                        held on Monday 9 May 2005 at 6.30 pm
                               in the Council Chamber

1.       Apologies

         Apologies were received from Councillors T Antonio, EJ Hughes and Ms J Hugo –
         Relieving Manager Infrastructure.


2.    General Section

2.1   Rigney Street Concrete Footpath

Cr Scheide moved          )        Council resolved:
Cr Hodge seconded         )
                                   1. That Council alter the construction program for
                                      concrete footpaths in the current program, postpone
                                      the works in Rigney Street and concentrate on
                                      continuing to construct a path on one side of every
                                      street.
                                   2. That Council officers develop a policy for the
                                      construction of concrete footpaths in areas of
                                      Whyalla that have landscaping to the back of the
                                      kerb and this policy be presented to Council for
                                      approval.
                                   3. That Council officers look at the residence located on
                                      the corner of Rigney Street which has requested a
                                      concrete footpath and look at future options for the
                                      provision of accessible pedestrian access.

2.2    Receive the 1st Draft of the 2005/06 Budget

Cr Coombe moved               )      Council resolved that it receives the draft budget for the
Cr McGinniss seconded         )      2005/06 financial year.

                                     Carried

Cr Scheide moved              )      Council resolved that the officers be thanked for their
Cr Stovell seconded           )      efforts in preparing the draft budget.

                                     Carried

Cr Scheide moved              )      Council resolved that the 1st draft budget, along with
Cr Velthuizen seconded        )      comments, be made available for public consultation.

                                     Carried

Cr Scheide moved              )      that correspondence tabled from Tennis SA be received.
Cr Hodge seconded             )
                                     Carried

Cr Scheide moved              )      Council resolved that a report to the next Council
Cr Hodge seconded             )      meeting to consider the draft budget in late May include:

                                     1. details on the Whyalla Tennis Club’s financial
                                        position;
                                     2. details of their current loan;
                                     3. details of their lease agreement;
                                     4. Strategic Plan reference; and
                                     5. membership trends and fees.

Cr Pickert moved              )      Council resolved that the appropriate officer prepares a
Cr Velthuizen seconded        )      report on the costs of operating the Jetpatcher vs
                                     outsourcing.

                                     Carried

2.3    Public Passenger Transport Service

Cr Stovell moved              )      Council resolved that:
Cr Scheide seconded           )
                                     1. following a specific request from the Minister for
                                        Transport, Mr Pat Conlon, Council continues to
                                        contribute its one third funding for a period not
                                        exceeding six weeks in relation to the funding of
                                        buses in Whyalla;
                                     2. Provincial Cities are advised of Council’s decision;
                                        and
                                     3. Council issues a media release in relation to its
                                        decision.

3.     ITEMS FOR DECISION AS TO CONFIDENTIALITY IN ACCORDANCE WITH
       SECTION 87(10) OF THE LOCAL GOVERNMENT ACT 1999

3.1    Core Site – Development Deed

Cr Hodge moved                )       Council resolved that under the provisions of Section
Cr McGinniss seconded         )       90(3)(b) of the Local Government Act 1999, an Order be
                                      made that the public be excluded from attendance at the
                                      meeting in order for Council to receive, discuss or
                                      consider in confidence, Agenda Item 3.1

                                      that Council is satisfied that it is reasonably foreseeable
                                      that the public disclosure or discussion of the information
                                      included in the report from the Manager Environment
                                      and Planning could

                                      reasonably be expected to prejudice the commercial
                                      position of the person who supplied the information, or to
                                      confer a commercial advantage on a third party, and
                                      would, on balance, be contrary to the public interest

                                      that accordingly, on this basis, the principle that
                                      meetings of Council should be conducted in a place
                                      open to the public has been outweighed by the need to
                                      keep the information or discussion confidential.

3.2    Civic Building Redevelopment

Cr McGinniss moved            )       Council resolved that under the provisions of Section
Cr Coombe seconded            )       90(3)(b) of the Local Government Act 1999, an Order be
                                      made that the public be excluded from attendance at the
                                      meeting in order for Council to receive, discuss or
                                      consider in confidence, Agenda Item 3.2

                                      that Council is satisfied that it is reasonably foreseeable
                                      that the public disclosure or discussion of the information
                                      included in the report from the Relieving Manager
                                      Infrastructure could

                                      reasonably be expected to confer a commercial
                                      advantage on a person with whom the Council is
                                      conducting, or proposing to conduct, business, or to
                                      prejudice the commercial position of Council; and would
                                      on balance, be contrary to the public interest

                                      that accordingly, on this basis, the principle that
                                      meetings of Council should be conducted in a place
                                      open to the public has been outweighed by the need to
                                      keep the information or discussion confidential.
