					Proposal of legal inspection requirements for aquarium lighting fixtures

Background
With the increased popularity of aquariums to be set up at homes, the safey of aquarium lighting becomes
the concerns of the consumers in terms of the risk of shock. A survey of aquarium lighting fixtures on the
market surveyed during the second half of 2009 revealed potential safety problems for such products in
respect to their water resistance performance. The BSMI intends to regulate acquarium lighting fixture as
commodities subject to legal inspection in order to protect consumers.

Conformity Assessment Procedures
Applicable Conformity Assessment Procedures for Aquarium Lighting Fixture listed in the Table are as
  follows: Registration of Product Certification (RPC) Scheme (Module II + III )*; or
Type-Approved Batch Inspection (TABI) Scheme**

Notes:
*Registration of Product Certification (RPC) Scheme
Under this procedure, manufacturers must have their products type-tested by the BSMI or Designated
Testing Laboratories recognized by the BSMI (Module II) before applying for registration of their
products. Manufacturers or importers will also be required to ensure by declaration that all products made
at their manufacturing facilities are in conformity with the prototypes submitted for type test in Module II.
Module III (conformity-to-type declaration): a declaration of conformity to type shall be drawn up by the
manufacturer or the authorized local representative, declaring that the products concerned comply with the
type as described in the type-test report. The application for RPC certificate shall be submitted to the
BSMI or its branches with jurisdiction over particular applicants. Products will be allowed to use the
Commodity Safety Mark with designated letter “R” and the identification number given by the BSMI,
after they are certified and registered with the BSMI. Both the application fee and annual fee for RPC is
NT$5,000 for each type of product, and a RPC certificate is generally valid for three years.

**Type-approved Batch Inspection (TABI) Scheme
Under this procedure, manufacturers or importers shall have their products type-tested by the BSMI or
Designated Testing Laboratories recognized by the BSMI, and then file an application for type approval
with the BSMI or its branches with jurisdiction over particular applicants.
After manufacturers or importers have obtained a type-approval certificate, they are required to file an

application for batch inspection with the BSMI each time before their products are to be released from the
production premises or arrive at the port of entry. The BSMI will then review the application and
accompanying documents according to simplified procedures. Additional samples may be required for
further testing if it is deemed necessary. The application fee for a type approval is NT$3,500, and a type
approval certificate is generally valid for three years.

The fees for type test vary by product and depend on the fee schedule of the testing laboratories.

Other inspection requirements for the aquarium lighting fixture listed in the Table:
1. The products listed in Table conduct certification by the Registration of Product Certification (PRC) or
    the Type-approved Batch Inspection.
2. The conformity assessment modules in accordance with Articles 3 of the Regulations Governing
    Registration of Product Certification.
3. The term of validity of an RPC certificate or a Type Approval certificate is 3 years. For certificates
    that are issued prior to the implementation date of this public notice, the term of validity shall be until
    December 31, 2013.
4. The inspection standards shall be the latest version of standards as of the date this public notice is
    adopted, except where the applicable version is otherwise designated. When the applicable standards
    is revised or amended, the date of applying the revised or amended standard shall be decided and
    announced separately by the BSMI.
5. The technical documents required for type testing shall prescribed by the BSMI.
6. Product having combined functions or multi-functions shall comply with relevant standards.
7. The relevant inspection fees shall be charged in accordance with the applicable fee schedule of the
    testing laboratory.
8. The application for type test shall be submitted to the BSMI or Designated Testing Laboratories
    recognized by the BSMI.
9. The application for type approval shall be submitted to the BSMI or its branches with jurisdiction over
    particular applicants.
10. The application for RPC certificate shall be submitted to the BSMI or its branches with jurisdiction
    over particular applicants.
11. The timeframe for completing the review of type approval or RPC certificate application is 14
    working days, including the review and evaluation processes. The time period of waiting for samples
    and/or necessary documents for review and evaluation is excluded. Another 7 working days will be
    needed to conduct sample testing.
12. The batch inspection application shall be submitted to the BSMI or its branches with jurisdiction over
    particular applicants, or any of them if necessary.
