The Bureau of the CDCJ:

1. held its 86th meeting (Strasbourg, 19-20 January 2010), which was chaired by Mr Seamus CARROLL
   (Ireland), and opened by Mr Jan KLEIJSSEN, Director of Standard-Setting, Directorate General of Human
   Rights and Legal Affairs (DG-HL);

Relations with the Committee of Ministers

2. took note of the decisions taken by the Committee of Ministers since its last Plenary meeting
   (6-9 October 2009) which are of direct concern for the CDCJ (see Document CDCJ (2010) 2);

3. took note of the compilation and the synthesis of replies received from the CDCJ delegations
   concerning the functioning of the CDCJ, which has been sent to the Secretariat of the Committee of
   Ministers;

4. took note of Recommendation 272 (2009) of the Congress of Local and Regional Authorities of the
   Council of Europe on “Preventing violence against children” and decided to forward it to the CDCJ
   delegations as well as to the Group of Specialists on child-friendly justice for information;

Family law

5. took note of the forthcoming meetings1 of the Working Group of the Committee of experts on family
   law on the legal status of children (CJ-FA-GT) for 2010;

6. welcomed the Conclusions of the joint Council of Europe and European Commission Conference on
   “Challenges in adoption procedures in Europe (Strasbourg, 30 November - 1 December 2009);

Discrimination on grounds of sexual orientation or gender identity

7. noted that the reply of the CDCJ to the Committee of Ministers on discrimination on grounds of sexual
   orientation or gender identity was sent to the Committee of Ministers (Appendix X to Document
   CDCJ (2009) 31) and taken note of by the Ministers’ Deputies at their 1073rd meeting on 9 December
   2009;

8. noted that “with 20 votes in favour, 1 vote against and 11 abstentions, the Steering Committee for
   Human Rights (CDDH) adopted the draft Recommendation on measures to combat discrimination
   based on sexual orientation or gender identity and decided to transmit the text to the Committee of
   Ministers for final adoption”2, and that its examination by the Rapporteur Group on Human Rights
   (GR-H) and by the Ministers’ Deputies are scheduled respectively for 2 February and 24 February 2010;

9. agreed to await the adoption of the above-mentioned recommendation by the Committee of Ministers
   before starting its reflection on possible future activities of the CDCJ in the field of combating
   discrimination on grounds of sexual orientation or gender identity;

Independence of the judiciary

10. took note of the work of the Group of Specialists on the Judiciary (CJ-S-JUD) and congratulated the
    Group;

11. examined and welcomed the draft Recommendation on judges: independence, efficiency and
    responsibilities and its draft explanatory memorandum, instructed the Secretariat to revise them so as
    to take due account of the comments of the Bureau and to transmit them
    (document CDCJ-BU (2010) 2) to the CDCJ delegations for possible comments by 16 April 2010;

Child-friendly justice

12. took note of the work of the Group of Specialists on Child-friendly justice (CJ-S-CH), in particular the
    draft Conclusions of the Hearing with International NGOs and other Stakeholders (Strasbourg,
    7 December 2009);

13. instructed the Secretariat to:
    - send, immediately after the Bureau meeting, the 4th Draft of the Council of Europe guidelines on
      child-friendly justice (Document CJ-S-CH (2010) 3) to the CDCJ delegations as well as to focal points
      on children’s rights and violence against children3 for possible concerted comments coordinated
      between the competent national agencies, to be returned to the Secretariat by 31 March 2010;
    - publish the afore-mentioned document on the CJ-S-CH’s website for public consultation;
    - activate the consultation of children on child-friendly justice with a view to taking their views into
      account in the drafting process of the Council of Europe guidelines;

Access to justice for migrants and asylum seekers

14. took note of the ongoing discussions on the draft Terms of Reference of the Group of Specialists on
    access to justice for migrants and asylum seekers in the Rapporteur Group on Legal Co-operation (GR-J,
    meetings of 19 November 2009 and 14 January 2010); whereby a risk of duplication with the European
    Union work was raised;

Administrative Law

15. held an exchange of views with Mr Erik WENNERSTRÖM (Principal Legal Adviser, International Law and
    Human Rights Department, Ministry for Foreign Affairs of Sweden), and welcomed his proposals made
    in the fields of rule of law and administrative law as a follow-up to “Resolution No. 3 on Council of
    Europe action to promote the rule of law” adopted at the 29th Council of Europe Conference of
    Ministers of Justice (Tromsø, June 2009);

16. instructed the Secretariat to prepare a feasibility study in the area of privatisation of public services
    (with a focus on state delegation of security controls), and a report evaluating the implementation of
    Recommendation CM/Rec(2007)7 on good administration, as regards civil registration;

17. took note of the budgetary constraints which prevented further progress in 2009 on the revision of the
    Handbook “The administration and you” and of the planned steps to be taken to ensure this revision;

18. instructed the Secretariat to continue seeking an expert to examine the European Convention on the
    Service Abroad of Documents relating to Administrative Matters (ETS No. 94) and the European
    Convention on the Obtaining Abroad of Information and Evidence in Administrative Matters
    (ETS No. 100);

The role of Prosecutors outside the Criminal Law Field

19. welcomed the exchange of views with Mr Olivier de BAYNAST, Chair of the Consultative Council of
    European Prosecutors (CCPE), on its Opinion n°3 on the role of the public prosecution services outside
    the criminal field and agreed to take advantage of the available expertise of the CCPE where needed;

20. instructed the Secretariat to prepare a report assembling relevant material, including the related case
    law of the European Court of Human Rights, which it will examine at the next Bureau meeting with a
    view to submitting a report and facilitating the review of this issue at the next CDCJ plenary meeting;

Medical liability

21. confirmed the choice of Ms Ksenija TURKOVIC as the consultant to carry out a feasibility study
    concerning the drafting of a guide on alternative dispute resolution in the medical liability field by April
    2010, recalling the importance of tackling civil aspects of the topic and of building on the work carried
    out by the CDCJ in the past;

22. proposed that a representative of the CDCJ participate in the World Congress on Medical Law
    (Zagreb, 8-12 August 2010);

Debt problems

23. took note of the publication on the website of the CDCJ4 of the replies received from the CDCJ
    delegations concerning the implementation of Recommendation CM/Rec(2007)8 on legal solutions on
    debt problems, and agreed to have it preceded by an analytical foreword and synthesis of these
    replies;

24. considered that, in the context of the current global economic crisis, the preparation of a European
    model code of conduct for lending institutions was at this stage premature;

Data protection

25. welcomed the exchange of views with Mr João CABRAL, Chair of the Consultative Committee of the
    Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data
    (T-PD) concerning the draft Recommendation on the protection of individuals with regard to automatic
    processing of personal data in the framework of profiling and took note of the ongoing preparation of
    its Explanatory Memorandum;

26. referred to and had general discussions on the compilation of replies received from the CDCJ
    delegations on the draft Recommendation (Document CDCJ (2010) 7 Mos) which will be transmitted to
    the TP-D, for consideration during its forthcoming Bureau and Plenary meetings (Strasbourg, 2-4 March
    and 13-15 April 2010 (Bureau meetings), 1-3 June 2010 (Plenary meeting));

27. looked forward to receiving a revised draft of the Recommendation by its next meeting, which will be
    circulated for further comments to the CDCJ delegations in view of its submission to the CDCJ for
    approval at the 85th Plenary meeting (11-14 October 2010);

28. took note of the preparation of the 30th anniversary of the Convention for the Protection of Individuals
    with regard to Automatic Processing of Personal Data (ETS No. 108), to be celebrated in 2011;

29. instructed the Secretariat to prepare, for its next Bureau meeting, a paper on possible future priorities
    in the field of data protection and the challenges ahead in the legal void on internet;

Non-Governmental Organisations (NGOs)

30. took note of the Compilation of replies received from the CDCJ delegations on the questionnaire on the
    evaluation of the implementation of Recommendation CM/Rec(2007)14 on the legal status of
    non-governmental organisations in Europe, and agreed to finalise its reply to the Committee of
    Ministers at its next meeting;

Legal instruments

31. took note of the Memorandum on targeted conventions (intellectual property and patent, liability)
    (Document CDCJ (2010) 8) and decided to carry out a similar exercise on conventions in the commercial
    and financial law field;

32. underlined that the restricted composition of the Bureaux of the steering committees preparing the
    Council of Europe Conferences of Ministers of Justice should be reconsidered;

33. agreed, as a follow-up to Resolution No. 3, to pursue work in the field of administrative law as
    described in paragraphs 15-17 of the present report;

30th Council of Europe Conference of Ministers of Justice, 2010, Istanbul, Turkey

34. took note of the dates of the Conference: 25-26 November 2010, and instructed the Secretariat to
    inform the CDCJ delegations of those dates at its earliest convenience, noting that meetings of senior
    officials as well as of the respective Bureaux of the Steering Committees will be held on 24 November
    2010.

35. welcomed the topic proposed by the Turkish authorities: “Improvement of justice through information
    technologies” and, given the short deadline, looked forward to receiving at its earliest convenience a
    preliminary draft of the report of the Turkish Minister of Justice with a view to beginning reflection on
    this topic;

4th Council of Europe Conference on Nationality

36. took note of the ongoing preparation of the 4th Council of Europe Conference on Nationality to be held
    this year, and recalled the leading role of the Council of Europe in the field of nationality, underlining
    the importance to keep the momentum on this work going;

Opinions

37. took note of the following recommendations of the Parliamentary Assembly of the Council of Europe:
    1889 (2009) on “Improving the quality and consistency of asylum decisions in the Council of Europe
    member states”, 1890 (2009) on “Engaging European diasporas: the need for governmental and
    intergovernmental responses” and 1891 (2009) on “Migrant women: at particular risk from domestic
    violence”;

38. instructed the Secretariat to prepare a common draft Opinion in line with the indications given by the
    members of the Bureau during the present meeting with a view to transmitting it to the Secretariat of
    the Committee of Ministers within the set deadlines (15 March 2010);

Work of other Council of Europe bodies

39. took note of the reports of Mr Eberhard DESCH on the work of the European Commission for the
    efficiency of justice (CEPEJ), the Consultative Council of European Judges (CCJE) and the Consultative
    Council of European Prosecutors (CCPE);

40. took note of the report of Mrs Nicole COCHET, Vice-Chair of the Bureau, on the work of the Ad hoc
    Committee on preventing and combating violence against women and domestic violence (CAHVIO) and
    provided guidance with a view to the preparation of draft observations of the CDCJ on the draft text
    submitted by the CAHVIO, underlining in particular the need for clarification of the competence of the
    European Union in this regard;

41.   took note of the work of the Council of Europe ad hoc Committee for the Revision of the Convention on
      Mutual Administrative Assistance in Tax Matters (CAHTAX), of the Committee of Experts on Terrorism
      (CODEXTER) and of the Steering Committee on Bioethics (CDBI) as presented by their respective
      Secretariat representatives;

Co-operation with the European Union

42. took note of the important developments brought to its attention by Mr Kleijssen and:
    - welcomed the adoption of the Stockholm programme, which contains many references to the
      Council of Europe;
    - underlined the challenges ahead following the entry into force of the Lisbon Treaty;

Appointment of the representatives of the CDCJ to other Council of Europe bodies

43. agreed to send a letter to all representatives recalling the importance of their effective and regular
    participation in meetings and of the subsequent submission of their meeting reports;

44. took note of the dates of the meetings of other Council of Europe bodies scheduled for 2010
    (document CDCJ (2010) 6);

Other business

45. agreed to examine carefully at its next meeting the Declaration on "Making gender equality a reality"
    adopted by the Committee of Ministers at its 119th Session (Madrid, 12 May 2009);

Calendar of future meetings

46. agreed on the dates proposed for the next Bureau meeting on 15-17 June 2010, and for a four-day
    Plenary meeting of the CDCJ, on 11-14 October 2010.
