     Impact, risks and opportunities
                                                                                                       HALF DAY CLINIC

    Ai Group is offering a half day modern awards clinic to assist companies in the
    Building, Engineering and Civil Construction Industries to prepare for the implementation
    of modern awards and the National Employment Standards (NES) from 1 January 2010.
    Start your preparations early to assess the potential impact and determine the best
    strategy for your business.

Do you know the answers to the following questions?
n Will modern awards apply in your workplace from 1 January 2010? They won’t in every workplace.
n If modern awards will apply in your workplace – what do you estimate the cost of implementation will be?
n What are the differences between the National Building and Construction Industry Award 2000, National Metal and Engineering
    On-Site Construction Industry Award 2002, Australian Workers’ Union Construction and Maintenance Award 2002, and the
    consolidated modern Building, Engineering and Civil Construction Industry General On-Site Award 2010?
n What are the differences between the Clerical and Administrative Employees Award (Clerical Award) and the modern Clerks
    Private Sector Award?
n Can your business defer the application of modern awards? How?
n What strategy is best for your business when it comes to modern awards, deferment or compliance?
n What steps need to be taken for each strategy?
n What provisions of modern awards must always be complied with?
n How will modern awards be varied and what transitional arrangements will apply?
n What are the differences between the NES and the Australian Fair Pay and Conditions Standard (AFPCS)?
n How will modern awards and the NES interact with existing workplace agreements?
n If you are negotiating a workplace agreement now, what do you need to consider in relation to the underpinning award?
n Should your business utilise the new modern award flexibility provisions?

This half day clinic will answer these and many more questions which are no doubt occupying your mind as time
ticks inevitably to the 1 January 2010 implementation date.

Session One – Understanding Modern Awards
This session will briefly explain the:
n  development of modern awards
n implementation and variation of modern awards
n  coverage of modern awards
n transitional issues DATE & vENUE
n  modern award flexibility provisions.
                                                                                                 1 July 2009
Session Two – Helping you assess the impact of modern Australian Industry Group
awards and the NES in your workplace 20 Queens Road
This practical and interactive session will highlight the differences between the: Melbourne VIC 3004
n Existing building, engineering and civil construction awards and the modern Building,
                                                                                                 Registration: 8.30 – 9.00 am
   Engineering and Civil Construction Industry General On-Site Award 2010;
n Existing Clerical Award and the modern Clerks Private Sector Award; and Clinic: 9.00 am – 12.00 noon
n  AFPCS and the NES
This session will set you on your way in determining the necessary steps to comply with new modern awards as well as assess the
cost impact of implementing modern awards. This cost assessment, which should include differing award entitlements as well as the
administrative burden of implementation, will be critical to determining whether the best strategy for your business is deferment of, or
compliance with, modern awards.

Session Three – Understanding the interaction between modern awards and enterprise bargaining
This session will explore the opportunity for employers to defer the application of modern awards by making an enterprise
agreement to apply to employees, who would otherwise be covered by a modern award from 1 January, 2010. It will also explain
why timing is everything in the making of enterprise agreements due to the recent passage of the Fair Work Act 2009. Employers
should bargain early for best outcomes.

Specifically this session will cover the pros and cons of:
n extending/varying a pre-reform WorkChoices agreement (ie lodged before 27 March 2006);
n making an enterprise agreement before 1 July, 2009;
n making an enterprise agreement between 1 July and 31 December 2009; and
n making an enterprise agreement from 1 January, 2010.

So whether your award employees are currently covered by an enterprise agreement or not, this modern awards clinic
will help you make the best strategic decision for your business. This may be preparing for implementation of modern
awards or bargaining to defer their operation.
