Trademark Registration: To complete a trademark application, you will need the following information and materials: (a) Goods or Services: The application must identify, with some particularity, the goods or services provided in connection with the mark. Use in Commerce: The application must provide the date that the mark was first used in connection with the stated services in interstate commerce. Please be prepared to substantiate this date with relevant documentation (e.g., purchase orders or invoices). Use Anywhere: The application must provide the date that the mark was first used in connection with the stated services anywhere, whether in interstate or international commerce, or otherwise. Typically, this date is the same date as the date of first use in commerce. Drawing: The application must include a drawing of the mark, which may consist of words in upper case letter or a stylized black and white rendition of the mark with lining to signify colors. Unstylized words will cover all variations of those words. If the mark includes a distinctive design, we generally recommend separate registrations of both the unstylized words and the stylized words-and-design combination. Specimens: The application must include specimens of actual use of the mark in connection with the stated goods or services. Please provide us with three such specimens. We are available to assist you in selecting and preparing specimens. For a mark used in connection with tangible goods, appropriate specimens include labels, invoices, packaging, screen shots of software or the product itself, which bear the mark. For a mark used in connection with services, appropriate specimens include brochures, web pages or other types of advertising bearing the mark and describing the services.

Screening Search: To assess the availability of the desired mark, we recommend a screening search for your mark. Federal screening searches reveal all similar Federal trademark applications and registrations. Internet searches, telephone directories and trade publications can be useful for your own preliminary assessment of availability. Trademark Notice: You should display the mark with the appropriate proprietary notice. Unregistered marks should be displayed with the symbol ™ for a trademark and SM for a service mark. The symbol ® should not be used in connection with the mark until the mark is actually registered.

Fees: The following fees apply: (a) Trademark Registration: The fee for a trademark application is $750.00 plus application Patent and Trademark Office (“PTO”) filing fees (currently $325.00 per class of goods or services identified in the application). Responses to PTO office actions concerning the application are provided at standard hourly rates. Screening Search: Federal Screening Searches are provided at cost (currently $205.00/search for a standard five business day turnaround). Our analysis of the results of either search will be provided at the standard hourly rates. Analysis typically takes two to four hours depending on the number of marks uncovered by the search.
