a) Provide brief background information on the original setting up of the Committee. Indicate the validity
period of its last mandate.


Set up in 1958, the European Committee on Crime Problems (CDPC) was entrusted by the Committee of
Ministers the responsibility for overseeing and coordinating the Council of Europe’s activities in the field of
crime prevention and crime control.

The CDPC identifies priorities for intergovernmental legal co-operation, makes proposals to the Committee of
Ministers on activities in the fields of criminal law and procedure, criminology and penology, and implements
these activities.

The CDPC elaborates conventions, agreements, recommendations and reports. It organises criminological
research conferences, criminological colloquia, and conferences of directors of prison administration.

Its last mandate is valid until 31 December 2010.

Committee of Experts on the Operation of European Conventions in the Penal Field (PC-OC)
       - Elaborates ways to improve international co-operation in criminal matters and identify solutions
           to practical problems encountered in the application of Council of Europe conventions in the
           criminal law field (eg, extradition, mutual legal assistance, the transfer of sentenced persons).

Council for Penological Co-operation (PC-CP)
        - A standing advisory body to the CDPC dealing with questions related to prisons and developing
             European standards, including the European Prison Rules and the Council of Europe Probation
             Rules and other recommendations on juveniles offenders, education in prison, prison staff,
             health care in prison and prison overcrowding.

Conference of Directors of Prison Administration (CDAP)
       - The regular CDAP are held in Strasbourg and organised by the Council of Europe. The holding
           of ad hoc CDAP conferences in different hosting member-states offers an opportunity to inform a
           larger audience about the work carried out by the Organisation in the penal field.

Group of Specialists on Counterfeit Pharmaceutical Products (PC-S-CP)
       - Reported on the feasibility of an international legal instrument in the field of counterfeiting of
           medical products and similar crimes. It held six meetings in Strasbourg to prepare the draft
           Convention on Counterfeit Pharmaceutical Products and Similar Crimes Involving Threats to
           Public Health. The last meeting, at which a draft text of the convention was adopted, took place
           on 2 – 4 February 2009. The terms of reference of the PC-S-CP expired on 28 February 2009.


Ad Hod Committee on Counterfeiting of Medical Products and Similar Crimes involving Threats to Public
Health (PC-ISP)

         -    A new plenary committee with the participation of all member states, observers and other
              international organisations was created to negotiate and finalise the convention. The draft
              convention was approved by the CDPC at its plenary in October 2009.

Group of Specialists on Child-friendly Justice (CJ-S-CH)
       - Drafting of a recommendation on child-friendly justice in civil, administrative and criminal law
           areas, ensuring effective access to justice for children.

Yes, there is an inevitable overlap with the work of the European Union.

Yes.

meetings of the Bureau or subordinate bodies or by using other means of communication?

It would not be possible since there is only one plenary meeting per year.


6. With the same budget, what improvements do you suggest to raise the efficiency and relevance of
the committee’s work (for example with regard to topics addressed, length of agendas, documents,
working methods, ministerial conferences, …)?

Shorter plenary meetings but twice per year instead of once. This would involve fewer items on the agenda
each time and give more time for intergovernmental discussion.


7. In your opinion, which priority topics should be examined by this committee?

Topics related to scientific proof in criminal matters, dangerous offenders, prison issues, penal procedure,
victimology, special investigative measures, modernisation of conventions on international cooperation in
criminal matters.


8. Do you see the need to reinforce the interaction between the Committee of Ministers and your
committee?

No, the current situation is acceptable.

-AL: CoE(CDPC) resolutions are very useful as “European standards” in assisting Albanian law
drafters (e.g. prison & probation, mediation in penal matters, pre-trial detention, legal aid,
domestic violence); MLA and Extradition Conventions are applied; difficulty: some treaties are
ratified, but not implemented

AT: CoE Conventions (e.g. MLA, Extradition+Protocols, Money Laundering, Corruption,
Terrorism Prevention, Sexual Exploitation etc.) very useful as standards for efficient international
cooperation and as incentives for the legislature. Recommendations (e.g. Prison Rules, simplified
and summary proceedings, pre-trial detention, domestic violence etc.) used as guidelines and

Ministry for Foreign Affairs to the relevant bodies for guidance in their daily work.

The main value of the CDPC is the promotion of the implementation and harmonisation of
national policies with regard to criminal law, as well as the examination of Council of Europe
conventions and agreements in the penal field and improving practical applications

- The CDPC holds a plenary session every year and it is very efficient way. I think we have to go
on by this mechanism as it is.

- The agendas of the CDPC every time were very hard and meaningful. The working methods as to
me is enough efficient and to propose to change something with the same budget is very difficult.

- All the topics that we had in our agendas were very important one and to give priority to some of
them would be not correct. Meanwhile during the meetings we have to give more importance to
the examination of Council of Europe conventions and agreements in the penal field, and to the
practical cooperation of the member States.

- Consider the possibility of participation of the Chair of CDPC at the Committee of Ministers

- Since 2001 Armenia has participated in all CDPC meetings. This activity is very important for us
and Armenia is ready to make its contribution in all projects.

A. Relevance and added value: impact of the committee’s work in your country

- The Convention on protection of children against sexual exploitation and sexual abuse
served as a basis for the legislative amendments of the Bulgarian Penal Code (PC), carried
out in April 2009, in Section “Debauchery” of the PC and in the Bulgarian Penal Procedure
Code (PPC). The main purpose of the aforesaid legislative amendments, carried out by the
Bulgarian Government (in particular, initiated by the Ministry of Justice) was to bring in
line the relevant provision of the PC and the PPC with the high standards of the new Council
of Europe Convention in the area of protection of children against different types of sexual
offences. Through the abovementioned amendments, new corpora delicti were introduced in
the Bulgarian PC and new procedural rules in the PPC (an essential example for the latter is
the fact that with the amendments in the PPC the interrogation of a child victim of a sexual
offence can be carried out through the use of videoconference). The legislative amendments
are already fact, which undoubtedly proves the practical significance of the new Council of
Europe legal instrument.

- Bulgarian authorities also give great importance to the work done within the Ad hoc
Committee on counterfeiting of medical products and similar crimes involving threats to
public health (PC-ISP) towards the elaboration of a new convention on the same matter. The
future adoption of the above mentioned instrument will provide for criminalisation of
certain acts and facilitate the international cooperation between the state parties by creating
a set of minimum standards in the field of prevention and combating counterfeit medical

products. One of the most significant results, similar to the above given example, will be
namely the improvement of the quality of both national and international legislation, as well
as setting up and application of higher standards in protection of public health.

reasons, to your mind?

- The Committee’s work is considered to be very useful, due to the fact that professionals
being involved in the activities of CDPC mostly appreciate the function of the Committee
related to making proposals to the Committee of Ministers for undertaking of certain actions
(including legislative, practical, etc.) in the field of criminal law and procedure. In particular,
the experts within the Ministry of Justice consider this function as a key one which has a
horizontal impact on criminal law in general. This impact is undoubtedly being achieved
through the activity of the Committee to provide adequate solutions for various criminal law
issues - both substantive criminal law and procedural law matters.

On the other hand, CDPC has “a broad overview” over the activity of numerous expert
committees, groups of specialists, etc. before their work is being presented to the Committee
of Ministers.

Some of the practical results have been pointed out in the answers to Question 1 and 2. Our
general conclusion is that the added value of the work of the Council of Europe is the
introduction of high standards in the criminal law for Member-States (substantive and
procedural law), strengthening of the international legal cooperation in criminal matters, as
well as elaboration of adequate solutions for various practical problems, which might emerge
in the process of international legal cooperation.

- We do not consider the current number of plenary meetings as excessive. On the contrary,
we share the opinion that if the number of plenary meeting (which is currently 1 per year) is
limited, the agenda of the meetings will be “overloaded” and it will very difficult to take
decisions on all the items included. This might decrease the efficiency of the Committee’s
work.

Yes, of course there is overlap to some extent with several other organizations, in particular the
European Union and the United Nations. The main factors contributing to this overlap are the
membership (the wider the membership, the more difficult it is to achieve consensus on
instruments that actually have a relevance to practice and policy), and the continuity of activity
(the Council of Europe has the longest tradition, and to some extent the European Union is trying
to “reinvent the wheel” on some issues, and trying to go further on others).

We are aware, and we appreciate, the great extent to which efforts are made to coordinate the work
of the Council of Europe, and the European Union.

The overlap with the United Nations (UN Office on Drugs and Crime) is not a significant problem.
The UN has produced a considerable variety of soft law recommendations and resolutions – which
often are based on Council of Europe discussions and instruments, but are then generalized (and
“watered down”) to allow them a more global application.

The UN has also produced hard law in the form of the conventions from 1988, 2000 and 2003. To
a significant degree, these have been able to utilize the experience of the Council of Europe (and
the European Union).

It appears likely that the Council of Europe and its CDPC will continue to be a source of
inspiration to other regions.

that the participants at CDPC meetings tend to be well indoctrinated into the issues at hand, and

- Eviter de réduire les discussions sur la grand partie de sujets a tort ou à raison considérés comme
« mineurs » à la dernière (demi) journée de réunion en privant les débats à ce sujet de
l’enrichissement potentiel dérivant de la contribution de tous

- Calendariser avec plus de précision les discussion législatives en évitant dans la mesure du
possible de empiéter au-delà du temps assigné dans l’idée que, au début de la semaine des travaux,

on dispose de beaucoup de temps et on puisse prendre le « luxe » des discussions parfois superflues
sur des points de détail pour se réduire après a clôturer de manière parfois précipiteuse les
discussions vers la fin de la semaine pour manque de temps.

L'utilité dépend du domaine. La législation suisse est en général largement conforme aux standards
internationaux. Dans la plupart des cas, la mise en oeuvre des conventions du Conseil de l' Europe
ne nécessite pas de changements fondamentaux de la législation interne. Comme exemple, on peut
mentionner le troisième protocole additionnel à la Convention européenne d'extradition. Par contre,
l'adhésion à une convention ne peut pas être le seul motif pour changer la législation interne.

- Rec (2008)11 du Comité des Ministers aux Etats membres sur les Règles européennes pour les
délinquents mineurs faisant l'objet de sanctions ou de mesures

-There is very difficult to assess direct impact of the committee’s work on national legal system.
The steering committee poses one of the body of Council of Europe which participate in
establishment the law particularly concerning co-operation in criminal matters.

- All conventions in these matters are very important achievement in raising the safeguards of the
citizens to be properly protected on the same level in all member States. Also the other legal acts
such as recommendations or resolutions depict in which directions the future work of the Council
of Europe should be carried out.

- That is why legislative results of legal activity of Council of Europe including committee’s work
play important role for internal legislator. It shows what need to be done to be in compliance with
the latest Council of Europe’s achievement in criminal field.

- Wide range of the conventions were adopted inter alia by the committee. Hence also input made

In principle the committee deals with criminal instruments ahead of the other organizations or
agencies.

So as regards the outcome, it might sometimes happen that because of overlapping the interests
towards protection of human rights or prevention the crimes some organizations or agencies may
undertake similar legislative activity.

However, legislative acts adopted by Council of Europe usually pose a indication what need to be
done in the future. Yet they give rise to follow of the Council’s (committee’s) footsteps in these
matters.


Please point out the added value of the work of the Council of Europe in your field:
The instruments which were adopted by Council of Europe pose very important input in
improvement of international co-operation between member States.

The outcomes of its work point out the direction how to improve the protection of human rights
especially in criminal field.

- Replacement of the plenary meetings by the Bureau meetings might not be sufficient means to
improve the effectiveness of interoperability between member States. The reason why to establish
the plenary meetings of the committee was to give the chance to delegates from different countries

to exchange their views and opinions in order to find a solution or reach a compromise despite
varieties of their legal systems.

-Leaving such opportunity in hands of the Bureau might expedite the preparations to the plenary
meeting of the committee and reduce the costs of functioning of the committee. However it might
not be a sufficient way for facilitate the means of reaching the compromise between member
States.

-It should be taken into consideration the shortening the duration of the plenary meetings.
-Instead of current period of the plenary meetings, it might be taken into account to organise the
meeting for example twice a year for shorter period of time. It would give the delegates more time
to prepare their attitudes and reach a compromise even if such compromise could not be achieved
during one meeting.


7. In your opinion, which priority topics should be examined by this committee?

One of the main task of committee’s activity is to raise the effectiveness in interoperability
between the member States.

That is why such co-operation should be still reinforced n terms of carrying out the analysis of all
existing instruments in that field without prejudice to establishment new instruments, where
appropriate.


8. Do you see the need to reinforce the interaction between the Committee of Ministers and your
committee?

- All problems which were tackled during the meetings of the committee are usually raised in list
of decisions taken during its work.

-It seems to be proper means of the communication with the Committee of Ministers which allows
to show the merit of the committee’s work and specificity of the matters handled with.

La législation hongroise est en général largement conforme aux standards internationaux. Dans la
plupart des cas, la mise en oeuvre des conventions du Conseil de l' Europe ne nécessite pas de
changements fondamentaux de la législation interne. On peut mentionner le troisième protocole
additionnel à la Convention européenne d'extradition ; l’extradition simplifiée existe depuis 1996
dans la législation hongroise.

- I do not recommend having less than 1 plenary a year, but you might want to reconsider on
having meetings that lasts an entire week. It is not very familyfriendly, and you might end up
putting to many items on the agenda (like last plenary). Better to have two shorter versions?

- If you have 1 plenary a year, the number of items on the agenda should be less than last time, or –
if possible - “more” finished. A lot of time is spent on details, and the plenary sessions do not
manage to finish properly – only hurriedly...

–   la convention STCE n°201 sur la protection des enfants contre l'exploitation et les abus sexuels a contribué
    remettre la question à l'ordre du jour du débat public. Elle a conduit à apporter certaines modifications
    législatives permettant de mieux appréhender de nouvelles formes de criminalité (« grooming »).

–   le projet de convention sur la contrefaçon de médicaments et les infractions similaires portant atteinte à la santé
    publique contribuera à la prise de consicence de l'importance de la lutte contre ce phénomène au niveau
    international. Au plan interne, sa mise en oeuvre éventuelle par la France devrait à conduire à repenser le
    traitement de certaines infractions afin de renforcer l'efficacité de la répression dans ce domaine.

–   Par exemple, les travaux conduits, sous l'égide du CDPC, par le PC-OC, permettent un échange de vues entre
    experts sur des questions d'intérêt commun liées à la coopération judiciaire pénale. Il en va de même des travaux
    conduits par le comité de coopération pénologique pour les questions pénitentiaires.

–   Le projet en cours sur la coopération judiciaire pénale (qui vise à l'établissement d'une base de données contenant

    des modèles-types de demandes d'entraide et des fiches sur les législations nationales applicables) sera d'une utilité
    immédiate pour les praticiens.

Un risque de chevauchement existe avec l'UE et de fait, le développement de la construction de l'UE dans le domaine
de la justice pénale a pour conséquence de réduire le champ d'activités potentiel du Conseil de l'Europe et le nombre
des thèmes sur lesquels il peut engager des travaux. Par ailleurs, en matière pénale, il n'est pas toujours souhaitable de
vouloir étendre au Conseil de l'Europe l'ensemble des standards de coopération adoptés dans le cadre de l'UE, qui
peuvent être liés au niveau d'intégration juridique et politique particulier qui existe en son sein.

Les travaux conduits sous l'égide du CDPC permettent d'échanger les expériences et les bonnes pratiques sur certains
sujets et, à partir d'une étude approfondie des besoins, de faire émerger des problématiques méritant des travaux
normatifs (par exemple, la contrefaçon de médicaments). Lorsque cette méthode – fondée sur une évaluation préalable
- est suivie, les travaux sont de qualité et ont de la valeur ajoutée.

- Le CDPC se réunit en séance plénière une fois par an, ce qui constitue un minimum. Cette échéance est préparée par
des réunions régulières du bureau (4 ou 5 par an), ce qui paraît constituer une méthode efficace. La qualité des
documents préparés par le secrétariat facilite les travaux du comité.

pertinence des travaux du comité (par exemple en matière de sujets abordés, ampleur de l’ordre du

Les choix budgétaires du Conseil de l'Europe, associés parfois à la volonté de faire aboutir trop vite certains travaux,
conduisent à diminuer la part consacrée aux discussions intergouvernementales et à multiplier les travaux au sein de
comités restreints, auxquels ne participent que certains Etats. Cette méthode ne permet parfois pas toujours d'assurer un
consensus suffisant, ce qui entraîne une réouverture des discussions au niveau du comité directeur. Il convient de
consacrer le temps nécessaire aux discussions intergouvernementales.


7. Quels sont, à votre avis, les sujets prioritaires que ce comité devrait examiner ?
