Subject: Calling of option for absorption from Group B officers in BSNL.

Reference: This office letter No.BSNL/11/SR-2001 dated the14th January, 2002
           And letter No. BSNL/9-5/SR-2002 date the 1st Feb. 2002

        In continuation of the two letters referred to above and in accordance with the
directions/judgment of the Hon’ble Principle Bench of CAT New Delhi dated 6 th August
2002 & subsequent instructions issued by DOT vide their letter No, 400-23/2003-STG-
III dated the 29th August 2003, it has been decided to revive the process of calling of
options for absorption in BSNL from all the Group B officers who were transferred to
BSNL on deemed deputation basis w.e.f. 01-10-2000 as well as from those who
remained in DOT and/or who were on the roles of DOT/DTS/DTO as on 30-9-2000.


2.     After calling of the options vide this office letter No.BSNL/11/SR/2001 dated 14 th
January, 2002, certain clarifications were asked by the field units on certain issues.
The issues raised & their clarifications are given in enclosure attached as Annexure-I.


3.     As directed by the Principal Bench of CAT New Delhi in its judgment dated 6 th
August 2002, the IDA pay scales, fitment formula and the promotional avenues are
given in enclosures attached as Annexure- II, III & IV respectively.


4.      This office letter No.BSNL/11/SR/2001 dated 14th January 2002 regarding
calling of options of Group B officers in BSNL, may be read with following changes:

4.1    Para 3(Page 1) :

       The options already exercised by the officers against this office letter referred to
above (even no. dated 14-1-2002) shall remain valid. However, those desirous of
changing their earlier exercised options can submit their option afresh in the revised
proforma attached as Annexure-V. The details of options already exercised will be
displayed on the BSNL web site.

       Four copies of the revised option form numbered 1 to 4 with one set of general
terms and conditions will be sent to each Group B officer latest by 05-09-2003 and the
process of exercising option should be completed in 45 days i.e. by 20-10-2003. All the
four copies of the option form will be got filled by each officer and dealt as follows:

          1st copy to be acknowledged by a Group ‘A’ officer as indicated in para 4 of the
           option letter dated 14-1-2002 and returned to the optees.
          2nd copy (original copy) to go to the service book of the concerned officer in the
           unit.
          3rd copy to be sent to DOT, Sanchar Bhawan, New Delhi and
          4th copy to be sent to the concerned circle office ( Concerned CGM office).


4.2        Para 7 (Page 2)

       BSNL would absorb optees subject to the number of vacancies existing in the
BSNL as on 30-9-2000 in various Grades/Services. In case, the number of optees is
more than the number of vacancies existing on 30-9-2000, the senior most optees in
the various Grades/Services would be given preference for absorption.


4.3        Para 8 (Page 2)

       The IDA pay scales and the fitment formula that will be applicable on absorption
in BSNL is given in enclosure attached as Annexure-II & III respectively. The IDA pay
scales will be effective from 01.10.2000. After the absorption is finalized by BSNL and
the absorbed employees are fixed in IDA pay scales, the ad-hoc sum of Rs.2000/-p.m.
being received by the employees w.e.f. 01.10.2000, shall be adjusted against their IDA
emoluments, perks and benefits on fixation of their pay in IDA pay scales. In case of
optees accepted for absorption in BSNL and presently working in MTNL, any ad-hoc
amount paid to them by MTNL & which is required to be adjusted from the IDA Pay
scale arrears after their absorption, would also be adjusted against their IDA
emoluments, perks and benefits on fixation of their pay in IDA pay scales.


4.4       Para 9 (page 2)

      Circle cadres of BSNL & MTNL can exercise options for respective PSUs only.
Therefore, for circle cadres, CGM will decide and finalize the list of optees based upon
the seniority criterion. For all India cadres, CGMs will forward the list of optees and the
number of available posts in the cadre to the respective cadre controlling authorities.
CSS staff can exercise option only for BSNL.


4.5        Para 10(Page 2 )

        No officer shall give any conditional option. Conditional option, if any, given by
the officer, shall be treated as having opted for retention of Government status. Officers
not exercising any option as prescribed will be deemed to have opted for Government
service.

4.6   Para 11(Page 3)

      Information giving details of total Group B staff, number of optees to BSNL,
number of optees to DOT and number of officers giving no option in case of each cadre
must reach the undersigned latest by 30-10-2003.


5.      The General Terms & Conditions attached with this office letter
No.BSNL/11/SR/2001 dated 14th January 2002 regarding calling of options of Group B
officers in BSNL, may be read with following changes:


5.1   Para 4 (Page 2) – Change over to IDA pay sales.

       The IDA pay scales and the fitment formula that will be applicable on absorption
in BSNL is given in enclosure attached as Annexure-II & III respectively. The IDA pay
scales will be effective from 01.10.2000. After fixation of the IDA pay sales of the
absorbed employees in IDA pay scales they will be paid arrears . However, the ad-hoc
sum of Rs.2000/-p.m. being received by the employees w.e.f. 01.10.2000, shall be
adjusted against their IDA emoluments, perks and benefits on fixation of their pay in
IDA pay scales. In case of optees accepted for absorption in BSNL and presently
working in MTNL, any ad-hoc amount paid to them by MTNL & which was required to
be adjusted from the IDA Pay scales arrears after their absorption , would also be
adjusted against their IDA emoluments, perks and benefits on fixation of their pay in
IDA pay scales.


5.2   Para 7(Page 3) - Promotion

      (a)    Promotional avenues that will be applicable after absorption in BSNL
             shall be as indicated in enclosure attached as Annexure-IV.

      (b)    The officers officiating in higher grades on ad-hoc/local officiating basis
             will be absorbed in BSNL in the substantive grade only. However, they
             shall continue to get the higher officiating pay so long as the BSNL
             Management continues the officiating arrangements.


5.3   Para 9(Page3) – CGEIS

       Ministry of Finance, Government of India has discontinued the CGEGIS scheme
for the BSNL employees w.e.f. 1.07.2003. However, BSNL is making efforts to
formulate a similar insurance scheme for the absorbed employees.

5.4   Para 16 (page4) - Medical benefits.

      Medical scheme as announced vide BSNL’s letter No.BSNL/ADMN/1 dated
22.04.2003 shall be applicable.

5.5   Para 17 (page 4) – Timeframe for absorption

      Group ‘B’ officers shall exercise their option for permanent absorption in BSNL
by 20-10-2003.


     The other guidelines and terms and conditions give in this office letter
No.BSNL/11/SR-2001 dated 14th January, 2002 remain unchanged.

                                                                           ANNEXURE-I

Clarifications had been sought by the field units on the various issues related to the
guidelines and terms and conditions given in this office letter No.BSNL/11/SR/2001
dated the 14th January, 2002 regarding calling of option for absorption from Group B
officers in BSNL. The issues were examined and issues along with clarifications are
as follows:

Issue 1: Whether options from officers who have retired on or after 01.10.2000 have to
be called, as done in case of Group C & D.

Clarification: Yes.

Issue 2: Whether options from JEs (Civil/Elect.) etc. are to be called afresh in view of
the fact that they have now been designated as Group B and their earlier options be
treated as null and void.

Clarification: No. Instructions on the above issue have already been issued vide this
office letter No. BSNL/4/SR/2001 dated 24.01.2002.

Issue 3: Whether options are to be called from STS of ITS Group A and Class I
Accounts and Finance Service promoted on ad hoc service having pay scale of
Rs.10,000-15,200.

Clarification: It has already been clarified in para 6 of this office letter of even no.
dated 14.01.2002 that ad hoc promotees in Group A are to be treated as Group B
officers.

Issue 4: Whether the options are to be called for Sr.SDEs/ Sr.AOs in the pay scale of
Rs.8000-13500.

Clarification: Yes. It has already been clarified in para 6 of this office letter of even no.
dated 14.01.2002.

Issue 5: Whether the options are to be called from Group C officials who have already
filled option forms for absorption in BSNL as Group C on 01.10.2000 and thereafter
have become Group B officers such as JTOs of Civil, Elect. , Architect & Telecom.
Factories / Sr.PAs etc.

Clarification: No.

Issue 6: Whether options are to be taken from JAOs.

Clarification: Yes, JAOs are covered under the definition of Group B officers as
explained in para 5 of this office letter of even dated 14.01.2002.

Issue 7: Whether options form Steno Gr. I/Arch. Asst. Gr. I whose pay scale is
Rs.5500-9000 and not falling under OTBT/BCR/Grade IV/ACP/ad hoc promotion/Time
Bounds Advancement Schemes are to be called for absorption in BSNL.
Clarification: Yes.

                                                          ANNEXURE III


                          FITMENT METHOD


In respect of executives appointed by BSNL in CDA pay scales on or after
01.10.2000, the executives will be deemed to have been appointed in the
corresponding IDA pay scale and accordingly their pay will be fixed at the
minimum of the IDA pay scale corresponding to the CDA scales in which
they were appointed. In respect of the DOT/DTS/DTO Group B and A
officers (including CSS/CSSS officers), on absorption in BSNL w.e.f.
01.10.2000, the basic pay of the executives as on 01.10.2000 in the IDA
pay scales would be fixed at the stage corresponding to the stage which
they had reached under CDA pay scales on 30.09.2000 i.e. pay fixation
will be on point to point basis. In case of CDA scale Rs.12000-375-16500,
pay is to be initially fixed at 2 stages above the minimum. In cases where
the minimum benefit (Pay + DA taken together) on absorption in BSNL on
01.10.2000, falls short of Rs.2500/-per month, it will be enhanced to
Rs.2500/- p.m.

                       PROMOTIONAL AVENUES

With a view to motivate Executives in BSNL for achieving excellence in
performance and higher productivity, resulting into improved quality of
service, customer satisfaction and greater revenues for the Company,
Executives in BSNL will be allowed upgradation to the next higher IDA pay
scale on a time bound basis, varying between 4 to 6 years, as may be
prescribed for each Scale and other attendant conditions, up to the IDA
pay scale of JAG Selection Grade, beyond which it will be depend upon
availability of post and their suitability and selection for promotion, which
will be uniformally evaluated in the various streams of discipline.
