Please find herewith, the summary of the conclusions of the 444th meeting of the Tariff and
Statistical Nomenclature Section (HS/WCO Coordination Sector) of the Customs Code
Committee, held in Brussels from 3rd to 4th March 2008.

1.     Adoption of the agenda

Upon proposal from the Chairperson the Committee agreed to add to the agenda under item 2)
“Pre-coordination 41st HSC”, point II.1, document TAXUD/628/08 concerning information
on the application of the HS Nomenclature in the French overseas territories.

The Committee accepted also to add under item 3) “Possible amendment of the subheading
Explanatory Note to subheading 4101.20” document TAXUD/629/08 which would be dealt
with together with item VIII.15 of the agenda 41/HSC.

Under item 8) “Any other business” the question of the adoption of previous meeting reports
would be addressed.

The Committee agreed to delete item 5) “Possible amendment of heading 04.03” from the
agenda as no working document was available.

The Committee then adopted the agenda with the above mentioned amendments.


2.     Pre-coordination of the 41st HS Committee meeting. Study of all available
       documents on the agenda of the aforementioned committee and fixing of a
       joint position

II.    REPORT BY THE SECRETARIAT

II.1   Position regarding Contracting Parties to the HS Convention and related matters.
       NC1253, TAXUD/628/08
       The Committee noted that Ukraine was only now applying HS 2002 (par. 5 of the
       working document). However, Contracting Parties applying older versions of the HS
       should now directly proceed to the application of HS 2007.

       With regard to document TAXUD/628/08 the MS who had submitted the information
       contained therein informed the Committee that HS 2002 was now being applied in
       Wallis et Futuna. The updated information contained in the working document would
       be sent to the WCO Secretariat.

II.2   Report on the last meeting of the Policy Commission. NC1254
       The WCO Secretariat would be asked to present the state of play with regard to the
       publication of the alphabetical index to the HS Nomenclature.

II.3   Approval of decisions taken by the Harmonized System Committee at its 40th session.
       NG0134, NC1252
       The Committee took note of the reservations entered by the European Community on
       the classification of outdoor units of airconditioning systems and by the Russian
       Federation on the classification of sodium sulphate.

II.4    Capacity building activities of the Nomenclature and Classification Sub-Directorate.
        NC1255
        The Committee took note of the information presented in the working document. The
        Secretariat would be asked to furnish information on WCO training courses carried
        out in areas other than classification.

II.5    Co-operation with other international organisations. NC1256
        The Committee took note of the information presented in the working document.

II.6    New information provided on the WCO Web site. NC1257
        The Committee noted the absence of any information on the publication of the
        alphabetical index to the HS Nomenclature. MS were asked to check the accuracy of
        the information on their respective contact persons.


III.    GENERAL QUESTIONS

III.1   Possible amendment of Article 8 of the HS Convention. NC1248 (Annex C/2),
        NC1258
        The Committee unanimously agreed to accept the proposed text as set out in the annex
        to document NC1258 i.e. to remove all square brackets in this text.

III.2   Updating of the Table establishing a correlation between the Harmonized System and
        selected international conventions. NC1259
        The Committee took note of the annex to the working document.


IV.     RECOMMENDATIONS

IV.1    Draft Recommendation of the Customs Co-operation Council on Chemical Weapons.
        NC1260
        With regard to the classification questions posed in the document the Committee
        decided as follows:

        Product number “5”:         classification in subheading 3824.90

        Product number “6”:         to be submitted to the Scientific Sub-Committee

        Product number “13”:        classification in subheading 3824.90

        Product number “16”:        classification in subheading 2931.00

        Committee on the basis of document NC1262:

The Committee agreed with classification in subheading 3908.90

Annex A/2 – Classification of transferrin aldifitox and verpasep caltespan
The Committee agreed with classification of transferrin aldifitox in subheading 3002.90 and
verpasep caltespan in subheading 3002.20.

Annex A/9 – INN list 97
● eldecalcitol: the Committee agreed to propose classification in heading 29.09 according to
its chemical structure. However, if other Contracting Parties demanded classification
according to its activity the question could be sent to the SSC

● lonaprisan: the Committee agreed that this product should be re-examined by the next SSC
on the basis of new information

Annex A/13 - General Explanatory Note to Chapter 28: the Committee agreed with the
proposed amendment

Annex A/14 - Epoetin beta: the Committee agreed with the proposed classification of epoetin
beta, epoetin alfa and epoetin gamma in subheading 3002.10.

Annex A/15 - Note 2 to Chapter 30 and heading 30.02: the Committee agreed to accept the
expression “which regulate the immunological processes”.

V.3    Classification of Beperminogene perplasmid
       The Committee agreed with classification of this product in heading 29.34

V.4    Possible amendments to the Explanatory Notes to Chapter 29
       The Committee accepted the amendments set out in the annex to the working
       document


VI.    REPORT OF THE REVIEW SUB-COMMITTEE

VI.1   Report of the 36th session of the Review Sub-Committee. NR0722
VI.2   Matters for decision. NC1262

The Committee agreed to examine the results of the 36th session of the HS Review Sub-
Committee on the basis of document NC1262:

● Annex C/8 – Possible amendment to the Nomenclature with respect to printer cartridges
The Committee agreed that discussion of this item should be pursued in the RSC.

● Annex C/9 – Possible amendment of Note 2 (a) to Chapter 94
The Committee agreed with the texts proposed by the Secretariat.

● Annex C/10 – Possible amendment of Note 1 (m) to Chapter 95
The Committee agreed with the amendments made to the proposed text by the RSC.

● Annex D/6 – Possible amendment of Note 1 to Chapter 38
The Committee agreed that a decision on this issue should be taken at the HS Committee
meeting in September 2008.

● Annex D/8 – Possible amendment of subheading 9504.30
The Committee agreed with the texts proposed by the Secretariat.

● Annex E/4 – Possible amendment to Note 8 (b) to Chapter 85
The Committee took note of the preliminary discussion that was held at the RSC on this item.
The Committee also noted that European industry was very interested in finalising this
question during the current review cycle.

● Annex E/5 – Possible amendment of subheading 8523.40
The Committee agreed with the texts proposed by the Secretariat.


VI.3 Classification of Passenger Boarding Bridges. NC1263
The Committee noted that the French version of the working document had not yet been made
available. A preliminary discussion only of this item at the HSC could therefore be accepted if
other Contracting Parties so wished. A tour de table then revealed a great majority of MS in
favour of classification in heading 84.79. This position would be defended at the HSC.

VI.4 Classification of biological dual-use items. NC1264
The Committee raised concerns with regard to the identification of the goods in question.
Acceptance of the proposal would also considerably increase the number of subheadings. The
annex to the working document contained a number of goods for which the correct
classification needed to be established. Finally, the Committee also had concerns with the fact
that a private party had brought forward the proposal at the HSC.

The above mentioned concerns would be raised at the HSC. A possible way forward could be
the insertion of the items concerned in the table correlating the HS Nomenclature with
selected international conventions.


VII.   REPORT OF THE PRESESSIONAL WORKING PARTY. NC1265

VII.1 Frozen chicken cuts with addition of salt. Annex A
      The Committee could accept the proposed text. With regard to the request made by
      Japan to insert a reference to “Gallus domesticus” the Committee decided to adopt an
      open position.

VII.2 Dried tea flowers. Annex B
      The Committee could accept the proposed text with the additional reference to “even
      intended to be used in pharmacy // “même si elles sont utilisées en médecine”.

VII.3 Canola oil flavoured with chilli pepper. Annex C
      The Committee agreed that the text should start with “Preparation consisting of low
      erucic acid rape oil”. An open position would be adopted with regard to whether or not
      the term “Canola” should be maintained given that it was a commercial denomination
      used in the US but not in Europe.

       In the French text the word “récipient” should be replaced by “flacon”.

VII.4 Taimbé. Annex D
      The Committee could agree with the proposed text. The presentation of the list of
      ingredients might be improved. The reference in the confidential part to “INS 150d”
      should be checked as the corresponding E-number might be more appropriate.

VII.5 Milk protein (product number 2). Annex E
      The Committee could accept the proposed text with an improvement of the
      presentation of the ingredients that would avoid the use of brackets.

VII.6 Pegfilgrastim (INN). Annex F
      The Committee could accept the proposed text. The correct alignment between the
      English and French text with regard to the reference to “G-CSF” needed to be
      checked.

VII.7 Explanatory Note to heading 57.02. Annex G
      The Committee agreed that the alternative proposed by the EC should be maintained.

VII.8 Soccer goalkeeper jersey. Annex H
      The Committee could accept the proposed text but noted that the portions of the text in
      bold and in normal characters needed to be inversed in order to correspond to the
      habitual presentation. A reference to “knitted” could be added to the text.

VII.9 Paintball pants. Annex IJ
      The Committee could accept the proposed text but noted that the portions of the text in
      bold and in normal characters needed to be inversed in order to correspond to the
      habitual presentation.

       In the French text the term “pantalon” should be used in the singular. In the English
       text the term “trousers” should be used. It should be checked whether the coating was
       visible to the naked eye in which case the product would fall into heading 62.10.

VII.10 Explanatory Notes of headings 84.36 and 85.08. Annex K
       The Committee could accept the proposed text. Typographical errors in the French
       text needed to be corrected.

VII.11 Power modules. Annex L
       The Committee noted that in the English version the texts describing the 4th and the 5th
       product were identical. The appropriate texts from the working document needed to be
       put in here. The reference to “C-TVs” needed to be checked as it was not clear which
       products were meant. Likewise, the terms “PC” and “auxiliary power” needed to be
       checked.

VII.12 Explanatory Note of heading 90.21 and 94.02. Annex M
       The Committee agreed with the deletion of the first square bracketed text. The last
       sentence should read “However, when the latter appliances form an inseparable part of
       the bed, table or another support, they are excluded from this heading”.

VIII.   FURTHER STUDIES

VIII.1 Classification of vehicles by the name “Jacobsen® Model 1100 and 1110 Haulers”.
       NC1223 (HSC/40), NC1266
       The Committee agreed to maintain the EC position in accordance with the relevant
       classification regulation. One MS presented a text for a possible amendment of the HS
       Explanatory Notes in order to distinguish more clearly between products of headings
       87.04 and 87.09. This text would be the subject of a working document for an
       upcoming coordination meeting. Once the classification dispute on these products
       settled this text could contribute to a study to be carried out by the Secretariat for an
       amendment of the HS Explanatory Notes.

VIII.2 Possible amendment of the Explanatory Note to GIR 3 (b). NC1267
       As there was no working document available the Committee agreed to postpone this
       item.

VIII.3 Possible amendment of the Explanatory Note to heading 17.01. NC1268
       The Committee agreed to accept option 1 as presented in the annex to the working
       document.

VIII.4 Classification of certain methanol or ethanol mixtures with gasoline. NC1217
       (HSC/40), NC1269, NC1301
       The Chairperson informed the Committee that the Commission Services were still
       examining the maximum limit allowed for denaturing. In view of the late publication
       of the working document NC1269 only a preliminary discussion might be held.

        With regard to the question whether this issue should be sent to the SSC the
        Committee agreed to adopt an open position. Furthermore, the Committee in principle
        agreed on a possible creation of separate subheadings for the mixtures at issue.

        As there was no definite position yet in the EC no position would be taken with regard
        to the classification of concrete products and a preliminary discussion would be
        proposed.

VIII.5 Scope of headings 22.06 and 22.08. NC1270
       As the relevant laboratory analyses for products A, B and D were not yet available no
       discussion of these products could be held. The Committee agreed to abandon the
       examination of products C and E as these were no longer marketed.

VIII.6 Scope of Note 1 to Chapter 25. NC1271, NC1307
       As there was no French version of the working document NC1307 available the
       Committee decided that a preliminary discussion only should be held.

VIII.7 Classification of ivermectin (INN) and similar products. NS0167 (Annex A/6),
       NC1272
       The Committee agreed to maintain classification in heading 29.32

VIII.8 General study on pegylation and its effects on the classification of pegylated
       pharmaceutically active substances. NC1123 (Annex G), NC1273

       The Committee agreed that this issued needed further study. In principle, classification
       of these products should be done on a case-by-case basis.

VIII.9 Possible amendment of the Explanatory Note to Chapter 29. NS0167 (Annexex A/5
       and A/10), NC1274
       The Committee agreed that a comprehensive amendment of the whole of Chapter 29
       should be carried out.

VIII.10 Classification of INN products (List 96). NS0167 (Annex A/8), NC1275
        The Committee approved the classifications set out in the annex to the working
       document.

       With regard to the products still to be classified it took the following decisions:

       Alvespimycin, tanespimycin: 2941.90
       carisbamate: 2924.29
       linaclotide: 3002.90
       rusalatide: 2933.99
       votucalis: 2934.99 – this product might be sent to the SSC for further examination.

VIII.11 Possible amendment of the Explanatory Note to heading 30.02. NS0167 (Annex A/7),
        NC1276
        The Committee accepted the proposed text as set out in the annex to the working
        document.

VIII.12 Possible amendment of the Explanatory Note to heading 33.01. NS0167 (Annex
        A/11), NC1277
        The Committee accepted the proposed text as set out in the annex to the working
        document.

VIII.13 Classification of milk proteins (product number 1). NC1197, NC1232 (HSC/40),
        NC1278
        The Committee agreed to adopt an open position with regard to the introduction of
       precise thresholds for the products in question.

VIII.14 Classification of polyurethane foam in aerosol containers. NS0167 (Annex A/12),
        NC1279
        The Committee agreed with classification in heading 39.09.

VIII.15 Possible amendment of the Subheading Explanatory Noteto subheading 4101.20.
        NC1202 (HSC/40), NC1280, TAXUD/613/08
        The Committee agreed to accept the first sentence of the proposal made by an MS in
       document TAXUD/613/08 i.e. “For the purposes of this Chapter, the expression
       “whole hides and skins” refers to the shape (surface) of the hides and skins and not to
       the thickness.” The rest of the text would be discussed with industry in order to obtain
       a version that was acceptable to them.

VIII.16 Classification of a warming blanket. NC1281
        As the discussion showed divergent views the Chairperson put the question of
       whether the warming machine was classifiable in heading 90.18 to a tour de table
       which showed that a majority of MS were in favour of classification in heading 90.18.

       With regard to the blanket itself the Committee agreed, in principle, to classify it
       together with the warming machine in heading 90.18.

VIII.17 Possible amendment of the Explanatory Note to heading 84.15. NC1282
         As there had been entered a reservation on the classification of these products the
       Brazilian proposal would be examined once the reservation procedure had been
       finished.

VIII.18 Possible amendment of the Explanatory Note to heading 85.09. NC1283
        The Committee could accept the Secretariat proposal set out in the working
        document but also the maintaining of status quo. An open position would, therefore,
        be adopted at the HSC.

VIII.19 Possible amendment of the Explanatory Notes to heading 90.25 and 90.27. NC1284,
        NC1302
        The Committee could accept the proposal mady by the Korean administration (see
       par. 7, NC1302). One MS informed the Committee that according to the IATE
       translation data base the translation of the French term “humidimètre” into English
       was “moisture meter”. This information would be brought forward at the HSC.

VIII.20 Classification of lamp posts. NC1227 (HSC/40), NC1285
        The Committee decided to wait for the complementary information to be provided by
        Madagascar before continuing with the discussion of this question.

VIII.21 Possible amendment of the Explanatory Note to heading 95.06. NC1286
        The Committee agreed to maintain classification in Section XI. The discussion on
        products 4a and 4b needed to be continued but the Committee agreed that these two
        products should be classified in Section XI as well.


IX.    NEW QUESTIONS

IX.1   Classification of pumpkin seeds. NC1249 (HSC/40), NC1305
       In view of an EC court ruling for a similar product for heading 12.12 the Committee
       decided to classify the products in question under this heading if they had lost their
       germinative power. Otherwise, classification would be in heading 12.07.

IX.2   Classification of certain jojoba products. NC1238 (HSC/40), NC1294, NC1292,
       NC1306
       The Chairperson informed the Committee that upon request from the US
       administration a presentation on jojoba production processes would be given at the
       HSC. The EC would maintain its previous position i.e. classification in heading
       15.18.

IX.3   Classification of coconut juice (water) and coconut milk. NC1287
       The Committee decided to classify Product (1) – coconut water – in heading 22.02 and
       Product (2) – coconut milk - in heading 21.06 in accordance with regulation 1486/93.
       Pure coconut juice (water) without any additives would be classifiable in heading
       20.09.

IX.4   Classification of an APC power distribution unit. NC1288
       The Committee agreed to classify the product in question in heading 85.36 by
       application of GIRs 2 a) and 3 b).

IX.5   Classification of “Sony Playstation”. NC1289
       The Committee agreed that the Sony Playstation 3 did not substantially differ from the
       PS 2 and, therefore, classification would also be in heading 95.04.

IX.6   Deleted

IX.7   Classification of correction tapes. NC1291
       The Committee agreed with classification of the products in question in heading 38.24
       taking into account Note 3 d) to Chapter 38.

IX.8   Deleted


X.     ADDITIONAL LIST

X.1    Reading of working documents. NC1295
       The Committee agreed that a complete reading of the working documents might be
       necessary in some cases while in others it was not. However, as some delegations
       would not have had the time and resources to undertake a detailed preparation for the
       HS meeting the reading of the working documents during the session was very useful.
       Furthermore, freely summarising the contents of a working document required more
       preparation for those chairpersons whose mother tongue was neither English nor
       French.

       In the light of the above arguments the Committee agreed that the extent to which the
       working documents should be read out during the session should be left to the
       discretion of the chairperson.

X.2    Possible amendment of the Explanatory Notes to GIR 1 and GIR 2 (a). NC1296
       In view of the late publication of the working document the Committee decided to
       have this item postponed.

X.3    Proposed new subheading for norephedrine. NC1297
       The Committee agreed to accept the proposal from Australia as contained in the
       working document.

X.4    Possible amendment of the Explanatory Note to heading 28.14. NC1298
       The Committee agreed to accept the proposal from Japan as contained in the working
       document.

X.5    Classification of new INN products (List 98). NC1300
       The Committee agreed to have a preliminary discussion only and to submit the list to
       the Scientific Sub-Committee.

X.6    Possible amendments to the Explanatory Note to heading 90.06. NC1303
       The Committee agreed with the editorial correction proposed by the Secretariat in the
       working document.

X.7    Possible amendments to Classification Opinions 9503.00/4, 9503.00/5 and 9503.00/7
       to 9503.00/9. NC1304
       The Committee agreed with the amendments proposed by the Secretariat in the
       working document.


XI.    OTHER BUSINESS

XI.1   List of questions which might be examined at a future session. NC1293
       The Committee took note of the contents of the working document.

XII.   ELECTIONS
       The Chairperson informed the Committee that Ms. Mantymaa, the delegate from
       Finland, would stand for the chairpersonship of the HS Review Sub-Committee.


3.     Possible amendment of the subheading Explanatory Note to subheading 4101.20
       Doc. TAXUD/613/08, TAXUD/629/08

This question was dealt with above under 2. “Pre-coordination of the 41st HS Committee
session, agenda item VIII.15”.

4.     Possible deletion of headings and subheadings with a small volume of trade
       Doc. TAXUD/616/08

Some MS had submitted to the Commission Services contributions to this item or would soon
do so. An updated version of the working document taking their comments into account
would be discussed at the next coordination meeting.


5.     Possible amendment of heading 04.03
       Doc. TAXUD/614/08

As no working document was available discussion of this item was postponed to the next
coordination meeting.


6.     Possible amendment of the HS Explanatory Note to heading 48.14
       Doc. TAXUD/615/08

The Committee agreed that a letter should be submitted to the WCO Secretariat setting out an
amendment to note 9, Chapter 48 for HS 2012. Furthermore, a proposal for an amendment of

the HS Explanatory Notes to heading 48.18 (corrigendum procedure) should also be made.
The texts of these proposals would be discussed at an upcoming coordination meeting.

7.     Classification of optical fibre cables
       Doc. TAXUD/617/08

The Committee agreed that the Commission Services should first contact India in order to see
whether their position had evolved. In case no bilateral solution could be found a proposal for
an amendment of the HSENs 85.44 as set out in the working document would be submitted to
the WCO Secretariat. The draft letter to the WCO would be discussed at an upcoming
coordination meeting.


8.     Any other business

       8.1.    WCO copyrights policy
               Doc. TAXUD/626/08

       A number of MS raised concerns about the implications of the WCO Copyright
       policy. In particular, smaller administrations would find it difficult to pay the
       copyright fees demanded by the WCO. MS gave an overview of their respective
       practice with regard to translation and publication of the HS Explanatory Notes and
       Classification Opinions.

       The Committee agreed that this issue needed to be addressed on EC level and not
       individually by Member States. As a first step those EC Member States represented at
       the WCO Finance Committee should raise the concerns mentioned above at the
       upcoming meeting of this Committee in April 2008. The Customs Director Generals
       (Deputies) should also be informed in order to find a coordinated approach for the
       WCO Council sessions in June 2008.

       At the next coordination meeting in May 2008 the Commission Services will inform
       MS on a proposed common approach to this issue.

       8.2     Adoption of reports of the Customs Code Committee meetings

       The Chairperson informed the Committee that the report of the present meeting would
       be adopted at the next meeting, thereby following the practice of other sectors of the
       Customs Code Committee. If MS had any comments on the report these should be
       sent to the Commission Services in advance of the report’s adoption.

       8.3.    HS Explanatory Notes divergencies

       One MS requested information on the state of play of this issue. The Chairperson
       responded that a submission to the WCO would be made as soon as possible.

       8.4     Departure of Mr. Joffre, delegate of France

       Mr. Joffre, who for many years had been the delegate of France at the Customs Code
       Committee, HS/WCO Coordination Sector, informed the Committee that he would

      soon be leaving his administration and he would therefore no longer attend the HS
      coordination meetings. The Chairperson thanked Mr. Joffre for his contributions to the
      work of the Committee and his strong engagement both in the RSC and HSC
      meetings. In the name of the Committee he wished him all the best for his future
      career.
