 days
before 25 December 2006 the number employed and working in the business in shops of any kind in Victoria does not exceed 100. For the purpose of calculating if you have more than 100
persons employed you total the number of hours worked by all persons employed and working in the business during the relevant period and divide the total by 38.

Cap does not apply to certain shops: Certain types of shops can trade on Christmas Day regardless of the number of employees employed in the shops.

A shop is not subject to an employee cap, if the predominant business carried on in that shop is that of a:

•         A chemist shop                                                                                 •     Any other shop that sells cooked or prepared meats that are ready to eat on the premises
•         A petrol shop                                                                                        or to be consumed off the premises or
•         An eating house                                                                                •     A prescribed kind of shop
•         A restaurant                                                                                   •     A café

A prescribed shop is a shop deemed to be an essential service shop by the Minister and prescribed exempt by regulation.

Retail service shops: The Shop Trading Reform Act 1996 no longer applies to shops for the retail provision of services (as opposed to goods) nor to shops for the hire of goods, therefore such shops
may trade Christmas Day, 25 December 2006. This means that hairdressers, shoe repairers, dry cleaners, tailors, dressmakers, photographers and undertakers or other retail service shops that are not
wholly or predominantly for the sale of retail goods are not covered by the legislation and can trade on 25 December 2006.

Tasmania
Certain shops must not be kept open at any time on Christmas Day

Where a person, or a group of persons, carries on a business or businesses of selling goods by retail at a shop or shops located in Tasmania and the number of persons employed, whether in a full-time
capacity or a non-full-time capacity, in that business or those businesses exceeds 250 at any time during the period beginning at 8 a.m. on the Monday of any week and ending at 6 p.m. on Friday of the
same week, being a week immediately preceding Christmas Day those shops shall not be kept open.

Where a person, or a group of persons, carries on a business or businesses of selling goods by retail at a shop or shops located in Tasmania and a franchise agreement is in force between a major
retailer and that person or group of persons then that shop/shops must also be kept closed ob Christmas day.

New South Wales
General shops are all shops other than scheduled shops for the purpose of s.78(1) of the NSW legislation. Scheduled shops are Audio shops, Book shops, Chemists' shops, Confectioners' shops, Fish
shops, Flower shops, Fruit and vegetable shops, Garden plant shops, Newsagencies, Pet shops, Souvenir shops, Tobacconists' shops, Vehicle service shops, Vehicle shops, Video shops and Cooked
food shops, being: cake and pastry shops, cooked provision shops, refreshment shops, restaurants, and take-away food shops.

Small shop: A shop is a small shop for the purposes of the NSW legislation if it complies with the requirements of this section. The shopkeeper or shopkeepers of a small shop is or are to be natural
persons not exceeding 2 in number (whether or not carrying on the business of the shop in partnership) or 1 corporation. The shopkeeper or shopkeepers of a small shop is or are to be the owner or
owners of the business of the shop and entitled to the profits of that business.

The number of persons engaged in a small shop as employees or otherwise in the conduct of the business of the shop on any day (either at the same time or at

different times) is not to exceed 4. Those 4 do not include:

•    the shopkeeper or shopkeepers or, if the shopkeeper is a corporation, not more than 2 natural persons who are shareholders of the corporation, or
•    any person so engaged in an emergency during the absence from the shop for part of a day of a person who is so engaged in the shop on that day, or
•    any person so engaged outside the normal working hours of any person so engaged on a full-time basis.

The employee cap does not apply to a shop during a period of exemption for holidays resorts specified in an order in respect of an area or locality within which the shop is situated.

A shopkeeper of a small shop is not to be a person acting as the employee of or acting directly or indirectly as the agent of another person in the conduct of the business of the shop.

A shop is not a small shop if a direct or indirect interest in the business of the shop is held by:

•    a corporation that is engaged in a business other than the business of the shop*, or
•    a director of a corporation that is engaged in a business other than the business of the shop*, or
•    any other person who is engaged, as an employee or otherwise, in a business other than the business of the shop, or

*Any corporation (whether or not engaged in a business) that for the purposes of section 50 of the Corporations Act 2001 of the Commonwealth is to be taken to be related to a corporation

A reference in any other Act, award or instrument to a small shop as defined in section 76A of the NSW legislation is to be read as a reference to a small shop within the meaning of this section.

"Business" means: the business of the sale of goods by retail, or the business of a hairdresser. "Shareholder", in relation to a corporation, means a person having a relevant interest in a share in that

corporation for the purposes of Part 6C.1 of the Corporations Act 2001 of the Commonwealth.

General shops in tourist areas permitted to trade Boxing Day 2006 and New Year’s Day 2007

The NSW Government has exempted general Shops in certain tourist locations from the requirement to be kept closed on Boxing Day 2006 and New Year’s Day 2007. General shops in the
following areas may trade on these public holidays: City of Albury, Shire of Ballina, Shire of Bega, Shire of Bellingen, Shire of Berrigan, City of Blue Mountains, Shire of Byron, Municipality of Coffs
Harbour, Shire of Cooma-Monaro, Shire of Coonabarabran, Sire of Corowa, Municipality of Deniliquin, Shire of Dungog, Shire of Eurobodalla, Shire of Gloucester, City of Gosford, City of Grafton,
Shire of Great lakes, Municipality of Hastings, Shire of Kempsey, Municipality of Kiama, Shire of Kyogle, City of Lismore, Shire of MacLean, Town Improvement District o Mathoura, Shire of
Nambucca, Shire of Narrandera, Shire of Port Stephens, Shire of Richmond River, Municipality of Shellharbour, City of Shoalhaven, Shire of Singleton, City of Greater Taree, Shire of Tweed, Shire
of Walgett, Shire of Wingecarribee and the Shire of Wyong.

South Australia
Exempt shop means:
•    A shop the floor area of which does not exceed 200 square metres; and which does not adjoin, and is not adjacent to, a building, with a floor area exceeding one-half the floor area of the shop,
     that is used as a storeroom for the purposes of the shop; or
•    *A shop the business of which is the retail sale of all or any of the goods set out in any one of the following subparagraphs: antiques (other than coins or stamps); or live fish, fish food,
     aquariums, accessories for aquariums; or paintings, reproductions, drawings, etchings, pottery, sculptures, artifacts, wood carving, leatherware, weavings, hand-made goods of glass, iron,
     copper or silver; or newspapers, books, periodicals, greeting cards, posters, wrapping paper, stationery; or pharmaceutical preparations, cosmetic and toilet requisites, first aid requisites,
     medical and surgical appliances; or fresh flowers, living plants, floral arrangements, wreaths; or non-alcoholic drinks, ice-cream, confectionery, light refreshments; or household pets, pet foods
     or accessories; or garden supplies; or food—for consumption on the shop premises or prepared on the shop premises for consumption off those premises; or souvenirs of a time, place or
     occasion, identified as such by inscription, stamping or marking; or cigarettes, cigars, tobacco, smoker's requisites; or caravans; or trailers; or
•    A hairdresser's shop; or
•    *A shop the business of which is the sale of foodstuffs and which has a floor area that does not exceed 400 square metres and which does not adjoin, and is not adjacent to, a building, with a
     floor area exceeding one-half the floor area of the shop, that is used as a storeroom for the purposes of the shop; or
•    *A shop within the premises of a squash centre, ten pin bowling alley or golf club, the business of which is the retail sale of sporting goods of a kind used in the sport carried on in or about
     those premises; or
•    A garden shop of the kind specified but does not include any shop the business of which is solely or predominantly the retail sale of motor vehicles (other than caravans or trailers) or boats; or
     motor spirit or lubricants;
*A shop is not an exempt shop unless during the immediately preceding period of seven consecutive trading days of the shop the aggregate price of all goods sold at the shop and that fall within any
one or more of the classes of goods referred to in those paragraphs is 80 per cent or more of the aggregate price of all goods sold at the shop during that period.

Shopping district means the Central Shopping District; or the Metropolitan Shopping District; or the Glenelg Tourist Precinct; or any Proclaimed Shopping District. For enquiries on these shopping
districts contact ARA Employee Relations. At the time of writing the following were Proclaimed Shopping Districts: Binnum, Blyth, Bute, Booleroo Centre, Caltowie, Cowell, Cleve, Georgetown,
Lameroo, Lock, Melrose, Minlaton, Morgan, Orroroo, Pinnaroo, Pt. Broughton, Pt. Lincoln (under review), Streaky Bay, Tailem Bend, Willimington, Yorke Peninsula, Balaklava, Burra, Gladstone,

Hardware & building materials, floor coverings, furniture and auto parts & accessories shops in shopping districts: May open the shop 9am-5pm on Proclamation Day, New Year’s Day and
Australia Day provided if, during the immediately preceding period of seven consecutive trading days of the shop the aggregate price of goods sold that fall in within any one or more classes of

hardware, floor coverings, furniture and auto parts goods sold at the shop is 80 per cent or more of the aggregate price of all goods sold at the shop during that period; and the aggregate price of all
hardware and building materials of a kind prescribed (Call ARA Employee Relations for further information) sold at the shop during that period does not exceed 20% of the aggregate price of all
hardware and building materials sold at the shop during that period.


Extended trading hours in South Australia
The South Australian Government have announced that the government has extended trading hours in the Central Shopping District from Thursday 21 December 12.01am to 5pm on Saturday 23
December 2006. Shops in the Central Shopping District will also be able to commence trade at 7am on Sunday 24 December 2006 rather than the traditional 11am start. An exemption has also
been granted to Westfield Marion to trade from 9pm-12midnight on Thursday 21 December and 9pm-12midnight on Friday 22 December 2006 and to open from 7am on Sunday 24 December 2006
in addition to normal trading hours.

Western Australia
The Retail Trading Hours Act 1987 applies to the part of the State south of the 26th parallel of South Latitude. This Act does not apply to a place that is used for or in connection with a show held by
an incorporated agricultural or horticultural society or a bazaar or fair the proceeds of which are intended for religious, charitable or public purposes. The Act does not apply to a place that is used
as a restaurant or a café, a take-away-food shop, a veterinary clinic or a retail shop and is located in a public passenger transport terminal or station where public passenger transport services are
running.

General retail shops: Retail shop that is not a small retail shop, a special retail shop or a filling station shall be regarded as a general retail shop.

Small retail shops: A retail shop shall be regarded as a small retail shop if only goods or services that are prescribed for the purposes of sale at a small retail shop are sold or provided at the retail
shop. The small retail shop must be owned by one eligible person or not more than 4 eligible persons trading in partnership or by a body corporate with not more than 4 shareholders all of whom
are eligible persons and the retail shop is operated for the benefit of the eligible persons and the eligible persons are personally and actively engaged in the retail shop. Not more than 5 persons
(inclusive of the eligible persons who own and operate the retail shop) may work in the retail shop at any one and the same time and the retail shop is owned and operated in accordance with the
directions of the Minister. The small shop must be certified as a small shop for the purpose of the legislation.

Special Retail Shops include: Newsagencies; pharmacies; garden nurseries; hardware shops; video shops; art and craft shops; souvenir and duty free shops; shops at sports venues; marine craft
shops; motor vehicle spare parts shops; and shops at international standard hotels.

If a business wants to operate a Special Retail Shop or are considering converting to the Exempted General Retail Shop (Small Shop) category, the business must apply to the Ministry for a
certificate.

Filling stations: A retail shop shall be regarded as a filling station if the whole or part of the business of the retail shop constitutes the sale of fuel and any pump or contrivance in a filling station for
supplying fuel is deemed to be included in the filling station. Service station trading hours are completely deregulated in all areas. There are restrictions on the range of non-petroleum or motor
vehicle related goods which may be sold from service stations after General Retail Shop hours.


Extended trading hours in Western Australia
The Western Australian Government has announced that for the 2006 Christmas period extended trading hours will be: Sunday 10 December 10am-5pm, Monday 11 December-Saturday 16
December-normal trading, Sunday 17 10am-5pm, Monday 18 December and Tuesday 19 December-normal trading, Wednesday 20 December-Friday 22 December 8am-9pm, Saturday 23

December normal trading, Sunday 24 December 10am-5pm, Monday 25 December and Tuesday 26 December-closed (subject to above exemptions), Wednesday 27 December 8am-9pm,
Thursday 28 December--Sunday 31 December-normal trading hours and Monday 1 January 2007-closed (subject to the above exemptions). The extensions apply to general retail shops in the

metropolitan area including those in the Perth and Fremantle Tourism Precincts. The extensions will be available to non-metropolitan local government authorities other than where a Council
applies to Consumer Protection to vary the arrangements. The extensions will not apply to general retail shops in the City of Rockingham or the localities of Two Rocks and Yanchep, where specific
extended trading Orders apply. The Christmas extensions do not affect the trading hours of motor vehicle dealers.

Queensland
Exempt shops: Exempt shops are shops that predominantly sell goods by retail, or for supplying services, that a reasonable person would expect to be sold or supplied in such shops. The trading
hours of exempt shops are totally unrestricted. The occupiers of these shops may trade whenever they wish, however, hours of trade may be restricted by virtue of some other Act or contract. For
example, licensed premises, tenancy contracts, etc. The following shops are listed in the Act as exempt: antique shop, aquarium and aquarium accessories shops, art gallery, arts and crafts shop,
bait and tackle shop book shop, newsagency, bread shop, cake shop, pastry shop, camping equipment shop, chemist, confectionery shop, cooked provisions shop (where the provisions are cooked
or heated on the premises immediately before sale), delicatessen, fish shop, flower shop, fruit, vegetable or fruit and vegetable shop, funeral director's premises, hair salon, beauty salon or barber
shop, ice-cream parlour, licensed premises within the meaning of the Liquor Act or Wine Industry Act, marine shop, milk bar, plant nursery, shop for selling garden plants and shrubs, seeds, garden
and landscaping supplies or equipment and associated products, pet shop, photographic shop, premises which are licensed under the Pawnbrokers Act, restaurant, café, refreshment shop, service
station, shop for selling motor vehicle spare parts and/or motor cycle parts, soap shop, souvenir shop, sporting goods shop, temperance beverages shop, tobacconists, toy shop, veterinary supplies
shop and video cassette shop (blank or pre-recorded).

Non-exempt shops: A non exempt shop means a shop other than an exempt shop, and independent retail shop, an office or a stall.

Independent retail shops have unlimited trading hours provided they meet certain criteria. Generally these shops are the 'small' retailers where the business is run by a single operator or a private
company and where a maximum of 20 people are engaged in the shop at any one time and if a number of shops are operated throughout the State, a total of not more than 60 people are engaged
at any one time in all the shops being operated. Independent retail shops must remain closed throughout the whole of 25 December (Christmas Day). Independent retail shops that are
predominantly food and/or grocery shops are allowed to open on Christmas Day. An independent retail shop must meet the following criteria: The business is run by an individual, partnership or a
proprietary company (does not include a public company or a related corporation), the number of people engaged at any one time in the shop including the owner is not over 20 and the number of
people engaged by the owner of the business in all shops throughout the State is not more than 60 at any one time.

The definition excludes certain types of shops and arrangements including exempt shops, offices, shops selling wholly or partly wholesale products, shops selling motor, vehicles or caravans and
stalls in a market.

South-East Queensland: South-East Queensland area means the existing Sunshine Coast area and the area east of the Bruce Highway between the existing Sunshine Coast area and the
Brisbane statistical division and the area occupied by non-exempt shops fronting onto the western side of the Bruce Highway between the existing Sunshine Coast area and the Brisbane statistical
division and the Brisbane statistical division and the local government area for
the Gold Coast City Council that is not included in the Brisbane statistical division and the islands in the coastal waters of the State east of the areas mentioned in paragraphs above that are not
included in the Brisbane Statistical Division. Brisbane Statistical Division: The Brisbane Statistical Division means the Brisbane statistical division defined in the 2001 edition of the Australian
Standard Geographical Classification (Cat. No. 1216.0) published by the Australian Bureau of Statistics and includes the localities within the boundaries of a number of localities. For enquiries call

Area of City Heart of Inner City of Brisbane: Provided that the ‘Area of the City Heart’ of the inner City of Brisbane shall be deemed to be the area within the following boundaries:-Commencing at
the outer extremities of the junction of Edward Street and Alice Street; thence along Alice Street to its junction with William Street and North Quay; thence along William Street and North Quay to its

junction with Makerston Street; thence along Makerston Street to its junction with Roma Street; thence along Roma Street to its junction with Albert Street; thence along Albert Street to its junction

any of the named streets shall be deemed to be within the defined area.

Tourist and/or Seaside resorts: Rainbow Beach; Tin Can Bay; Burrum Heads; Woodgate: Elliott Heads; Bargara; Moore Park; Keppel Sands; Emu Park; Yeppoon; and the islands off the sea
coast of Queensland being part of the State of Queensland. Provided that for the purposes of trading on Sundays and Public Holidays this definition excludes the islands as defined in clause (1) of
Schedule 1.

Gold Coast Area: That part of the eastern portion of the State within the following boundaries:-Commencing at the junction of the sea coast and the southern bank of the Coomera River thence
along the southern bank of that river to its junction with Coombabah Creek; thence by the southern bank of that creek to the Gold Coast Highway; thence westerly along the Gold Coast Highway to
its junction with the Pacific Highway; thence by a straight line to the point on the Nerang River situated 1 kilometre in a direct line westerly from the nearest point on the western boundary of the
pacific Highway; thence by a line parallel to, and one kilometre to the west of, the western boundary of the pacific Highway to the intersection of that line with the Tallebudgera Creek Road; thence
by a straight line to a point on the Queensland – New South Wales border situated 6 kilometres in a direct line from the sea coast at its nearest point; thence by that border to its junction with the sea
coast; thence by the sea coast to the point of commencement.

Sunshine Coast Area: Commencing at the far north point of Noosa Heads then following the coast line west, to the Noosa River, following the river to its junction with Wooroi Creek, then following
Wooroi Creek to its junction with McKinnon Drive, then following that road east to its junction with Butler Street, then following Butler Street south west (the road becoming Cooroy-Noosa Road) until
its junction with Beckhams Road, following that road to its junction with the Eumundi Noosa Road, then following that road to its junction with Fellowship Drive, then in a straight line south to
Diddilibah Road, then following that road west to the Bruce Highway, then following the Bruce Highway to its junction with the Sunshine Motorway, then following the Sunshine Motorway east to its
junction with Military Road, then in a straight line south to Bells Creek, then following that creek to the Pumicestone Channel; and the suburb of Maleny.

Cairns Tourist Area: The area within the following boundaries:- Commencing at a line due west from the Sea Coast to the junction of Jensen and Montrose Streets; then a line due south to the
junction of Laurel Avenue and Hardy Road, then a line due east to the sea coast; and commencing from the township of Ellis Beach where it is located on the Captain Cook Highway, then following
the captain Cook Highway in a southerly direction to the point where the Captain cook Highway crosses the Barron River, then following the Barron River in an easterly direction to the sea coast,
then following the sea coast in a northerly direction to the point of commencement (viz the township of Ellis Beach where it is located on the sea coast); and commencing from the junction of the
Captain Cook Highway and Stanton Road, west along Stanton Road to the junction of Stanton Road and Upper Stanton Road, then a line due south to the Kennedy Highway, then east along the
Kennedy Highway to the junction with the Captain Cook Highway then north along the Captain Cook Highway to the point of commencement.

Townsville Tourist Area: The area within the following boundaries: Commencing at the junction of Morris Street and Flinders Street; thence along Flinders Street to Bridge Street; thence by Bridge
Street to the railway line; thence by the railway line to its junction with Ross creek; thence by the northern bank of that creek to a point in a direct line with the Strand; thence along the Strand to its

then westerly direction to the mouth of Waite Creek. Then south along Waite Creek to the junction of Waite Creek and Shute Harbour Road and continuing south along Shute Harbour Road to its
junction with Milk Depot Road. Then in a line of a north easterly direction to the eastern end of Tropic Road, then to the eastern most end of Eshelby Drive, then to the junction of Orana Street and
Waterson Road. Then proceeding in a line back to the junction of Coconut Drive and Shute Harbour Road crossing the intersection of Harper Street and Golden Orchard Drive.
