        MINUTES OF THE COUNCIL MEETING HELD IN THE COUNCIL
        CHAMBERS, RAILWAY TERRACE, CUMMINS, ON FRIDAY 12
        DECEMBER 2008 COMMENCING AT 1.34 PM .


PRESENT:              COUNCILLORS M J HILL (MAYOR), J K LOW (DEPUTY
                      MAYOR), G S BOBRIGE, P B PEDLER, N H TREZISE, L
                      P MURRAY AND P J PORTER.

                      MESSRS R W PEARSON (CEO), T SMITH
                      (ACCOUNTANT), L P BLACKER (DEVELOPMENT
                      MANAGER), AND MRS G E PICKFORD (SECRETARY).

589    CONFIRMATION OF MINUTES

       TREZISE / BOBRIGE
       That the Minutes of the Meeting held on 12 November 2008, as per
       copies supplied to members, be confirmed.
                                                                Carried

       Cr Murray made comment that he was not completely satisfied with the
       Works Manager’s response to his query on the standard of
       infrastructure at Point Boston as documented in the minutes relating to
       the CEO’s Report item CEO/104/08.

       The Works Manager was unavailable for comment and would be asked
       for further clarification on his return to the meeting.

589    CONFIRMATION OF MINUTES


       Cr Murray noted the return of the Works Manager to the meeting and
       again raised his concern in regard to the documented response from
       the Works Manager in respect of Point Boston infrastructure. Cr
       Murray was seeking assurance that the infrastructure has been
       developed to a satisfactory standard, rather than only the plans having
       been designed to an appropriate standard.

       The Works Manager confirmed that the provided infrastructure has
       been designed and constructed to appropriate engineering standards
       and does reflect the extent of infrastructure interpreted as being
       required by the Point Boston (Mixed Use) zone of Council’s
       Development Plan.

       Cr Murray again raised his concerns with the standard of footpaths,
       lighting and drainage that had been constructed.

       Cr Low stated that Council were debating the recording of the minutes
       not the issue of the standard of the infrastructure.

597    BUSINESS ARISING FROM THE MINUTES

(1)    Item 588 (1.1) Coffin Bay Caravan Park Lease

       Cr Porter queried the status of this item as the Lessee has received no
       further notification from Council in regards to the matter.

       The CEO advised that the documents were with the Lessee’s Solicitor
       to finalise.


598    COMMITTEE MINUTES

       That the Minutes of the Committee Meetings be received.
                                                                      Carried.

       1        Finance Committee: meeting held 21 November 2008
       2        Works Committee: meeting held 21 November 2008
       3        Occupational Health Safety & Welfare / EEO Consultative
                Committee: meeting held 27 November 2208

       Cr Bobrige queried item 8.9 in the OHS&W minutes and asked if
       inspection of trails are included in the infrastructure items. The Works
       Manager advised that a checklist is only just being drawn up and trails
       could be included.

       That the minutes of the Committee Meetings,                   and   the
       recommendations contained therein, be adopted.

       Mrs Dianne Modra, Economic & Community Development Officer
       presented a verbal report on the status of funding applications that
       have been submitted:
       • Zero Waste – Coffin Bay and Cummins
       • Natural Disaster Mitigation Scheme
       • Coffin Bay Town Centre Project - $50,000 has been received from
          SA Tourism and an application has been submitted for the “People
          for Places” grant
       • Sleaford Bay Public Convenience – attempting to source funding
          from SA Tourism
       • Cummins Medical Clinic
       • Assisted with a “Grants for Seniors” for the Cummins Homes

611    GENERAL BUSINESS

(1)    Cr Bobrige

       Cr Bobrige advised that a “Caring for Country” meeting will be held on
       Monday 15 December at 3.00pm at the Hilton Hotel in Port Lincoln

       Cr Bobrige advised that the Lower Eyre Pest Management Group
       will be giving out pine trees for Christmas on lawns in front of the Port
       Lincoln Yacht Club on 16 December.

(2)    Cr Trezise

       Coffin Bay Issues
       Cr Trezise made note of the concerns of the Coffin Bay community that
       issues relating to Coffin Bay are not being finalised.

(3)    Cr Murray

       Point Boston Development
       Cr Murray made note of his concerns relating to the standard of
       infrastructure being provided in the Point Boston development.

       Cr Murray noted that Council will be forced to accept the infrastructure
       provided in Stage 1, but stated that Council should seek a better
       standard of infrastructure in the future.

       The Chairman stated that the purchase of land is a commercial
       transaction and nothing to do with Council. The Chairman suggested
       that Cr Murray present a list of questions to staff to be answered at the
       next meeting.

       The CEO advised that staff have requested advice from the Local
       Government Association regarding the relationship between Council
       and a Community Title Corporation in respect to future liability for
       infrastructure.
