Please Note: A Permit will not be issued unless your public risk and liability cover of your business is for at
least 10 million dollars and the policy is endorsed to include the name of the City of Port Lincoln as a
principal party. Please inform your public risk insurer that you are applying to extend your business
activities to include use of footpath and that you require a Certificate of Currency to submit with your
application. (*Short Term permit – endorsement is not required - Certificate of Currency only required)


For a RENEWAL a Certificate of Currency for the permit period must be provided as above, the previous
years will not suffice.

ITEM 2 THE PERMIT AREA
Please provide detail as to the prescribed Use of Public Footpath being applied for:

The INITIAL application must be accompanied by a scaled (1:100 minimum) dimension plan of the proposed
use of the footpath area. The plan should show:

                        The boundaries of the use of footpath area in relation to the building face and the kerb

                        The number, type and position of the pieces of furniture

                        Any existing street element within the proposed area including refuse bins, public seats and
                        poles.

A permit will not be issued unless the footpath is wide enough to allow the furniture and a two (2) metre
direct and unobstructed public footway separate from the use of the footpath area. (Furniture to be placed
not nearer than 600mm to the Kerb)

ITEM 3 THE AUTHORISED FURNITURE & PAYMENT OF FEE
Please do not send a cheque with this application. An invoice will be issued to you once the application has
been assessed, in accordance with the current Fees and Charges Schedule.

ITEM 4 THE COMMENCEMENT DATE
The INITIAL application for a permit will take effect from the date the permit is approved by Council to the
next 30th day of June (pro-rata fees may apply for a period of less than 6 months)

RENEWAL permits will take effect from the 1st day of July to the 30th of June. A RENEWAL permit must be
applied for each financial year.

ITEM 6 Permits for Use of Public Road for Business Purposes are not transferable
Should you sell your business you must inform the new business owner that they will need to apply for a
new Permit. The permit is issued to the business owner not to the business.

ITEM 7 General Conditions of Permit
A permit is hereby approved, subject to these “General Conditions of Permit”

   1. Certificate of Currency valid for period of permit
   2. The permit holder, where appropriate, shall ensure that it is licensed or registered to carry out the
        activity authorised by the issuing of this permit.
   3. The permit is not transferable.
   4. No nuisance may be committed. Permit holders must not knowingly cause annoyance to any
        member of the public, including obstruction to pedestrians or traffic movement outside of the area
        of this permit
   5. The permit holder shall comply with and give all notices required by any Act of Parliament,
        Ordinance, Regulation or By-law relating to the activity.
   6. The permit holder shall ensure that its site or sites are left in a clean and tidy condition at the end of
        the permit period. Failure to do so may result in cleaning fees being charged.
   7. This permit may be revoked by Council if the permit holder fails to comply with a condition of this
        permit or may be revoked in any other justifiable circumstance by a delegated Council officer or
        SAPOL.
