With this seminar the Academy of European Law will provide participants, first and foremost, with updates on the latest developments at EU level in the fields of asylum and immigration law. In successive meetings of the European Council since Tampere, the Member States have pledged their loyalty to the "Tampere Milestones", but to outside observers it has sometimes seemed that lip-service is being paid to Tampere's ambitious objectives. However, there are certain signs of a new momentum, and this seminar will chart the most recent developments. The analysis will be divided between the regulation of legal and illegal forms of migration to the European Union, with the emphasis being placed on the former. Recent Court of Justice case law will also be reviewed and "operational" initiatives such as the proposal to establish an External Borders Agency will be discussed. Both at national and at European level, the balance between restrictive regulatory measures and a more protective rights-based approach to immigration and asylum appears difficult to draw. The realities of migration seem more often than not to defeat the legislator.
