Recommendation(s): That the Board of Directors: Accept the certified copies of the attached Easement Deed (Permanent Easement) and Easement Deed (Temporary Construction Easement), for the acquisition of easements on portions of County Assessor Parcel Numbers 128-091-001 and 129-091-001, from Bradley Land Company to the District, for the amount of $87,300.00, by authorizing the Clerk of the Board to sign the original Certificates of Acceptance attached thereto. Alignment with Board Strategic Plan: The recommendation is primarily aligned with Goal No. 1. An Efficient Government Able to Respond Effectively to the Needs of the Community. Executive Summary and Discussion: The Flood Control and Water Conservation District (the “District”) has designed the plans and specifications to install and construct a retention basin, storm drain, and related public improvements in connection with the proposed Green Canyon Drainage Improvement Project (also known as the East Santa Maria Drainage Improvement Project and hereinafter referred to as the "Project").

The District’ Board of Directors approved the Project and the Negative Declaration (00-ND-31) pursuant s to the California Environmental Quality Act (CEQA) on November 21st, 2000 (Clerk of the Board File No. 00-21,487). The Project has also been found to be in conformity with the County’ General Plan in s compliance with Government Code Section 65402. In accordance with the National Environmental Protection Act (NEPA) the Federal Emergency Management Agency (FEMA) prepared an Environmental Assessment and Finding of No Significant Impact (EA-FONSI) known as document number HMGP-1044-445-0025 on July 22nd, 1998, and FEMA approved said EA-FONSI on August 5th, 1998. The Project involves the District’ acquisition of permanent easements for a retention basin, storm drain s improvements, and embankment restoration improvements, together with temporary construction easements, upon APNS 128-091-001 and 129-091-001. Both of the parcels are owned by Bradley Land Company. On June 19th, 2001, the Board of Directors executed Real Property Purchase Contracts providing for the District’ acquisition of the necessary easements on the properties owned by Bradley Land Company in s the amount of $87,300.00 (Clerk of the Board File No.01-22,090). Pursuant to the terms of the contract, escrow was opened with Chicago Title Company. Bradley Land Company executed the easement deeds for the easements in escrow. On October 16th, 2001, the District Board of Directors adopted Resolution No. 01-352, a Resolution of Intent to Purchase Real Property (Clerk of the Board File No. 01-22,090). The Resolution of Intent to Purchase Real Property describes the easements to be purchased, the price to be paid, the property owner (seller), and a notice that the Board will meet on November 13th, 2001, to consummate the purchase through the acceptance of the easement deeds. Notice of the intention to purchase the easements was published pursuant to Section 6063 of the Government Code in the Santa Barbara News-Press on October 22nd, October 29th, and November 5th, 2001. Also on October 16th, 2001, the Board set the date of November 13th, 2001, on the Administrative Agenda to consummate the purchase of the easements through the acceptance of the attached easement deeds. Upon acceptance by the Board, the easement deeds will be delivered to escrow and, provided that all conditions to the close of escrow are satisfied, escrow is expected to close on or about November 19th, 2001. Fiscal and Facilities Impacts: Funding is available from Department 054, Fund 2560 and Account 8200 for Real Property services as well as for the Project. The just compensation for the acquisition of the necessary easements is $87,300.00. In addition, escrow fees for the transaction will cost the District approximately $2,000. Upon receipt of the documents from the Clerk of the Board, the Facility Services Division will deposit them in escrow. Once the documents have been recorded, the originals will be returned to the Clerk of the Board and the Facilities Services Division will keep copies in its files.
