Last Will & Testament of Daniel R. Moon
In the name of the Benevolent Father of All Amen, know all men by these presents that I Daniel R. Moon of Pike Township, Jay County, Indiana being of lawful age of sound mind and memory and in view of the uncertainty of life and the certainty of death and the more fully to provide for my family after my death do make and publish this my Last Will and Testament. estate. Item 1st – It is my Will that my just debts and funeral expenses be first paid out of my
Item 2nd – I do hereby give and bequeath unto my beloved wife Esther Moon all my personal estate household and kitchen furniture, rights, credits, monies and effects of whatever kind of which I may die seized of, either in law or equity. Also all the estate both personal and real which I inherit from my father William Moon late of Clinton County, State of Ohio, hereby giving her full power to sell and convey said real estate and collect and receipt for the same. Also I do hereby give and bequeath unto my said wife Esther Moon all my real estate situated in Jay County in the State of Indiana and described as follows to wit: The West half of the North West quarter of Section Six in Township No. Twenty two North of Range Fourteen East containing one hundred and two and 20/100 acres more or less to have and to hold unto the said Esther Moon during her natural life. Item 3rd – It is my further will and desire that after the death of my said wife Esther Moon and the payment of her funeral expenses that the residue of my estate both personal and real be equally divided between my lawful heirs. Item 4th – I hereby appoint my beloved wife Esther Moon Executrix of this my Last Will and Testament. Witness my hand and seal this 11th day of December 1876 Daniel R. State of Indiana Jay County. ss: Before me R. T. Hammous, Clerk of Jay Circuit Court personally came Cornelius Corwin one of the subscribing witnesses to the Last Will and Testament of Daniel R. Moon late of said County, deceased and being duly sworn on his oath says that he was present at the execution of said Last Will, that the same was duly executed, that at the time of the execution thereof, said testator was of full age to devise his property of sound mind and memory, and not under any coercion or restraint, that said testator requested him to sign said Will as witness thereto which he accordingly did in the presence of testator and in the presence of David S.
