I/We M/S have read Various conditions to tenders attached hereto and hereby agree to abide by the said conditions I/We also agree to keep this tender open for acceptance for a period of 180 days from the date fixed for opening the same and in default thereof. I/We will be liable for forfeiture of my/our (security deposit) I/We offer to do the work for : Replacement of (a) defective signaling & telecom cable in the section JAJ-KCA (b) Damaged concrete pedestal, crank & compensator foundation in the section of JAJKCA of Danapur division at the rate quoted in the attached schedule and hereby bound my self/ourselves live to complete the work in 90 days from the date of issue of letter of acceptance of the tender. I/We also hereby agree to abide by the General and special condition of contract and to carry out the work according to the specification for the materials and works laid down by the Railway for present contract. 2. A sum of Rs.20000/-(Twenty thousand only) is forwarded as earnest money. The full value of earnest money Rs.20000/- shall stand forfeited without prejudice to any other rights or remedies if. (a) I/We do not execute the contract documents within seven days after receipt of notice issued by the Railway that such documents are, or (b) I/we do not commence the work within ten days after receipt order to that effect. 3. Until a formal agreement is prepared and executed, acceptance of this tender shall constitute a binding contract, between, as a subject to modifications to as may be mutually agreed to between us and indicated in the letter of acceptance of my/our offer for this works. 2 Clause-52:With-holding and lien in respect of some claimed.:Whenever any claim or claims for payment of a sum of money arises out of under the contract against the contract, the Railway shall be entitled to withhold and also have lien to retain such sum or sums in whole or in part from the security, if any deposited by contractor and for the purpose aforesaid, the Railway shall be entitled to withhold the said cash security deposit or the security, if any, furnished as the case may be and also have a lien in the event of the security being insufficient to cover the claimed amount or amounts or if no security has been taken from the contractor the railway shall be entitled to withhold and have lien to retain to the extent of the such claimed amount or amounts referred to supra, from and summon sums found payable to the contract or under the same contract or any other contract with this or any other Rly. or any other department of the central government pending finalization or, It is an agreed terms of the contract that the sum of money or moneys so withhold or retained under the lien referred to above, by the Rly. will be kept withheld or retained as such by the Rly. till the claim arising out of under the contract is governed by the arbitration clause or by the competent court as the case may be and that the contractor will have no claim for interest or damages what so ever or any account in respect of such withholding or retention under the lien referred to supra and fully modified as such to the contractor. For purpose of this clause the contractor is partnership firm, limited company, the railway shall be entitled to withhold and also have a lien to retain towards such claimed amount or amounts in whole or in part from any sum found possible to any partner limited company, as the case may whether in his individual capacity or otherwise. Clause 52-A : Lien in respect of claims in other contracts. Any sum of money due and payable to the contractor including the security deposit returnable in him under the contract may be withhold or retained by way of lien by the Railway against any claim of or any other railway or any other department of the central government in respect payment on a sum money arising out under any other contract made by the contractor with this or any other Rly. or any other department of the central government.
3 It is an agreed terms of the contract that the sum of money so withhold or retained under this cause by the Railway will be kept withhold or retained as such by the Railway till the claim arising out or under any other contract is either mutually settled or determined by an arbitrator, if the other contract governed by arbitration clause or by the competent court as the case may be and that the contractor shall have no claim for interest or damages whatsoever on this account or any other ground in respect of any sum of money withhold, retained under this clause and duly notified as to the contractor.
Clause No. 15 : Post payment audit. 15(2) : It is clause no.51(2) terms of the contract that the Railway reserves to itself the right to carry on a post payment audit and or technical examination of the works and the final bill including all supporting vouchers, abstract etc. and to make a claim on the contractor for refund of any excess amount paid to him if as a result of such examination any over payment to him is discovered to have been made in respect of any work done or alleged to have been done by him under the contracts. Variation in quantity : The payment against increased quantity beyond the agreemental value will be regulated in the following manner :For increase in quantity upto 25% of the agreemental value the accepted rate will be applicable. For the first 15% increase in the value beyond 25% of agreemental value, the rates will have a reduction of 2% in the incremental value of the agreement and for the next 10% increase in the value rates will have an additional reduction 2% in the further incremental value of the agreement.

SCOPE OF TENDERS : Sealed tender are invited on behalf of the president of India for the work of Replacement of (a) defective signaling & telecom cable in the section JAJ-KCA (b) Damaged concrete pedestal, crank & compensator foundation in the section of JAJ-KCA of Danapur division. SUBMISSION OF TENDER : Tender document (nontransferable) must be submitted in sealed cover subscribing the name of work as stated above addressed to the Sr. DSTE/ECR/Danapur and should be deposited in the tender box from 17.01.06 to 16.02.06 and on 17.02.06 upto 12.00 hrs. No tender which is received after the time and date specified above shall be considered. Tender will be opened on 17.02.06 at 12.30 hrs. in presence of such tenderer or their authorized representative as are present. CONSTITUTION OF FIRM : Tenderers should submit the constitution of their firms, partnership deed and power of attorney if any, in original together with one copy of same of such documents duly signed by persons who signed the original documents original will be returned to the tenderers after verification. EARNEST MONEY : Prior to submission of the tender, tenderers must deposit a sum of Rs.20000/- towards earnest money deposited with the Sr. DC/ECR/Danapur in cash or in any of the following forms: Deposit receipts, fixed deposit receipt, Demand Drafts payable to FA & CAO/ECR/Hajipur payable at Patna. Govt. Securities, Bank Guarantee (Stock certificate) Bearer bonds, promissory notes, cash certificate will not accepted. Earnest money to the unsuccessfull tender will be returned after the tender is accepted. TENDER WITHOUT EARNEST MONEY : Tenders unaccompanied by full earnest money in requisite form will under no circumstances, be entertained and will summarily be rejected without further reference to the tenderers. No reference to previous deposit of earnest money and Security for adjustment against the present tender will be accepted neither any request for recovery from outstanding bills for earnest money against present tender will be entertained. 5. PERIOD OF VALIDITY : The tenderer shall keep offer the rate open for a minimum period of 180 days from the date of opening of the tender within which period the tenderer can not withdraw or modify his/their offer.

5 6. QUALIFYING CRITERIA : Tenderer must have sufficient experience in similar type of work. Should have completed in the last three financial years (i.e. current year and three previous financial years):at least one similar single work, for a minimum value of 35% of Advertised Tender Value of Work. Similar works means Cable laying. Signalling and telecom work. Total contract amount received during the last three years as per payment certificate Should be a minimum of 150 % of Advertised Tender Value of Work.

PRICES : The rate to be quoted by the tenderer in schedule of work. Rate shall be quoted on a firm rupee basis both in word & figure. The rate quoted be including of loading, transportation, unloading, leads, stakes,etc.of materials from the unloading point at SSE/Sig/Store/Danapur station to the site of work. Hold good for 90 days from the date of issue of letter of acceptance to undertake the work irrespective of market fluctuations and no claim whatsoever on this account will be entertained. TIME : Time is the essence of the contract and the work must be completed within 90 days from the date of issue of letter of acceptance.

10. RAILWAY PASSES AND ACCOMMODATION : No Railway free pass or concessional facilities for men and materials will be granted under any circumstances. The contractor will have to make his own arrangement for accommodation of his staff, labourer, materials and tools etc. 11. INFORMATION RELATING TO TENDER : Any information relating to the tender may be obtained from the O/O the Sr.DSTE/ER/DNR on any working day during office hour If any tenderer desires, prior to tendering, to inspect the site he may do so at his own cost by arrangement with Sr. DSTE/DNR or through his authorized representative. 12. ACCEPTING AUTHORITY : Acceptance of the Tender will rest with the Sr. DSTE/DNR who reserves the right to divide the tender amongst more than one tenderer, if deemed necessary and also to reject any or all tenders part thereof without assigning any reason and does not bind himself accept the lowest or any reference to the tenderers any may accept the tender in respect of any such portion of work.
6 13. SECURITY DEPOSITE : Security deposit will be deducted as per extant rule. 14. INCOM TAX : Income tax at the rate of two percent of the gross amount will be recovered from the bills of contractor in terms of section 194(c) of the income tax act 1961 as introduced through the finance act 1972. 15. SALE TAX : As per extent rule. 16. REFUND OF SECURITY MONEY : The security deposit, unless forfeited in whole or part according to the terms and conditions, it will be retained Twelve months from the date of completion of work for due observation of the installation work as the case may be. 17. PAYMENT : Running bills against full completed work and certified as such will be paid to the contractor and it may also please be noted that no payment will be made till current and valid ITCC & STCC, affidavit in case of proprietary concern and power of attorney is furnish. 18. OTHERS POINTS : A. The contractor shall at all items indemnity the railway against a claims made in respect of the injuries to the person or damage to the property of railway or his staff or public within the railway premises made by the contractor, his agent or servant during the terms of contract. B. The railway will not be responsible for any loss or damage to the contractors materials, equipments, tools and plants due to fire, floods, theft or any other cases whatsoever. C. The railway may at any time by notice in writing summarily terminate the contract without any compensation to the contractor if the contractor commits any breach of this contract. D. All the transaction of materials, if any between railway and contractor shall be done on proper acknowledgement. On completion of the work at site the contractor will hand over the materials to Rly. for which a receipt will be granted to the contractor.
7 E. In case of Rly. excess/and or released materials are left over with the contractor, these will be returned in good condition by him/them to the Rly & receipt taken thereof. If the contractor fails to return any excess unused rly. materials, the cost thereof shall be recovered from him at issue rates plus present code charge and to this will be added an increase of 100%. F. No tools and plans required to do the work will be supplied by the Rly. The contractor will have to make his own arrangement for transportation materials at the site from the unloading point or from the godown as per conditions agreed. G. Any materials (Except to be supplied by contractor) for execution of work will be supplied by Railway at store of SSE/Sig./Tele/Store/DNR. H. All the pages of the tender forms must be signed by the tenderer with date. I. Current STCC copy of partnership deed, Affidavit in case of proprietory concern and power of attorney, declaration as to whether association with any retired Gazetted officer/Engineer with the contractor should also be furnished.
J. Copies of certificate and testimonials to show that the contractor has carried out works of this nature showing name of work. Agreement no. And date value of contract and time taken to execute the work under whom the work was executed should also must be furnished. No further correspondence will be made in this connection. K. Bank certificate showing financial stability to undertake the contract should also be furnished. L. Labour license from the labour commissioner (central) of the area of labour Act, 1970 and central rules, 1971, if any, should also be furnished. M. Declaration as to whether any relative of the contractor is working in the Railway should also be furnished. N. Work should be done according to schedule of work.

9 ENCLOSURE –1 TECHNICAL SPECIFICATION Item 1. Trenching and laying of cable (I) Excavation & refilling of cable trench 300 mm wide, 1 metre deep in all types of soil, rock mixed soil. Mecademi sed and stone paved platform/road. The cable trench should be clear of roots of trees and bushes. Before refilling the cable in the trench should be covered by sieved/shifted soil for 50mm and then cable should be covered by bricks. Supply, placing and positioning breadth wise second class country made bricks above the screened earth after laying the cable (placing of bricks @ four bricks per meter). (I). Laying of cable should be as per approved cable route plan. (II). laying of signaling cable and Telecom/power cable in same trench shall be as per Drg. No. CORE/S&T/ALD/SK/373/93 PG 1. Meggering & Testing of all main and Tail cables before and after laying of the cables in trenches and also after termination in Apparatus cases. Jn. Boxes and Relay Room. Testing will be done jointly with Railway representative and submission of joint cable, insulation chart certificate to Engineer Incharge. The cable shall not be commissioned if the insulation resistance is found less than the standard value. Any defect noticed during the testing after laying the cable the same will be replaced by the contractor at his own cost.
