Instructions




          Use this form if you want to end the tenancy because the tenant
          has not paid rent and the tenant is still living in the rental unit.

          It is your responsibility to make sure that your notice complies
          with the requirements of the Tenant Protection Act. You can
          obtain this form at the Ontario Rental Housing Tribunal office in
          your area or from the Tribunal’s website at www.orht.gov.on.ca.

About this notice...

              Use this form to terminate the tenancy if the tenant owes rent and is still living in
              the rental unit.

              There are many ways that you can give this notice to the tenant. You can:

              •     hand it directly to the tenant or to an adult in the rental unit,

              •     leave it in the tenant's mailbox or where mail is ordinarily delivered,

              •     place it under the door of the rental unit or through a mail slot in the door,

              •	 send it by fax to a fax machine where the tenant carries on business or to a fax
                 machine in their residence,

              •	 send it by courier to the tenant (if you courier it, you must allow one business
                 day for delivery),

              •     send it by mail (if you mail it, you must allow five calendar days for delivery).

              You cannot give the tenant this notice by posting it on the door of the tenant’s
              rental unit.

              Keep a copy of this notice for your records.

              If the tenant does not move out or pay the rent owing by the date that you put in
              this notice, you can apply to the Ontario Rental Housing Tribunal for an order
              terminating the tenancy and evicting the tenant and/or for payment of the rent
              owing.



How to complete this form...

To:	              Fill in the tenant's name and complete address. If there is more than one tenant
                  living in the rental unit, fill in the names of all of the tenants.


From:	            Fill in the landlord’s name and address. If there is more than one landlord, fill in
                  the names of all the landlords.

Address of        Fill in the address and unit number of the rental unit covered by this notice.
Rental Unit:

Termination	      Fill in the termination date. If the tenancy is a daily or weekly tenancy, the date
Date:             on this line must be at least seven calendar days after the date you give the tenant
                  this notice.

                  For any other type of tenancy, such as monthly, the date on this line must be at
                  least 14 calendar days after the date you give the tenant this notice. When you
                  are counting the days for the notice, do not count the day that you are giving this
                  notice.

                  Example:
                     Theresa Able, the landlord, has a monthly tenancy agreement with Bill
                     Freeman. If Theresa hands this notice directly to Bill on January 10th, she
                     would complete this line as follows:

                         “You must move out of the rental unit identified above on or before
                         January 24, 2001...”

                     If Theresa mails this notice to Bill on January 10th, she would have to add an
                     additional five calendar days for mailing. She would complete the line as
                     follows:

                         “You must move out of the rental unit identified above on or before
                         January 29, 2001...”


                  On the form, include the total amount of rent the tenant owes. The tenant will
                  not have to move out if the tenant pays all the rent that is due on or before the
                  termination date.


Reason for        Complete the table to show how you calculated the amount of rent the tenant
this Notice...	   owes. The example on the next page shows how to complete this table. If the
                  table does not have enough rows to show your calculations, attach an additional
                  sheet that shows your complete calculations.

Example:

    Jack Smythe, the landlord, and Ellen Olsen, the tenant, have a monthly tenancy agreement.
    Ellen pays $650.00 in rent each month. On January 1st, Ellen only paid $300.00, and she
    did not pay any rent on February 1st. If Jack gave Ellen this notice on February 3rd, he
    would fill in that Ellen must pay $1000.

Signature	       If you are the landlord, check the box marked “landlord” and sign your name.
                 Print your name above your signature. Include your telephone number and the
                 date you are signing this notice. If you are an officer signing for a corporation,
                 also print your title.

                 If you are the landlord’s agent, check the box marked “agent” and sign your
                 name and include the date you are signing this notice. In the space marked
                 “Agent Information”, fill in your name, company name, mailing address,
                 telephone number and a fax number if you have one.
