Terms and conditions
These Terms and Conditions outline the rules and regulations guiding the ballot process to
sell the units at 26 Emery Avenue Woodroffe.
Applications are completed by people who want to enter the Emery Avenue Ballot. The
eligible applications form the pool of applicants from which entries are randomly drawn.
Applicants selected through a ballot draw are required to:
   • undertake and pass the defined eligibility assessment;
   • provide evidence of eligibility;
   • do all things that are necessary or desirable to ensure all eligibility criteria has been
       properly met.
Eligibility assessments will be conducted by the Department of Local Government and
Housing’s NT Home Ownership area, and do not represent a mortgage or loan application.
Subject to the eligibility assessment, including confirmation that the applicant can secure
mortgage finance, once selected from the public ballot, the applicant will have the
opportunity to purchase one of the 16 units on offer.
The Department of Local Government and Housing has the absolute discretion to
determine whether an applicant is eligible to enter the Emery Avenue Ballot.


Definitions
Applicant means:
   • anyone to be listed on the certificate of title of one of the 16 units located at 26
       Emery Avenue Woodroffe; and
   • any spouse / defacto partner of the person to be listed on the title.


Application means Emery Avenue Ballot Application


Assessable income means the sum of all amounts received annually by each applicant.
Amounts received are before taxation, levies and expenses and include monies received
from wages / salaries and superannuation and profit and loss for those who are self
employed.
Not all income types (such as Centrelink Family Tax Benefits) are included as Assessable
Income. If you are unsure please contact the Department of Local Government and
Housing on 8999 8372 or email housingsales@nt.gov.au for further information.
To calculate annual gross household income, applicants must refer to individual Australian
Taxation Office taxation returns for the last financial year and income records for the
current financial year.
Assessable assets means the sum of all assets by each applicant (see Fact Sheet –
Eligibility).


Ballot means Emery Avenue Ballot.


Emery Avenue Ballot means the pool of ballot applications from which entries are
randomly drawn.


Emery Avenue Ballot Application means the application forms and fact sheets included
in this kit. Applications are completed by applicants interested in being placed in the Emery
Avenue Ballot, subject to the validity of their application. Applications remain valid for up to
three months from the date of approval or until such time as all of the Emery Avenue Units
are sold, whichever date occurs first.


Emery Avenue Units means the 16 units situated at Lot 4130 Town of Palmerston, 26
Emery Avenue, Woodroffe in the Northern Territory. These units are offered for purchase
by the Department of Local Government and Housing. The units are offered to eligible
applicants randomly selected by public ballot, subject to confirmation of their eligibility.


First Home Owner Grant means the First Home Owner Grant administered by the
Territory Revenue Office. Details of the First Home Owner Grant including eligibility
criteria can be found at www.revenue.nt.gov.au or by calling the Territory Revenue Office
on 1300 305 353.


Principle Place of Residence Rebate means the Principle Place of Residence stamp duty
rebate scheme administered by the Territory Revenue Office. Details of the Principle Place
of Residence Rebate including eligibility criteria can be found at www.revenue.nt.gov.au or
by calling the Territory Revenue Office on 1300 305 353.


Private Ballot Draw means the first ballot draw taken from the Emery Avenue Ballot. The
ballot draw will be conducted privately by KG Young and Associates, in the presence of the
Department of Local Government and Housing and legal representatives, to randomly
select a shortlist of applicants to attend the Public Ballot Draw subject to confirmation of
their eligibility.
Public Ballot Draw means the second ballot draw taken from the Private Ballot Draw. The
ballot draw will be conducted publicly by KG Young and Associates in the presence of the
Department of Local Government and Housing and legal representatives at a location to be
confirmed. Drawn applicants are offered the opportunity to purchase a remaining Emery
Avenue Unit subject to confirmation of their eligibility.


1. Privacy Statement
Your privacy is important to the Department of Local Government and Housing. Information
you provide in an Emery Avenue Ballot Application is collected, held, used and disclosed
for the purpose of assessing your eligibility for the Emery Avenue Ballot. When you submit
this Emery Avenue Ballot Application, unless you indicate otherwise, your details will also
be registered on the Emery Avenue Units database which will be used by KG Young and
Associates to administer and manage the Emery Avenue Ballot Applications. Your
information may also be disclosed to other organisations to confirm your eligibility for the
Emery Avenue Ballot (eg. Territory Revenue Office or Lands Titles Office). By signing the
Emery Avenue Ballot Application, you are consenting to the use and disclosure of your
personal information in accordance with this Privacy Statement and each of the
Department of Local Government and Housing’s and KG Young and Associate’s
(collectively the parties) generally available privacy policy. To the extent of any
inconsistency between a party’s generally available Privacy Policy and the Privacy
Statement contained in this Emery Avenue Ballot Application, the terms of the Privacy
Statement in this Ballot Application will take precedence. Please indicate on the application
form if you do not wish to receive any marketing materials from the parties.


Disclaimer
Applicants that accept an Emery Avenue Unit do so at their own risk. The Department of
Local Government and Housing and KG Young and Associates are not liable for any claim,
cost, expense, loss or damage whatsoever suffered or incurred (including but not limited to
indirect or consequential loss), or personal injury suffered or sustained as a result of or
arising out of or in any way connected with the conduct of the Emery Avenue Ballot or the
acceptance of an Emery Avenue Unit, except for any liability which cannot be excluded by
law.
