      Minutes of the meeting of the Ethics Committee held on 2nd & 3rd August, 2004 at 11.00

1.      Minutes of the last meeting of the Ethics Committee- Confirmation of.

               The minutes of the Ethics Committee held on (a) 24th & 25th May, 2004, (b) 14th
        June, 2004 & (c) 24th & 25th June, 2004 were read and confirmed.


2.      Minutes of the last meeting of the Ethics Committee-Action thereon.

        (a) The Ethics Committee noted the action taken by the office on the various items of the
            minutes of the meeting of the Ethics Committee held on 24th & 25th May, 2004 with
            the following directives to the office:-

             1. Dr.Yash Nigam may be asked to appear before the Ethics Committee on the 2nd
                day of the next meeting at 11.00 a.m. in relation to file No.98/1996 and 89/1997.

             2. Dr. Anil Malik may be asked to appear before the Ethics Committee on the 2nd day
                of the next meeting at 1.00 p.m. in relation to file No.98/1996 and 89/1997.

             3. Dr. Pramod Kohli may be asked to appear before the Ethics Committee on the 2nd
                day of the next meeting at 12.00 noon in relation to file No.98/1997.

             4. Dr. Balraj Gupta, Jalandhar may be asked to appear before the Ethics Committee
                on the 2nd day of the next meeting at 10.30 a.m. in relation to file No.111/1996.

             5. Dr.Ajay, Safdarjung Hospital may be asked to appear before the Ethics Committee
                on the 2nd day of the next meeting at 3.00 p.m. in relation to file No.96/2002.

             6. Mr. Choudhuri Vinod Singh complainant may be asked to appear before the
                Ethics Committee on the first day of the next meeting at 3.30 p.m. in relation to
                file No.263/2003.

             7. Mr. U.S. Mishra, Complainant may be asked to appear before the Ethics
                Committee on the first day of the next meeting at 4.00 p.m. in relation to file
                No.20/2003.

             8.    Dr. Pradeep Kumar may be asked to appear before the Ethics Committee on the
                  first day of the next meeting at 4.30 p.m. in relation to file No.38/1995

           9. Complaint against Safdarjung Hospital, New Delhi as alleged by Mr. Karam
              Chand in relation to file No.60/2002 may be placed in the next meeting of the
              Ethics Committee as a separate agenda.

           10. The complaint against Dr. J.P. Swami, New Delhi as alleged by Mr. Kishan Lal in
               relation to file No.77/2002 may be placed as a separate agenda in the next meeting
               of the Ethics Committee.

(b)    The Ethics Committee noted the action taken by the office on the minutes of the meeting
       of the Ethics Committee held on 14th June, 2004.

(c)     The Ethics Committed noted the action taken by the office on the minutes of the meeting
       of the Ethics Committee held on 24th & 25th June, 2004.

       The Ethics Committee further decided that the decision of item No.2 of the meeting of the
       Ethics Committee on 24th/25th June, 2004 in relation to “an appropriate action will be
       taken by the Council for endorsing declaration containing mis-statement and also false
       statement – explanation of the Dean/Principal’s in response to MCI letter dated
       27.5.2004” are to be referred to the Executive Committee and General Body of the
       Council for their approval.

       A copy of the Gazette notification dated 27th May, 2004 may be sent to all the State
Medical Councils with the list of cases referred to by this Council since 1993 till date. All the
State Medical Councils shall be requested to submit the status report of all those cases within one
month of receipt of the letter.

       In view of the Gazette notification dated 26.5.2004 of Section 8.7 and 8.8, the Ethics
Committee decided that from now onwards, a separate register (Referral Register) shall be
maintained in the office for all cases that are referred to the State Medical Councils with the
following entries:-

       All such referred cases of this meeting (2nd/3rd August, 2004) are to be entered in the
Referral Register.

3.     Complaint against Dr. Puneet Gupta as alleged by Mr. Chandra Mohan
       Kakkar.(F.No.92/1996)

      Read the matter with regard to complaint against Dr. Puneet Gupta as alleged by Mr.
Chandra Mohan Kakkar.

        The Ethics Committee considered the matter with regard to complaint against Dr. Puneet
Gupta as alleged by Mr. Chandra Mohan Kakkar and noted that even after all the efforts taken to
find out the particulars of Dr. Puneet Gupta, it could not be obtained. Mr.Chandra Mohan
Kakkar the complainant was also requested by this Council to provide the full particulars of
qualification and registration of Dr. Puneet Gupta which he also failed to provide even after
receiving the reminders from this Council.

       The Ethics Committee decided that under these circumstances, no further action is
required at this case and the file may be treated as closed.

4.     Complaint against doctors of Sir Ganga Ram Hospital as alleged by Mr.
       K.L.Nijhawan (F.No.97/1996).

       Read the matter with regard to complaint against doctors of Sir Ganga Ram Hospital as
alleged by Mr. K.L.Nijhawan.

        The Ethics Committee considered the matter with regard to complaint against doctors of
Sir Ganga Ram Hospital as alleged by Mr. K.L.Nijhawan and noted that Medical Superintendent,
Sir Ganga Ram Hospital did not provide the registration particulars of concerned doctor even
after sending reminders by this Council.

       The Ethics Committee further noted that the letter was sent to the Medical
Superintendent, Sir Ganga Ram Hospital from this office on 18.10.96, 27.6.2003, 10.11.2003,
14.1.2004, 6.5.2004 and 5.7.2004 and even he did not care to reply once.

       Under these circumstances, the Ethics Committee decided that the Medical
Superintendent may be asked to appear before the Ethics Committee in its next meeting at 3.00
p.m. on the first day. A copy of the said letter may be sent to the Director of Health Services, F-
17, Karkardooma, Delhi-110092.

5.     Complaint against Dr. R.P.Gupta as alleged by Mr. Kishan Das Bhagat,
       Aligarh(F.No.113/1996)

      Read the matter with regard to complaint against Dr. R.P.Gupta as alleged by Mr. Kishan
Das Bhagat, Aligarh.

        The Ethics Committee considered the matter with regard to complaint against Dr.
R.P.Gupta as alleged by Mr. Kishan Das Bhagat, Aligarh and noted that the Council has received
the registration particulars of Dr. R.P. Gupta on 26.7.2004 which states that he is registered with
the U.P. Medical Council, hence the matter may be referred to U.P. Medical Council with the
request to investigate the complaint and to take decision within the period of six months as
stipulated by the Hon’ble Supreme Court. A copy of the Gazette notification to this effect may
also be sent. No further action is required at this end and the file may be treated as closed.

6.     Complaint against doctors of AIIMS, New Delhi as alleged by Mr. Ishwar Prasad
       Verma(F.No.96/1997).

      Read the matter with regard to complaint against doctors of AIIMS, New Delhi as alleged
by Mr. Ishwar Prasad Verma.

       The Ethics Committee considered the matter with regard to complaint against doctors of
AIIMS, New Delhi as alleged by Mr. Ishwar Prasad Verma and noted that as Dr. Lalit Kumar
and Dr. P.K. Das are registered with Delhi Medical Council and Orissa Medical Council, their
cases have been referred to the respective Medical Councils. However, the registration
particulars of Dr. Vertika Mittal could not be found. Complainant may be requested to provide
the complete address and registration particulars of Dr. Vertika Mittal within a period of one
month.

7.     Complaint against doctors of G.B.Pant Hospital, New Delhi as alleged by Mrs.
       Shabnam Parveen(F.No.10/1998).

       Read the matter with regard to complaint against doctors of G.B.Pant Hospital, New
Delhi as alleged by Mrs. Shabnam Parveen.

       The Ethics Committee considered the matter with regard to complaint against doctors of
G.B.Pant Hospital, New Delhi as alleged by Mrs. Shabnam Parveen and noted that nobody has
furnished the registration particulars of Dr. J.C. Mohan.

        The Committee further decided that letters may be sent to i) the Secretary, Ministry of
Health & F.W., Govt. of India, ii) Secretary, Health & F.W. Deptt., Govt. of NCT of Delhi, iii)
Dr. J.C. Mohan, C/o Medical Superintendent, Jaipur Golden Hospital, New Delhi to furnish
registration particulars of Dr. J.C. Mohan,

8.     Complaint against doctors of Northern Railway Divisional Hospital, Allahabad as
       alleged by Mr. Anil Tiwari(F.No.78/1999).

       Read the matter with regard to complaint against doctors of Northern Railway Divisional
Hospital, Allahabad as alleged by Mr. Anil Tiwari.

        The Ethics Committee considered the matter with regard to complaint against doctors of
Northern Railway Divisional Hospital, Allahabad as alleged by Mr. Anil Tiwari and noted that
this office has received the registration particulars of the concerned doctors from Northern
Central Railway office on 26.7.2004 and observed that Dr. Ashok Kumar is registered with U.P.
Medical Council and Dr. S. Behl is registered with Tamilnadu Medical Council.

         In view of above, the Ethics Committee decided to refer this matter to the respective State
Medical Councils with a copy of the Gazette Notification dated 27.5.2004 with the request to
complete the investigation procedure and to take final decision within six months from receipt of
this letter under intimation to this Council.

       No further action is required at this end and the matter may be treated as closed.

9.     Complaint against Dr. Avdhesh Kumar, Begusarai as alleged by Smt.Prabha
       Sharma(F.No.41/2000).

       Read the matter with regard to complaint against Dr. Avdhesh Kumar, Begusarai as
alleged by Smt.Prabha Sharma.

        The Ethics Committee considered the matter with regard to complaint against Dr.
Avdhesh Kumar, Begusarai as alleged by Smt.Prabha Sharma and noted that no reply is received
from the Health Secretary, Govt. of Bihar. The Ethics Committee further decided that another
reminder may be sent to the i) Registrar, Bihar Medical Council, ii) Health Secretary, Govt. of
Bihar, iii) Chief Secretary, Govt. of Bihar with the request to take necessary action in the matter.
A copy of which may be sent to Registrar, National Human Rights Commission, New Delhi.

       A copy of this letter may also be sent to Smt. Prabha Sharma, the complainant with the
request to provide the address and registration particulars of Dr. Avdhesh Kumar within one
month from the date of receipt of this letter.

10.    Complaint against doctors of National Heart Institute, New Delhi as alleged by Mr,
       J.C.Thukral, Delhi(F.No.80/2001).


       Read the matter with regard to complaint against doctors of National Heart Institute, New
Delhi as alleged by Mr, J.C.Thukral, Delhi.

        The Ethics Committee considered the matter with regard to complaint against doctors of
National Heart Institute, New Delhi as alleged by Mr, J.C.Thukral, Delhi and decided that the
Medical Superintendent, National Heart Institute may be requested to provide the relevant
documents pertaining to Dr. Sanjay Sharma, Dr.Vinod Sharma, Dr. V.K. Gujral and Dr. Amit
Chandra during their stay at the National Heart Institute including the initial appointment letters
and relieving orders mentioning the date of relieving. Copy of all the relevant documents may
also be sent. The complainant may also be requested to provide the complete address alongwith
registration particulars of above mentioned doctors.

        The complain alongwith all the relevant documents may also be sent to Dr. V.K. Gujral,
A-158, Defence Colony, New Delhi, Dr. Amit Chandra, Malhotra Heart Institute, Ring Road,
Lajpat Nagar, New Delhi and Dr. Vinod Sharma, Ganga Ram Hospital, Pusa Road, New Delhi
for their comments and registration particulars.

11.    Complaint against Dr. B.K.Narang as alleged by Joint Manager, FCI, New
       Delhi(F.No.3/2001).

      Read the matter with regard to complaint against Dr. B.K.Narang as alleged by Joint
Manager, FCI, New Delhi.

       The Ethics Committee considered the matter with regard to complaint against Dr.
B.K.Narang as alleged by Joint Manager, FCI, New Delhi and decided that Dr. V.K.Narang may
be asked to appear before the Ethics Committee at 10.00 a.m. in the 2nd day of its next meeting.


12.    Complaint against Dr. V.K.Mehta & Dr.(Maj.) A.K. Verma as alleged by Delhi
       Development Authority, New Delhi(F.No.100/ 2001).

        Read the matter with regard to complaint against Dr.V.K.Mehta & Dr.(Maj.) A.K. Verma
as alleged by Delhi Development Authority, New Delhi.

        The Ethics Committee considered the matter with regard to complaint against
Dr.V.K.Mehta & Dr.(Maj.) A.K. Verma as alleged by Delhi Development Authority, New Delhi
and noted that the matter has already been referred to Rajasthan Medical Council and Delhi
Medical Council for taking necessary action and no further action is required by this Council at
this end and the matter may be treated as closed.


13.    Complaint against Vidhyasagar Instt. Of Mental Health & Neuro Sciences, New
       Delhi as alleged by Sh. Radhey Shyam Gupta(F.No.212/2002)

      Read the matter with regard to complaint against Vidhyasagar Instt. Of Mental Health &
Neuro Sciences, New Delhi as alleged by Sh. Radhey Shyam Gupta.

       The Ethics Committee considered the matter with regard to complaint against
Vidhyasagar Instt. Of Mental Health & Neuro Sciences, New Delhi as alleged by Sh. Radhey
Shyam Gupta and decided that Dr.V. K. Khosla may be requested to offer his comments on the
post mortem report. All the relevant documents may also be sent for his perusal.


14.    Complaint against Dr. Santosh Kumar Singh, Dr.Vashi & Dr. Rakesh Tiwari as
       alleged by Mr. Vikas and the staff of Sanjay Gandhi Memorial Hospital,
       Mangolpuri, Delhi(F.NO.286/2003)

      Read the matter with regard to complaint against Dr. Santosh Kumar Singh, Dr.Vashi &
Dr. Rakesh Tiwari as alleged by Mr. Vikas and the staff of Sanjay Gandhi Memorial Hospital,
Mangolpuri, Delhi.

        The Ethics Committee considered the matter with regard to complaint against Dr.
Santosh Kumar Singh, Dr.Vashi & Dr. Rakesh Tiwari as alleged by Mr. Vikas and the staff of
Sanjay Gandhi Memorial Hospital, Mangolpuri, Delhi and decided to call all the three doctors in
the 2nd next meeting of the Ethics Committee at 10 a.m. on the 2nd day.


15.    Complaint against Dr. Ramesh Chetrapal as alleged by Mr. Budha Singh
       (F.No/39/2003)

      Read the matter with regard to complaint against Dr. Ramesh Chetrapal as alleged by Mr.
Budha Singh.

               The Ethics Committee considered the matter with regard to complaint against Dr.
Ramesh Chetrapal as alleged by Mr. Budha Singh and noted that this Council has not received
this complaint and only copy of the decision by the Rajasthan Medical Council is endorsed to the
MCI which is being noted. No further action is required at this end and the file may be treated as
closed.

Superintendent, LNJP Hospital, New Delhi may be requested to appear before the Ethics
Committee alongwith all the relevant documents and particulars of registration of concerned
doctors involved in this case in the 2nd next meeting of the Ethics Committee at 11.30 a.m. on the
2nd day. A copy of this letter may also be sent to the Secretary Health, Govt. of NCT of Delhi.


17.    Complaint against Dr. Sandeep Sachdeva at Karnal as alleged by Mrs. Kanta
       Rani(F.No.226/2002)

      The Ethics Committee considered the matter with regard to complaint against Dr.

Medical Council may be requested to investigate the matter and take the decision within six
months from the receipt of this letter. A copy of this letter may also be marked to the
complainant. No further action is required at this end and the matter may be treated as closed.


18.    Suggestion with regard to amendment in Indian Medical Council (Professional
       Conduct, Etiquette and Ethics) Regulations, 2002(F.No.80/2003)

      Read the matter with regard to suggestion with regard to amendment in Indian Medical
Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

       The Ethics Committee considered the matter with regard to suggestion for amendment in
Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 and
decided to defer the matter to the next meeting of the Ethics Committee.

who was the liver doner and decided that all the relevant documents alongwith death summary
may be referred to Director, AIIMS, New Delhi with the request to obtain expert opinion from
the Professor of Surgical Gastroenterology.


20.    Complaint against Dr. Sunil Sharma, Noida as alleged by Mr.S.C. Gupta,
       New Delhi(F.No.243/2003)

       Read the matter with regard to complaint against Dr. Sunil Sharma, Noida as alleged by
Mr. S.C.Gupta, New Delhi.

        The Ethics Committee considered the matter with regard to complaint against Dr. Sunil
Sharma, Noida as alleged by Mr. S.C.Gupta, New Delhi, and further decided that complainant
may be requested to provide the latest position alongwith relevant documents regarding this
particular case in Consumer Court.

        The Ethics Committee considered the matter with regard to complaint against Dr.Praveen Gupta
as alleged by Mr. D.K. Jain and decided that Mr.D.K. Jain may be asked whether he is interested to
pursue this case further or not. A copy of Dr. Parveen Gupta’s reply may also be sent for ready
reference.


22.    Complaint against Dr. K.G. Sharma as alleged by Mr. Ajay Narang(F.No.347/2003)

      Read the matter with regard to complaint against Dr. K.G. Sharma as alleged by Mr. Ajay
Narang.

        The Ethics Committee considered the matter with regard to complaint against Dr. K.G. Sharma
as alleged by Mr. Ajay Narang and decided that Madhya Pradesh Medical Council may be requested to
offer their final opinion in the case.


 23.   Complaint against doctors of Sona Nursing Home as alleged by Mr.Shafiquddin
       (F.No.207/2002)

      Read the matter with regard to complaint against doctors of Sona Nursing Home as alleged by
 Mr. Shafiquddin.

        The Ethics Committee considered the matter with regard to complaint against doctors of Sona
 Nursing Home as alleged by Mr. Shafiquddin and decided that Medical Superintendent may be
 requested to forward his comments alongwith address and registration particulars of the concerned
 doctors. A copy of this letter may also be sent to SHO, Police Station, Dariya Ganj, New Delhi and
 also to the complainant.


24.    Complaint against doctors of Northern Railway Central Hospital as alleged by
       Mr.Jaskaran Singh , Delhi (F.No.236/2002)

        Read the matter with regard to complaint against doctors of Northern Railway Central Hospital
as alleged by Mr.Jaskaran Singh, Delhi.

       The Ethics Committee considered the matter with regard to complaint against doctors of
Northern Railway Central Hospital as alleged by Mr.Jaskaran Singh, Delhi and decided that Medical
Superintendent, Northern Railway Central Hospital may be requested to provide the information already
sought for with regard to comments and registration particulars of the concerned doctor. A copy of the
same may be sent to the General Manager, Northern Railway, Baroda House, New Delhi and another
copy to the complainant.


25.    Responsibilities of Physicians (F.No.64/2003)

       Read the matter with regard to responsibilities of Physicians.

        The Ethics Committee considered the matter with regard to responsibilities of Physicians and
noted the same.

       The Committee further decided that the file may be treated as closed.

        Read the matter with regard to complaint against doctors of Taneja Nursing Home & Heart
Institute as alleged by Mr. Ashok Gupta.

        The Ethics Committee considered the matter with regard to complaint against doctors of Taneja
Nursing Home & Heart Institute as alleged by Mr. Ashok Gupta and decided that Medical
Superintendent may again be requested to forward the comments in the matter alongwith address and
registration particulars of the concerned doctor within one month from the date of receipt of this letter.


27.    Complaint against Dr. Pramod Kumar Singh, Begusarai as alleged by Mr. Mukesh Kumar
       (F.No.341/2003)

       Read the matter with regard to complaint against Dr. Pramod Kumar Singh, Begusarai as alleged
by Mr. Mukesh Kumar.

       The Ethics Committee considered the matter with regard to complaint against Dr. Pramod Kumar
Singh, Begusarai as alleged by Mr. Mukesh Kumar and noted that Bihar Medical Council could not
substantiate any negligence in the part of Dr. Pramod Kumar Singh. The Ethics Committee noted the
same and decided that the matter may be treated as closed.


28.    Complaint against doctors of PGIMER, Chandigarh as alleged by Mr. Ashwini
       K.Anand(F.No.113/2001)

      Read the matter with regard to complaint against doctors of PGIMER, Chandigarh as alleged by
Mr. Ashwini K. Anand.

       The Ethics Committee considered the matter with regard to complaint against doctors of
PGIMER, Chandigarh as alleged by Mr. Ashwini K. Anand and decided that a letter may be sent to the
Director, PGIMER with the request to provide the address and registration particulars of the concerned
doctor with a copy of letter received from M.S, PGI, Chandigarh. The Committee further decided that
complainant may be sent a reminder for providing the address and registration particulars of the
concerned doctors.


29.    Complaint against Dr. B.B.Gupta and Dr. R.S Lamba, Dr. RML Hospital as alleged by Mr.
       T.D.Sharma (F.No.70/2000)

       Read the matter with regard to complaint against Dr. B.B.Gupta and Dr. R.S Lamba, Dr. RML
Hospital as alleged by Mr. T.D.Sharma.

       The Ethics Committee considered the matter with regard to complaint against Dr. B.B.Gupta and
Dr. R.S Lamba, Dr. RML Hospital as alleged by Mr. T.D.Sharma and decided that the Medical Supdt.,
RML Hospital alongwith concerned doctors against whom the complaint has been lodged may be asked
to appear before the Ethics Committee in its 2nd next meeting at 3 p.m. on the 2nd day.


30.    Complaint against doctors of AIIMS, New Delhi as alleged by Mr. Surender Kumar
       Utreja(F.No.11/2002)

      Read the matter with regard to complaint against doctors of AIIMS, New Delhi as alleged by Mr.
Surender Kumar Utreja.

       The Ethics Committee considered the matter with regard to complaint against doctors of AIIMS,
New Delhi as alleged by Mr. Surender Kumar Utreja and decided that the complainant may be sent a
copy of letter of the Inquiry Committee of AIIMS, New Delhi for needful at his end.

       The Ethics Committee considered the matter with regard to complaint against Dr.O.P.Murthy as
alleged by Mr. Raj Singh Toofan and Mr. Aamod Shashtri, General Secretary, Society of Justice and
decided to write to the Director, AIIMS, New Delhi as to whether any institutional inquiry was
conducted regarding the complaint against Dr. O.P. Murthy by Mr.Raj Singh Toofan and Mr.Aamod
Shashtri. If any such inquiry was conducted, a report of the same may kindly be sent to MCI. All the
documents pertaining to this complaint available with MCI may be sent to the Director, AIIMS, New
Delhi for his ready reference.


32.    Complaint against doctors of Sir Ganga Ram Hospital, New Delhi as alleged by Mr. Shital
       Prasad Jain(F.No 71/2003)

        Read the matter with regard to complaint against doctors of Sir Ganga Ram Hospital, New Delhi
as alleged by Mr. Shital Prasad Jain.

        The Ethics Committee considered the matter with regard to complaint against doctors of Sir
Ganga Ram Hospital, New Delhi as alleged by Mr. Shital Prasad Jain and noted the same. The
Committee further decided that no further action is required at the end and this matter may be treated as
closed.

       Read the matter with regard to cancellation of the registration after holding enquiry against (1)
Dr. R.N. Dwivedi, Prof. & Head of Medicine, (2) Dr. Jayant Bajpai. Prof.& Head of Orthopaedic Deptt.,
(3) Dr. N.B.Singh, Associate Prof. & Head of Surgery & (4) Dr. S.K.Katiyar, Principal and Chief
Superintendent of G.S.V.M.Medical College, Kanpur- Nagar.

        The Ethics Committee considered the matter with regard to cancellation of the registration after
holding enquiry against (1) Dr. R.N. Dwivedi, Prof. & Head of Medicine, (2) Dr. Jayant Bajpai. Prof.&
Head of Orthopaedic Deptt., (3) Dr. N.B.Singh, Associate Prof. & Head of Surgery & (4) Dr.
S.K.Katiyar, Principal and Chief Superintendent of G.S.V.M.Medical College, Kanpur- Nagar and noted
that the MCI has since received response from Dr.N.B. Singh & Dr. S.K. Katiyar vide their letter dated
18.5.2004 and 1.6.2004.

       On perusal of the documents, it is found that all the four doctors including Dr. N.B.Singh & Dr.
S.K. Katiyar are registered with U.P. Medical Council. The matter may be referred to the U.P. Medical
Council for needful at their end from the date of this communication. A copy of the same may be
marked to the Hon’ble Judge Mr.Shailendra Saksena. A copy of Gazette notification dated 26.5.2004
may also be sent to the U.P. Medical Council.


34.    Complaint against doctors of Dr. Arora’s Memorial Hospital, City Heart Clinic & Medical
       Centre and Sir Ganga Ram Hospital (F.No.33/2004)

       Read the matter with regard to complaint against doctors of Dr. Arora’s Memorial Hospital, City
Heart Clinic & Medical Centre and Sir Ganga Ram Hospital.

       The Ethics Committee considered the matter with regard to complaint against doctors of Dr.
Arora’s Memorial Hospital, City Heart Clinic & Medical Centre and Sir Ganga Ram Hospital and
decided that Dr. Pawan Goyal may be requested to appear before the Ethics Committee in its 2nd next
meeting at 4.30 p.m on the 2nd day.

      Read the matter with regard to articles in the National Medical Journal of India on the Ethics of “
Live Operative Workshops”.

        The Ethics Committee considered the matter with regard to articles in the National Medical
Journal of India on the Ethics of “ Live Operative Workshops” deliberated on this issue and decided to
defer the matter to the next meeting.


36. Complaint against doctors of AIIMS, New Delhi as alleged by Mr.Vishal Mahrotra

   Read the matter with regard to complaint against doctors of AIIMS, New Delhi as      alleged by
Mr.Vishal Mahrotra.

       The Ethics Committee considered the matter with regard to complaint against doctors of AIIMS,
New Delhi as alleged by Mr.Vishal Mahrotra and decided that the Secretary General, Indian Medical
Association may be sent a reminder alongwith information that the complainant Mr.Vishal Mahrotra
was being sent a communication by this office but it has been informed by the postal authorities that
‘nobody at this address’.


37.    Complaint against Dr. Sushma Chandra as alleged by Mr. Rajendra Joshi., Rishikesh.
       (F.No.95/2001)

   Read the matter with regard to complaint against Dr. Sushma Chandra as alleged by Mr. Rajendra
Joshi., Rishikesh.

        The Ethics Committee considered the matter with regard to complaint against Dr. Sushma
Chandra as alleged by Mr. Rajendra Joshi., Rishikesh and noted that even after reminders she has not
responded. Dr. Sushma Chandra was requested to provide her comments alongwith particulars of
qualification and registration but the letter has been returned back with the remarks that ‘no person is
available in this hospital.’

      Under the above mentioned circumstances, no further action is required at this end and the file
may be treated as closed.

by the the Registrar, Sri Lanka Medical Council, Colombo..

       The Ethics Committee considered the matter with regard to complaint against Dr. Sunita
Aggarwal, Aggarwal Hospital as alleged by the Registrar, Sri Lanka Medical Council, Colombo and
decided that in this case some larger issues are involved regarding practice of Indian doctors in foreign
countries and practice of foreign doctors in India. A definite guidelines have to be prepared in this
aspect and to be discussed in the next meeting for further consideration. This has to be discussed in
conjunction with the deferred agenda item No.35 on the question of the “Ethics of live operative
workshop”. Dr. D. J. Bora was requested to prepare a draft guideline and place it before the Ethics
Committee in its next meeting.


46. Complaint against Dr. H.L.Virmani and Dr. Sudhir Jain forwarded by Directorate of Health
    Services, Delhi (F.No5/1997).

   Read the matter with regard to complaint against Dr. H.L.Virmani and Dr. Sudhir Jain forwarded by
Directorate of Health Services, Delhi.

    The Ethics Committee considered the matter with regard to complaint against Dr. H.L.Virmani and
Dr. Sudhir Jain forwarded by Directorate of Health Services, Delhi and decided that Punjab Medical
Council may be requested to provide the information about the status of this particular case. Dr. Sudhir
Jain informed vide his letter dated 24.7.2004 has informed that he is registered with U.P. Medical
Council and the matter may be referred to the U.P. Medical Council for investigating the case and to
take decision within six months from the date of receipt of this letter. A copy of the Gazette notification
dated 26.5.2004 may be sent to them. The Committee further decided that no further action is required
at this end and the matter may be treated as closed.


47.     Complaint against doctors of Orthopaedic, Unit-II of Safdarjang Hospital as alleged by
        Mr.Manu Verma (F.No.1/1997).

   Read the matter with regard to complaint against doctors of Orthopaedic, Unit-II of Safdarjang
Hospital as alleged by Mr.Manu Verma.

       The Ethics Committee considered the matter with regard to complaint against doctors of
Orthopaedic, Unit-II of Safdarjang Hospital as alleged by Mr.Manu Verma and decided that another
reminder may be sent to Medical Supdt., Safdarjung Hospital, New Delhi for forwarding urgent
comments alongwith full particulars of qualification and registration about the concerned doctors. The
complainant may also be requested to provide address, qualification and registration particulars of the
concerned doctors.


48.     Complaint against Dr. Ashwani Maichand & Dr. Rupinder kaur, Parmarth Mission
        Hospital as alleged by Mr. Subhash Chander Jaitly (F.No.315/2003).

Parmarth Mission Hospital as alleged by Mr. Subhash Chander Jaitly.

       The Ethics Committee considered the matter with regard to complaint against Dr. Ashwani
Maichand & Dr. Rupinder Kaur, Parmarth Mission Hospital as alleged by Mr. Subhash Chander Jaitly
and decided that Medical Supdt., Parmarth Mission Hospital, New Delhi and Medical Supdt., Jeevan
Mala Hospital, New Delhi may be asked to appear personally in the 2nd next meeting of the Ethics
Committee at 10 a.m. on the 3rd day with all the relevant documents in respect of this case including
bed-head ticket, a copy of the MLC as well as the address and registration particulars of Dr.Ashwani
Maichand & Dr. Rupinder Kaur and other treating doctors.

        The Ethics Committee considered the matter with regard to complaint against doctors & Staff of

requested to provide the address, qualification and registration particulars of Dr.Sabya Sachi Bal. The
Complainant Mr. Virendra Singh may also be requested to forward the address and registration
