The provisions of Chapter 14 of the Local Government Act, 1993 regulate the way in which
Councillors and nominated staff of Council conduct themselves to ensure that there is no
conflict between their private interests and their public trust.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct
or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the
Council (or Committee), that interest and the reasons for declaring such interest must be
disclosed as soon as practicable after the start of the meeting.

As members are aware, the provisions of the Local Government Act restrict any member
who has declared a pecuniary interest in any matter from participating in the discussions or
voting on that matter and further require that the member vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of
interest, the nature of the conflict must be disclosed. The Code also provides for a number
of ways in which a member may manage non pecuniary conflicts of interest.



RECOMMENDATION

That where necessary any Councillor now disclose any interest and the reason for
declaring such interest in the matters under consideration by Council at this meeting.

SUMMARY

Confirmation of the minutes of the previous Observation of Eid Committee Meeting held on
February 20, 2008.

Note that all of the recommendations of the Committee were adopted by the Council at its
meeting on 5th March, 2008.


RECOMMENDATION

That the minutes of the previous Observation of Eid Committee Meeting held on
February 20, 2008 be received.

EC001/08        Election of Chairperson

The Committee noted the decision by the Mayor, to chair the Committee Meeting in
accordance with the Council’s Code of Meeting Practice.



EC002/08        Adoption of Committee Charter

RESOLVED unanimously on the motion of Clr Campbell, seconded Clr Batik that the
Committee recommend that the terms of Annexure 1 as attached to the subject report
be adopted as the Charter for the Observation of Eid Committee.



EC003/08        Hosting of Community Leaders at Break the Fast Function

RESOLVED unanimously on the motion of Clr Campbell, seconded Clr Batik that the
Committee recommend the holding of a function for community leaders to break-the-
fast as hosts of the Council, and that:

    -   the function takes the form of a dinner on an evening to be determined;
    -   the invitees include the Local State and Federal Member, and locally based
        Community Religious Leaders;
    -   Councillors be invited to each submit names of organisations or people who
        may be invited to the function; and
    -   the committee at a further meeting review that list so as select a final list of
        persons / representatives to be hosted at the function.

EC004/08        Display of Street Banners

RESOLVED unanimously on the motion of Clr Zraika, seconded Clr Batik that the
Committee recommend that street banners to mark Eid be displayed in Auburn,
Lidcombe, Berala and Regents Park.



EC005/08        Review of Christmas Banner Displays


RESOLVED unanimously on the motion of Clr Zraika, seconded Clr Campbell that the
Committee recommend that, consistent with the criteria for it to consider the
implications for other festivals and the public perception of Council’s actions, the
Council review the format and adequacy of the banners regularly displayed in the LGA
to celebrate Christmas.

EC011/08       Review of Nominations for Break the Fast Function

SUMMARY

It is necessary for the Committee to review the list of proposed invitees to the Break the Fast
Function.


RECOMMENDATION

That the Committee compile a final listing of invitees for the function.



REPORT

In response to separate emails to all the Councillors, the names of the following persons
have been put forward:

It is appropriate therefore for the Committee to review the above list and to add those other
persons who it considers should be invited.

SUMMARY

The Committee’s consideration is invited to the time and format of the Break the Fast
function.


RECOMMENDATION

That the Committee formulate a recommendation on the date, format and other key
aspects of the Break the Fast Function.


REPORT

Further to the Committee’s recommendation which was adopted by the Council at its meeting
on 5th March 2008, the function is to take the form of a dinner on an evening to be
determined. It is noted that Eid occurs in 2008 between the dates of 30th September and 2nd
October, 2008 and the Committee is therefore invited to nominate the date and time as well
as any other relevant details for the function.
