1.0      INTRODUCTION

1.1      Background and Purpose

         In 2000, the City of Cockburn prepared and processed a Consolidated Structure
         Plan for Cells 9 & 10, Yangebup, within Development Area 4. On 30 October 2001
         the WAPC advised that the Structure Plan (SP) generally conformed to the
         Commission’s Policies and endorsed the Plan subject to certain modifications.

         On 20 July 2004, the City adopted a modified SP for a portion of Cell 10 being the
         north east corner of the Cell, bounded by Beeliar Drive and Spearwood, McLaren
         and Tindal Avenues. In adopting this SP, Council sought an Agreement to be
         reached between the landowners of the area with regard to contributions for the
         provision of Public Open Space (POS). No Agreement has been reached by the
         landowners and consequently the City is proposing a modification to the SP which
         will adjust the location of the POS to straddle the boundary between the two main
         holdings (Lots 55 and 56).

         Council has also this year received submissions from the Consultants for the new
         owner of Lot 55 as well as from the “Department of Housing and Works and PRM
         Joint Venture” in regard to their remnant holding along Spearwood Avenue. Council
         has therefore developed this SP to respond to these issues.

         This report only discusses the proposed modifications to the existing SP. All other
         issues such as site analysis, development opportunities and constraints, servicing
         infrastructure etc, remain as per the report accompanying the Consolidated
         Structure Plan.

1.2      Planning Area

         As described above this SP relates to that portion of Cell 10, Development Area 4,
         bounded by Beeliar Drive and Spearwood, McLaren and Tindal Avenues in
         Yangebup. The area is shown on the extract of the existing Structure Plan. The
         land is zoned “Urban” under the Metropolitan Region Scheme and zoned
         “Development” within Development Area 4 of the Council’s Town Planning Scheme
         No. 3. The existing endorsed SP allocates the “Land Classifications” of Residential
         R20, Residential R40, Public Open Space as well as defining the road pattern.

1.3      Land Ownership

         The subject portion contains the following five parcels of land under the ownership
         described below. The parcels are shown on the Structure Plan.

2.0      MODIFIED STRUCTURE PLAN DESIGN

2.1      Open Space Configuration

          The existing SP locates an area of POS, within the approximate centre of the
          portion but wholly within Lot 56. As outlined above, Council had required an
          Agreement be reached between the owners of the various parcels. As this has not
          occurred Council is now proposing under this SP to move the POS 35 metres to
          the south, thereby straddling the boundary between lots 55 and 56 to enable each
          owner to satisfy their 10% POS on their own land thus eliminating the need for any
          agreement. The revised POS locations, R codes and roadways are shown on the
          modified Structure Plan.


2.2      “R” Coding

         Most of the land classified as Residential under the SP has been allocated an R
         Code of R20. This is consistent with the majority of Residential land within Cells 9
         and 10.

         The land adjacent to the POS has been allocated an R Code of R40 as has an area
         in the south east corner of the portion which is adjacent to another area of POS.
         This is consistent with other R40 classifications within Cells 9 and 10. Two small
         areas of land fronting McLaren Avenue have also been classified R40 to allow a
         continuous length of R40 development to link the two POS areas.


2.3      Road Design

         Two modifications have been made to the road design outlined in the existing SP.
         Firstly, with the relocation of the POS it is no longer possible to have a continuous
         road linking the eastern and western portion boundaries. Consequently an
         East/West roadway has been deleted and replaced with a North/South roadway
         down the western edge of the POS.

         A second modification has been made following a submission from the Department
         of Housing and Works (DHW). To provide internal road access to their land which
         fronts Spearwood Avenue it is proposed to terminate the eastern end of the two
         East/West roads with a Cul de sac, rather than constructing a North/South link
         between the two roads. Each cul de sac would provide access to two R20 lots
         within the DHW land.

         It is considered that the existing loop road does not make any positive contribution
         to traffic or pedestrian access and that the cul-de-sac arrangement shown on the
         modified Structure Plan is acceptable, subject to the cul-de-sac heads extending
         through to Spearwood Avenue as shown. By extending to Spearwood Avenue
         there will be good pedestrian and/or cyclist access to the dual use path system in
         Spearwood Avenue and will provide visual breaks in edge treatment along the road.


3.0      IMPLEMENTATION

3.1      Advertising, Adoption and Endorsement

         This modified SP is being advertised for public comment, in accordance with clause
         6.2.8.1 of Council’s TPS 3. It is then proposed to report to Council on all
         submissions to the advertising of the SP and seek Council’s “Adoption” of a
         modified SP. The SP would then be referred to the WAPC for “Endorsement”.
