 1   A Bill for an Act to amend the Marriage Act 1961 to
 2   create marriage equality for all relationships
 3   regardless of sexual orientation or gender identity,
 4   and for related purposes
 5   The Parliament of Australia enacts:
 6   1 Short title
 7               This Act may be cited as the Marriage (Relationships Equality)
 8               Amendment Act 2008.

 9   2 Commencement
10               This Act commences on the day on which it receives the Royal
11               Assent.

12   3 Objects
13               The objects of this Act are to:
14                (a) remove from the Marriage Act 1961 discrimination on the
15                    basis of sexual orientation and gender identity; and
16                (b) permit marriage regardless of sexual orientation and gender
17                    identity.

1   4 Schedule(s)
2               Each Act that is specified in a Schedule to this Act is amended or
3               repealed as set out in the applicable items in the Schedule
4               concerned, and any other item in a Schedule to this Act has effect
5               according to its terms.

 5   1 Subsection 5(1) (definition of marriage)
 6         Omit the definition, substitute:
 7              marriage means the union of two persons, regardless of their
 8              sexual orientation or gender identity, voluntarily entered into for
 9              life.

10   2 Subsection 45(2)
11         Omit “wife (or husband)”, substitute “spouse”.

12   3 Subsection 46(1)
13         Omit “a man and a woman”, substitute “two people”.

14   4 Subsection 72(2)
15         Omit “wife (or husband)”, substitute “spouse”.

16   5 Section 88EA
17         Repeal the section.

18   6 Part III of the Schedule (table item 1)
19         Omit “a husband and wife”, substitute “two people”.
