The Council contributes to dividing fences in accordance with the Fences Act 1968 where Council
is the “Owner or Occupier” of the land.
1. Council will only contribute towards the half cost of fencing works, where the fence abuts land
     owned by the Council and/or is clearly occupied by the Council.
2. Council will not contribute to fences where private property abuts a:-
     • Road Reserve (from property line to property line).
     • Walkways that Council considers are not “Council owned land”
     • Rights of Way
     • Other Authorities land e.g. Melbourne Water
3. Your request MUST be made to Council before the commencement of ANY works.
     Council will not consider contributions after works are commenced or completed.
4. Council will not pay for additional costs associated with the provision of any form of gate
     access. Note that you are required to gain separate permission from Council for the
     installation of a gate to access a Council reserve
5. Council can only pay on a Tax Invoice received from the Fencing contractor. No
     payment will be made if fence is paid in full by owner/occupier.

WHAT COUNCIL WILL CONSIDER
Council will consider paying towards the equivalent cost of erecting a 5’4” (1.63metre) high, paling
fence and other reasonable costs of removing an existing fence. Each case is assessed
individually.
Please Note:           It is the owner’s / occupier’s responsibility to :-
                       • Comply with any covenants, restrictions or caveats indicated on
                             property titles regarding fencing requirements.
                       • Clear the fence line of any obstructions including concrete paths.
                       • Ensure that they (or their contractor) obtain permission from Council’s
                             Parks and Gardens before entering onto Council reserves. A separate
                             application needs to be made to Council’s Parks and Gardens
                             Department before works commence.
                       • Seek other approvals. For example, applicable building permits,
                             permission from Council to erect a High Corner Fence, etc.

WHAT COUNCIL REQUIRES FROM YOU
At least two (2) quotations from separate reputable fencing contractors before
commencement of ANY works. Please note : Council will only deal with those contractors
with a registered ABN (Australian Business Number).

The quotes must clearly indicate:
• The location of the fence to be repaired/replaced/new.
• The height and type of fence (materials) required.
• The type of work to be undertaken eg. Repaired/replaced/new.
• The name of the contractor quoting the works.
• The price.
• ABN (Australian Business Number)
• The GST applicable (separately)

• Mailing the quotes to:

• Hand delivering your quotes to Council’s Customer Service Centres located at:
        Keilor Municipal Offices
        Harvester Site Branch Library

Upon receipt of the quotes by Brimbank Engineering Services, your request will be assessed,
including a site visit and you will be advised further in writing, generally within five (5) working
days.
