C arol W ilk e called th e m eetin g to order at 5:07 p.m . G ood aftern oon, before w e begin h earing petition s
ton igh t, I w ou ld lik e to give a brief overview of the role of the ZBA an d m ak e a sh ort an n ou n cem en t. T h e
Zon in g Board of A ppeals receives com plete con cise testim on y from both petition ers an d objectors,
deliberates an d provides a recom m en dation th at is based on facts an d eviden ce to th e C oun ty Board on 3
ty pes of petition s. T hese petition s in clu de m ap am en dm en ts, special u se perm its and variation s. A m ap
am en dm en t ch anges the zon in g classification of a piece of property , for exam ple, from A gricu ltural Priority
D istrict to R u ral A gricu ltural D istrict. Each zon in g classification h as a list of perm itted uses an d special u ses.
Special uses m u st be applied for th rough a special use perm it, becau se of its poten tial in flu en ce upon
n eigh borin g uses; a special use perm it is regu lated w ith respect to location or operation for th e protection of
th e com m u n ity . A variation , w h ich in clu des alteration s to setback requ irem en ts, is sou gh t w h en th ere is a
particu lar difficu lty in follow in g th e strict letter of th e regu lation an d is in ten ded to alleviate som e
dem on strable h ardsh ip or difficu lty . T h e zon in g ordinance in clu des stan dards, w h ich m u st be m et for both a
special use perm it an d a variation . It’s very im portan t th at both th e petition er an d th e objector’s testim on y
in clu de eviden ce an d facts, w h ich address each stan dard. T h ese stan dards are th e gu idelin es th at m u st be
con sidered w h en th e ZBA deliberates a special use perm it or variation . A n y docu m en ts or ph otograph s
su bm itted to th e ZBA w ill becom e part of the record an d w ill be placed in the petition er’s file, w h ich is
m aintain ed by the zon in g office. A s earlier stated, ou r decision is a recom m en dation to th e C ou n ty Board. A
favorable recom m en dation is approved w h en at least 4 ZBA m em bers cast a favorable vote to approve. A fter
each petition er m ak es h is or h er presen tation an y objectors to th at petition w ill be allow ed to m ak e their
presen tation . T h e petition er w ill be given the opportun ity to m ak e a rebu ttal. It is im portan t for both
petition ers and objectors to un derstan d th at th is h earin g is th eir on ly opportu n ity to provide evidence and
testim on y for the record. O n ce all of the eviden ce an d facts h ave been brou gh t forth , the ZBA m oves to
deliberation . D u rin g deliberation the testim on y period is closed. T h e Zon in g C om m ittee of the C ou n ty
Board w ill con sider petition s h eard ton igh t by th e ZBA and acted upon on W edn esday , Ju n e 21, 2006 at 5.30
pm in R oom 501 of the C ou n ty A dm in istration Bu ilding. T h e Zon in g C om m ittee is a pu blic m eetin g. T h e
recom m en dation s of the Zon in g Board of A ppeals an d th e Zon in g C om m ittee then go to the fu ll C ou n ty

requ estin g for th e property . A s y ou are aw are, w e’re appearin g before y ou requ estin g tw o an d h alf (2 ½) acres
of th is property , ph y sically , tw o and h alf acres of th e SW corn er of th e property is cu rren tly zon ed as
agricultu ral priority district to be rezon ed for ru ral agricultu ral district. A s y ou are also aw are, w e appeared
before y ou requ estin g a zon in g am en dm en t for th e en tire eleven poin t five-five (11.55) acres of th e sam e
property in M arch of th is y ear. I y ou w ill recall from ou r prior appearan ce, th e pu rpose of th is requ est is th at
w e w ish to con stru ct tw o (2) single-fam ily residen ces. O n e to be ow n ed by Kim an d h er h u sban d, Jeffrey ,
and th e oth er to be ow n ed by m y self an d m y h u sban d Dou glas. T h e property , if left zon ed agricu ltural,
w ou ld on ly allow th e con stru ction of on e (1) sin gle-fam ily residence. It sh ou ld be n oted at th is poin t, th at at
th e previou s m eetin g, the fact that I h ad a bu ildable righ t for even on e (1) residen ce w as brou gh t into
qu estion . Sin ce th at tim e, I h ave con firm ed th at I do h ave th at on e (1) bu ildable righ t for th e property , an d --
--docu m en tation IN A U D IBL E . Prior to ou r in itial appearan ce, w e w ere presen ted 6 poin ts in ou r zon in g
application m aterials th at w ou ld be for a presen tation per requ est. So th e goal, w h en w e are don e, I’ll tou ch
on briefly on those 6 poin ts, that n oth in g h as really ch anged regardin g them from m y first appearan ce.
Sim ply stated, the approved zon in g am en dm en t w ou ld on ly allow for th e con stru ction of on e (1) addition al
residen ce, in addition to th e on e (1) residen ce allow ed un der the agricu ltural zon in g design ation . T h is
in dicated th at activity on th e property w ould be m in im al, an d the only operation of th e property w ould be
rem oval of trees th at im pair w ith con stru ction of th ose residen ces, or th e dem olition of th e dilapidated
bu ildin gs design ated as safety h azards. But every oth er aspect of th e property bein g preserved, an d n o
su rrou n din g properties bein g in fringed upon. T h erefore, w e do not an ticipate an y adverse affect on an y of
th e item s h igh ligh ted in the six (6) poin t — in ou r presen tation in ou r zon in g application . N am ely , the qu ality
of ligh t, air, safety from fire, value of lan d an d buildings on su rrou n ding properties, the con gestion of traffic
on pu blic roads, the pu blic’s h ealth , gen eral safety , com fort an d con ven ien ce m ore over gen eral w elfare, the
stability of th e residen tial, agricultu ral, bu sin ess, or indu strial areas, for th e orderly an d ben eficial developm en t
of the residen tial, agricu ltural, bu sin ess, or in dustrial areas su rrou n ding the property specifically for the cou n ty
in gen eral. A fter con siderin g ou r respon se to be six (6) poin ts, I thin k y ou h ave to — it to ou r presen tation .
Bu t w e respectfu lly requ est that y ou con sider a few oth er k ey issu es prior to m ak in g a decision on this m atter.
A ccordin g to th e N ation al R esou rce In form ation reports com piled by th e W in n ebago C ou n ty Zon e W ater
C on servation D istrict, th e property received a h igh LESA prim arily becau se: N u m ber on e, It w as design ated
agricu ltu ral by th e 2010 Lan d U se G u ide. A n d th is is gu ided by th e — residen tial uses perm itted on
properties w ith A G design ation . A n d n u m ber tw o, th e proposed ch an ge of th e property is n ot con sisten t
w ith th e agricultu ral zon in g or agricultu ral u se of th e m ain area. A n d th ree, th e properties h ave soils th at are
classified as prim e for agricultu ral u ses and it is for, probably , to protect an d preserve th e area con sidered,
prim e agricu ltural areas. W h ile w e h ave life-lon g residen ces of W in n ebago an d R ock ford, and w e appreciate
and respect the role of agricu lture in the com m u n ity , w e do n ot n ecessarily agree w ith the com pon en ts
con stitutin g the h igh LESA score assign ed to th e property w h ich w e realize cou ld be a m ajor con tribu tin g
factor to an un favorable vote on th is petition . H ere are som e pictures. First, is th e ph otograph w e h ave
provided w ill dem on strate the property in qu estion is com pletely an d been free-w ooded; it is n ot tillable. T h e
land has n ot been farm ed in over fifty (50) y ears. A local, very w ell-respected farm er divided off an d sold th is

portion of w h at w as origin ally a forty (40) acre parcel, bu t because th is portion w as so w ooded, th at it w as
deem ed to difficu lt to effectively farm . So, in regards to th e soil assessm en t portion of the LESA score, w h ile
th e property m ay h ave prim e agricu ltural soil, it is n ot n ecessarily ideal in term s of agricu ltural u se in its
cu rren t state. C on sequen tly , in regards to th e con sisten cy w ith agricu ltu ral uses of su rrou n din g lan d portion
of th e LESA score, w e propose th at, becau se th is lan d bein g so w ooded in n atu re, is n ot as farm able as or
even sim ilar to th e lan d aroun d it. It sh ould n ot be zon ed exactly as th e lan d is aroun d it, an d perm ission
sh ou ld be gran ted for it to be utilized som ew h at differen tly th an th e su rrou n din g lan d. Fu rth erm ore, it h as
n ever been ou r in ten t, n or w ill it ever be farm ed again , so even if th e zon in g ch an ge is n ot approved, th is lan d
w ill n ot be farm ed or, in effect, preserved for farm use. T ak in g all of these poin ts into con sideration , w e
w ant to assu re y ou that w e do fu lly un derstan d th e im portance of the Land U se G u ide, an d bein g un der the
design ation . H ow ever, w e also h ope that from a practical stan dpoin t, w h at sim ply m ak es sen se for this lan d is
considered, an d th at th e contradiction of attem ptin g to tak e lan d th at is n ot farm able an d preserve it for farm
u se is recognized. Prior to con clu ding, I w ou ld lik e briefly address on e fin al poin t for con sideration . In the
staff report, w e received prior to ou r M arch appearan ce regardin g the property , a con cern w as raised th at w ith
m in im u m lot size of the R u ral A g of this district bein g tw o an d half (2 ½) acres. If the en tire eleven an d half
(11 ½) acres of a property w ere rezoned, as w e in itially requested, w e w ould h ave th e poten tial to create four
(4) bu ildable lots. A s the m in u tes from that first appearan ce w ill dem on strate, I assu re y ou that w e absolu tely
h ave n o in ten tion of con stru ctin g m ore th an tw o (2) residences on th e property , an d th at m y h u sban d and I
do n ot w ant an y on e oth er than the V ettore’s bu ilding on it, and that ou r allow in g them to bu ild on it w ou ld
be sort of a good w ill gestu re exten ded to a special part of ou r fam ily . Because w e realizes after th at in itial
m eetin g, th at th ere w as such a concern regardin g th e poten tial to create m ore buildable lots if th e en tire
property w as rezon ed, w h ich is so far from ou r in ten t, w e w ith drew ou r in itial petition , an d refiled th is on e,
requ estin g on ly tw o an d half (2 ½) acres be rezon ed to R u ral A g in an effort to assu re the board that w e tru ly
do on ly in ten d on con stru ctin g on e (1) residen ce besides ou r ow n on th e property , an d th at oth er th an th ose
tw o (2) residen ces, it is of utm ost im portan ce to us to preserve th e lan d, an d w e IN A U D IBL E to th e area
u n disturbed. A gain, w e respectfu lly requ est that y ou do w h at seem s to be practical w h en it com es to th e
property , an d n ot restrict lan d th at is essen tially n on -farm able from an agricu ltu ral design ation . T h an k y ou

th eir veh icles an d cam pers, veh icles lik e qu ads, A T V s, or van s. I th in k golf carts are used. T h ere’s no
h u n tin g. It’s really for the peacefu l en joy m en t of the cam pers. A n d th en , w h ere I begin this presen tation .
