RE:    SOUTH AUSTRALIAN NEW STUDENT REPORTS

I wish to advise that today 13 November 2006 an application was lodged in the Industrial
Relations Commission of South Australia [IRCSA] at the request of DECS seeking the
lifting of industrial bans imposed by the Australian Education Union [AEU] on the
implementation of the South Australian New Student Reports.

The current position on arrangements for reports for students in South Australian public
schools was arrived at after extensive consultation with the Australian Government and
local stakeholders. The AEU was a major voice in these discussions.

The Minister for Education and Children’s Services was able to gain several positive
amendments which reflected stakeholder views, to the original position held by the
Australian Government, but as with other States and Territories not all viewpoints were
accommodated.

Regrettably, a shared position to work within the requirements of the Australian
Government legislation was unable to be reached with the AEU.

The implementation requirements for South Australian new Student Reports were
described in a circular to all staff dated 24 August 2006, from Jan Andrews, then Acting
Chief Executive. A copy of this information is available on the DECS website through
http://www.decs.sa.gov.au/mediacentre/files/links/Circ_06_025_Student_Report.pdf. A
key element of the implementation is compliance with the new requirements by all
schools in Term 4, 2006.

While the majority of schools are in a position to implement the requirements as set out
in the August 2006 circular, delays caused by the current industrial ban have the
potential to adversely affect full implementation of the new Student Reports across the
State. This has the potential to jeopardise Federal funding for education to South
Australian public schools.

It is anticipated that this matter will have an early outcome in the IRCSA, as has been the
case in other States. As soon as the ruling becomes available this decision will be
communicated to all staff.

I take this opportunity to thank the many DECS staff and members of school
communities who are already well underway in implementing the new Student Reports.
