Re: Land Leases

There are four parcels of land in Goodhue County we have leased annually from April 1
through March 31. Three are in Stanton Township and one in Warsaw Township.
Proceeds from the leases will continue to go into the Park Account as they have in the
past. In addition the Lessee will pay personal property taxes for 2011- 2013.

Previously we had leases that were either one or five years. We are recommending the
first three leases below be for a three year period with payments due April 1 of 2010,
2011 and 2012. The final lease is for one year only with payment due April 1,2010.

RECOMMENDATION

We recommend the Board accept the lease amounts with Mr. Ravola, Mr. Pederson, and
Maring Brothers for the years 2010 through 2012 and Mr. Ohmann for the year 2010 with
the lease proceeds deposited in the Park account. Personal Property taxes for the parcels
will be paid by the lessees as well. Draft copies of the leases are attached.
                                           AGREEMENT
      This Agreement made this 2nd day of March, 2010, between the County of Goodhue, hereinafter
named Goodhue, lessor herein, and Norman Ohmann, here in after named, lessee herein,

       A.     Lessor is the owner of real property in Section 9, Stanton Township Goodhue County,
              Minnesota, and said property available for lease.
       B.     Lessee desires to lease said property.
       C.     In Consideration of the mutual confinements contained herein, the parties agree:
              1.     Lessor shall lease to lessee property owned by lessor, approximately 2.6 acres of
                     land in Section 9 Stanton Township, Goodhue County, Minnesota, identified as
                     parcel 41.999.0902.
              2.     The premises shall be leased to lessee from April 1, 2010 through March 31, 2011.
              3.     The lessee shall pay to lessor $55/acre (2.6 acres X $55.00=$143.00) rental for the
                     term of this lease, said payment due upon execution of the lease.(4-1-2010)
              4.     The lessee shall pay taxes due and payable on such real estate in 2011.
              5.     Lessee assumes all risk of loss or damage from any cause or claim occasioned by
                     use of such leased property by Lessee or by a third party. Further, Lessee agrees to
                     indemnify and hold harmless Lessor for any damage or loss, including attorney’s
                     fees, Lessor may suffer from the use of such property by Lessee or by a third party
                     for and during the full term of this lease.

                              LEASE AGREEMENT

THIS AGREEMENT, made this 2nd day of March, 2010, by and between the County of
Goodhue, a body of politic and corporate, herein referred to as lessor, and David Pederson,
Stanton Township, Goodhue County, Minnesota, herein referred to as lessee.
Subject to the terms and conditions hereafter expressed, lessor hereby leases to lessee and
lessee hereby hires from lessor real property described herein. Said real property hereafter
referred to as property.
WITNESSETH, that the said lessor, in consideration of the rents and covenants
hereinafter mentioned, does hereby Remise, Lease and Let unto the said lessee, and the
said lessee does hereby hire and take from the said lessor, the following described premises
situated in the County of Goodhue and State of Minnesota viz:
          That part of the SW ¼ of the NE ¼ lying Nly and Wly of the Cannon
          River, being in Section 16, Township 112, Range 18 (Stanton
          Township) being approximately 10 acres more or less as outlined on
          attached sketch “A” which is incorporated in and made a part of this
          agreement. (P 41-999-1610)
TERMS OF LEASE
The terms of this lease shall be for a period of 3 years beginning April 1, 2010 and ending
March 31, 2013, with a renewal option to be considered on the anniversary date of the
lease with either party being able to cancel by written notice 30 days prior to the
anniversary date.
In consideration for leasing of said property, lessee agrees to pay to lessor, as rent for the
property that total sum of $50.00 per year for personal property parcel P41.999.1610, with
the option for renegotiations on the renewal date of the lease. Said sum to be due and
payable in full upon commencing of each year of this lease. Also the lessee agrees to pay
the personal property tax due on said parcel of land each year, as determined by the
Auditor/Treasurer.


USE OF PROPERTY
Lessee may use such leased property, designated parcel #41.999.1610, as pastureland, for
grazing and control of not to exceed three (3) horses. For such purposes lessee may fence
such property and may exclude the general public therefrom. Lessee also has approval to
place a pop-up type camper on the property.


MAINTENANCE
Lessee, at his own expense, shall keep the property clean and neat, and shall see that the
property is not subject to careless or rough usage.

LESSOR’S RIGHT OF INSPECTION
Lessor shall at all times have the right to enter upon the property for purposes of use,
inspection, or observation of its use and for passing over said premises to access other
adjacent lands.
RISK OF LOSS OR DAMAGE
Lessee assumes all risk of loss or damage from any cause or claim occasioned by use of
such leased property by lessee or by a third party. Further, lessee agrees to indemnify and
hold harmless lessor for any damage or loss, including attorney’s fees, lessor may suffer
from the use of such property by lessee or by a third party for and during the full term of
this lease.
And it is further agreed by and between the parties as follows: That should the said lessee
fail to make the above mentioned payments as herein specified, or to pay the rent aforesaid
when due, or fail to fulfill any of the covenants herein contained, then and in that case it
shall be lawful for the said lessor to re-enter and take possession of the above rented
premises, and hold and enjoy the same without such re-entering working a forfeiture of the
rents to be paid and the covenants to be performed by the said lessee for the full term of
this lease.
And the said Lessee also covenants and agrees to and with the said lessor not to assign this
lease, to underlet the above rented premises or any part thereof, with out first obtaining the
written consent of the said Lessor, and that said Lessee will, at the expiration of the time as
herein recited, quietly yield and surrender the aforesaid premises to the said Lessor, heirs
and assigns, in as good condition and repair as when Lessee took them, reasonable wear
and tear and damage by the elements alone expected.
And the said Lessor does covenant that the said Lessee, on paying the rent and performing
the covenants aforesaid, shall and may peaceably and quietly have, hold and enjoy the said
remised premises for the term aforesaid.

                                           AGREEMENT
      This Agreement made this 2nd day of March, 2010, between the County of Goodhue, hereinafter
named Goodhue, lessor herein, and Arne P. Rauvola, here in after named, lessee herein,

       A.     Lessor is the owner of real property in Section 16, Stanton Township Goodhue County,
              Minnesota, and said property available for lease.
       B.     Lessee desires to lease said property.
       C.     In Consideration of the mutual confinements contained herein, the parties agree:
              1.     Lessor shall lease to lessee property owned by lessor, approximately 37.83 acres of
                     land in section 16 Stanton Township, Goodhue County, Minnesota, identified as
                     parcel 41.999.1619.
              2.     The premises shall be leased to lessee from April 1, 2010 through March 31, 2013.
              3.     The lessee shall pay to lessor $60/acre (37.83 X $60=$2269.80) rental annually,
                     first is payment due upon execution of the lease.(4-1-2010)
              4.     The lessee shall pay taxes due and payable on such real estate in 2011 through
                     2013.
              5.     Lessee assumes all risk of loss or damage from any cause or claim occasioned by
                     use of such leased property by Lessee or by a third party. Further, Lessee agrees to
                     indemnify and hold harmless Lessor for any damage or loss, including attorney’s
                     fees, Lessor may suffer from the use of such property by Lessee or by a third party
                     for and during the full term of this lease.
              6.     The existing access road to and across the property has a washed out culvert: lessor
                     makes no warranties or promises about the condition of such road.

named, lessee herein,

       A.     Lessor is the owner of real property in Section 24, Warsaw Township,
              Goodhue County, Minnesota, and said property available for lease.
       B.     Lessee desires to lease said property.
       C.     In Consideration of the mutual confinements contained herein, the parties
              agree.
              1.     Lessor shall lease to lessee property owned to lessor,
                     approximately 6.89 acres of land in Section 24 of Warsaw
                     Township, Goodhue County, Minnesota, identified as parcel
                     45.999.2428.
              2.     The premises shall be leased to lessee from April 1, 2010 through
                     March 31, 2013.
              3.     The lessee shall pay to lessor $432.00 annual rent, said first
                     payment due upon execution of the lease (4-1-10).
              4.     The lessee shall pay personal property taxes due and payable on
                     such real estate in 2011 thru 2013.
              5.     Lessee assumes all risk of loss or damage from any cause or claim
                     occasioned by use of such leased property by Lessee or by a third
                     party. Further, Lessee agrees to indemnify and hold harmless
                     Lessor for any damage or loss, including attorney’s fees, Lessor
                     may suffer from the use of such property by Lessee or by a third
                     party for and during the full term of this lease.
