Code Officials Brochure Developed
A Code Officials Brochure has been developed through successful partnering between the Kansas State Board of Technical Professions and the State Fire Marshal in conjunction with AIA Kansas, the Kansas Society of Professional Engineers, and the American Council of Engineering Companies of Kansas. This document is being distributed within the industry. The brochure is intended to inform code officials, design and construction professionals, and the general public of present statutes and rules and regulations. This is not a move to establish a statewide building code. This brochure will be a tool for the Kansas State Board of Technical Professions, the State Fire Marshal and code officials to carry out their responsibility to protect the public. IN THE MATTER OF ILC OF TOPEKA AND LAWRENCE, LLC Summary: The Kansas State Board of Technical Professions received a letter of inquiry concerning the land surveying practices of ILC of Topeka and Lawrence, LLC. Following receipt of that inquiry, the Complaint Committee of the Board directed that an investigation of ILC’s land surveying practices be conducted. Once the investigation was completed, the Complaint Committee of the Board reviewed the investigative report and directed that a formal complaint be filed against ILC of Topeka and Lawrence, LLC. The Complaint alleged that on 13 occasions ILC of Topeka and Lawrence, LLC had engaged in the practice of land surveying in the State of Kansas by performing certain mortgage title inspections and placing a licensed land surveyor’s seal on said inspections when said land surveyor had not been involved in the preparation of said mortgage title inspections, was not aware that his seal was being placed on said inspections, had not authorized the placement of his seal on said mortgage title inspections and had not completed a detailed review and evaluation of the documents or supervised the preparation of the documents upon which his seal was placed. The mortgage title inspections performed occurred between August 3, 2004 and September 17, 2004. Board Action: Following the panel hearing on October 23, 2006, the panel entered its initial order in which it found: 1. Respondent is a company that, among other things, performs mortgage title inspections (MTI) and that an MTI is a pictorial description of real property that includes the location of property lines, improvements, setback lines, means of access, easements, and encroachments on real property based on existing but unconfirmed evidence. 2. An MTI is performed by a licensed land surveyor or is conducted under his/her supervision with the MTI to be signed and dated by the surveyor with the signature and date placed across surveyor’s seal. 3. Respondent does not hold a certificate of authorization pursuant to the Kansas Statutes, which authorizes it to practice land surveying. 4. Respondent, through its employees, affixed the seal of a licensed land surveyor and used said surveyor’s stamp on the 13 MTIs that were the subject of the disciplinary complaint. 5. None of Respondent’s employees who performed the 13 MTIs in question were licensed to practice land surveying. 6. Some of the 13 MTIs in question deviated from the minimum standards for mortgage title inspections in the following regards: (1) level of certainty; (2) no certification denoting supervision by a licensed land surveyor; no original signature by a licensed land surveyor; and (3) encroachments not clearly noted. 7. It has been Respondent’s practice since 1989 to utilize unlicensed individuals to perform MTIs with little or no supervision by a licensed land surveyor and then to affix the seal and stamp signature of a licensed land surveyor.
8. The Board’s costs in investigating and prosecuting this matter include $3,718.50 for attorney fees and $2,965.16 in investigative costs for a total cost of $6,683.66. As a result of the findings outlined above, the panel determined that the Respondent, ILC of Topeka and Lawrence, LLC had clearly violated the prohibition of practicing land surveying without a license during the times identified in the complaint. In determining the amount of the fine to be imposed, the panel took into account the Respondent’s long standing practice of violating K.S.A. 74-7001 and the abdication of its responsibility to be the “lenders’ eyes” by ensuring sufficient oversight of mortgage title inspections by a licensed land surveyor. In addition to the Board’s costs, including attorney’s fees, which total $6,683.66, the panel directed that Respondent shall pay a fine in the amount of $40,000 for a total fine and costs in the amount of $46,683.66 within 30 days from the date of the certificate of service. Status: Since entry of the Initial Order, the 30 days in which the Respondent had to file an appeal of said Initial Order has expired and the Initial Order has now become a Final Order. To date, Respondent has not paid the fine and costs assessed and the Board has determined that it will take appropriate action to collect the fine and costs.
IN THE MATTER OF ROBERT G. BOLING, P.E., #6206 Summary:
In November 2005, the Kansas State Board of Technical Professions received a letter of inquiry concerning the engineering practices of Robert G. Boling, who is a licensed engineer in the State of Kansas. The inquiry related to Mr. Boling having sealed with his engineering seal a “Site Plumbing Plan” for a project in Haysville, Kansas. Said “Site Plumbing Plan,” which was sealed by Mr. Boling, had not been prepared by Mr. Boling, nor was it prepared under his direct supervision and control in violation of K.S.A. 74-7026.

Disciplinary Action/from page 3 entered into a Settlement Agreement and Consent Order, which included the following: 1. Robert G. Boling admitted that he signed and sealed the Site Plumbing Plan, which serves Lots 2 and 3 Peachwood 8th Addition, Haysville, Kansas, which plans were prepared by another individual who was not under Mr. Boling’s direct supervision and control as required by K.S.A. 74-7026(5). 2. Robert G. Boling shall immediately cease and desist from engaging in engineering practices, which do not conform with the Kansas Statutes and/or the Kansas Administrative Regulations. 3. Robert G. Boling shall pay a civil fine totaling $500.00 plus the Board’s expenses, attorney fees and investigative costs incurred in the investigation and prosecution of this matter in the amount of $870.40; for a total amount of $ 1,370.40; all of which were to be paid to the Kansas State Board of Technical Professions on or before February 1, 2007. Status: Robert G. Boling has fully complied with all of the terms and conditions of the Settlement Agreement and Consent Order in this matter and the case file has been closed.
Waterproofing, Inc. was practicing, offering to practice or holding itself out as authorized to practice engineering in the State of Kansas through its advertisements and yellow page ad. Board Action: Following the completion of an investigation of the circumstances which led to the inquiry, KC Waterproofing, Inc. and the Kansas State Board of Technical Professions entered into a Settlement Agreement and Consent Order, which included the following: 1. KC Waterproofing, Inc., agreed that it had held itself out as entitled to practice, had offered to practice, or had practiced in the State of Kansas the technical profession of engineering when it was not licensed to do so and did not hold a Certificate of Authorization authorizing it to practice engineering. 2. KC Waterproofing, Inc. will immediately cease and desist from holding itself out as authorized to practice, offering to practice or practicing engineering in the State of Kansas until such time as it is licensed to do so or has obtained a Certificate of Authorization authorizing it to do so. 3. KC Waterproofing, Inc. will pay the Board’s expenses in the amount of $250.00. Said costs are to be paid on or before December 1, 2006. Status: KC Waterproofing, Inc. has fully complied with all of the terms and conditions of the Settlement Agreement and Consent Order in this matter and the case file has been closed.
disciplinary action taken by the licensing Boards in those jurisdictions regarding Mr. McKinney’s engineering license in those states as well. As a result of the above, the Board filed a Complaint against Mr. McKinney on September 27, 2006 alleging the disciplinary action which had been taken against Mr. McKinney in the State of Kentucky. Said complaint asserted that the actions by the respondent for which he received discipline in the State of Kentucky also constitute violations of the provisions of the K.S.A. 74-7026(2)(4) and (5) and K.A.R. 66-6-4(d) and (f). A hearing on the allegations regarding Mr. McKinney and his Kansas license was held on October 24, 2006. Although notified of the hearing, Mr. McKinney failed to appear for the hearing. Board Action: Following the hearing on October 24, 2006, the presiding officer issued a Notice of Proposed Default Order. Mr. McKinney did not file a motion to vacate. As a Motion to Vacate the Proposed Default Order was not filed within the seven day time period set forth in K.S.A. 77-520, the Proposed Default Order became effective on November 2, 2006. On November 8, 2006, a Final Order was issued stating: “In order to protect the public, Respondent’s egregious violations of the laws governing engineering in Kansas and similar laws in other jurisdictions require revocation of his license to practice. Therefore, Respondent’s engineering license is revoked. In addition to revocation, the Board may assess civil fines and costs, including attorney fees, against Respondent for a violation of the statutes and regulations in an amount not to exceed $5,000 for the first violation and $10,000 for the second violation. Having been disciplined previously by this Board, Respondent is ordered to pay a fine in the amount of $8,598.62 in addition to the Board’s costs, including attorney fees, in the amount of $1,041.38. Both the fine and costs totaling $10,000 shall be paid to the Board on or before 30 days from the date on the Certificate of Service.” To date, Mr. McKinney has not complied with the order of the panel regarding the payment of the fine and costs, nor has he appealed the panel’s determination. Status: On February 2, 2007, The Kansas State Board of Technical Professions filed a Petition For Civil Enforcement of Agency Action against Mr. McKinney with the District Court of Shawnee County, Kansas to enforce payment of both the fine and costs.

Murray Rhodes Receives Land Surveying Excellence Award from Kansas Society of Land Surveyors (KSLS)
The Board of the Kansas Society of Land Surveyors presented the Land Surveying Excellence Award to Murray Rhodes during the 49th annual KSLS Meeting and Education Conference. This is only the second time this prestigious award has been given by KSLS due to the extremely high level of criteria to be met. The first presentation of the award dates back thirty years to 1976. All fifteen KSLS board Murray Rhodes members voted unanimously to award Rhodes based on numerous selection criteria including his leadership as a Board member of the Kansas State Board of Technical professions; member, officer and presenter for KSLS on a local and national level; and his impact on the surveying profession with his cutting edge methodologies. While serving for thirty years as the County Surveyor for Wyandotte County, Rhodes was instrumental in advancing Wyandotte County past nearly all other counties in the United States with his Geographic Base Mapping Land Information System (GIS) which was modeled and used by other counties, universities and countries for similar GIS systems. Rhodes also led the 1977 and 2004 survey efforts for the Indian land boundaries in Wyandotte County as well as surveying, documenting and preserving other notable projects for future generations such as levee district boundaries, railroad rights of way and county and state rights of way. “He has presented seminars to lawyers, title insurance professionals, city, county and state government officials and every one of them came away with a renewed respect for the survey profession as embodied in Murray Rhodes. I consider it an honor to know him,” said Larry Graham, President, KSLS.

State-Specific Exam Committee Meets

Land Surveying Curriculum
(Written by the Kansas State Board of Technical Professions and approved by the Board on December 8, 2006.) All course work shall be completed at a technical school, technical college, community college, college, or university approved by the Board. I. General Education Courses.
A. Mathematics 1. Algebra 3 credit hours 2. Trigonometry 3 credit hours A 3 credit hour course in calculus can be substituted for either algebra or trigonometry. A 5 credit hour course in pre-calculus will satisfy the mathematics requirement. B. Mathematical statistics 3 credit hours

Chaired by Dr. Richard Elgin, the committee is made up of eleven Professional Land Surveyors from different practice backgrounds and geographic areas of the State. The committee meets periodically to review the appropriateness of the materials and syllabus of the State-Specific exam, which is one of the exams required for licensure as Kansas Land Surveyor. The group also reviews each question in the bank of questions used on the exam and writes new questions. “The Board appreciates the time and dedication of this group,” said Board Member Murray Rhodes, LS. “The Board’s purpose is to make the exam complete, fair and appropriate and to assure competence of those whom we license. This group helps us achieve that goal,” he added. Many years ago the Committee identified seven subject areas which are examined on the State-Specific Exam. They are: 1.) The GLO system as used and applied in Kansas. 2.) Resurveys on the U.S. Public Land Survey System (USPLSS) as applied to Kansas. 3.) Kansas Minimum Standards. 4.) Calculation problems related to the USPLSS as applied to Kansas. 5.) Kansas Statutes and Rules. 6.) The Kansas State Plane Coordinate System. 7.) Kansas Riparian Boundaries. Each question on the State-Specific Exam relates to one of these topics. The Committee reviewed the percentage of the exam that covers each of these areas and slightly revised the syllabus percentage. The new (only slightly revised) percentages of the exam assigned to each subject area are: Kansas Minimum Standards 20% Resurveys on the USPLSS 19% Kansas GLO 18% Calculations Problems (on USPLSS) 20% KSA and Rules 12% Kansas State Plane Coordinates 6% Kansas Riparian Boundaries 5% 100% The Committee decided to continue the practice, started several years ago, of enclosing a form (to those who failed the Exam), which ranks the seven subject areas examined, from best to poorest performance. These results can be used by the examinee to prepare for a retest, should he or she wish to take the exam again. The Board thanks the Exam Committee for its work in helping make the exam fair and complete.

New Board Land Surveyor Education Curriculum
by Land Surveyor Board Members: Thomas Mulinazzi, Murray Rhodes, and Tim Sloan At its December 8, 2006 board meeting, the Board of Technical Professions approved a new land surveyor education curriculum consisting of 60 post-secondary credit hours. The Proposed Rules and Regulations related to this new curriculum are published within this newsletter edition, and a public hearing will be held on May 24, 2007 to receive comments. These courses do not have to be taken at the same institution. A two-year associate’s degree is not required. These courses may be taken at any accredited technical school, two year college, or four year institution. Distance learning courses may be accepted. College credits taken before starting this program may be approved if appropriate.
Proposed Rules and Regulation Changes for Land Surveyor Curriculum
66-9-5. Surveying curriculum approved by the board. Any applicant seeking licensure as a land surveyor may fulfill the education requirement by any of the following: (a) Graduation from an approved engineering curriculum as defined in K.A.R. 66-9-4; (b) graduation from a four-year land surveying baccalaureate curriculum accredited by the accreditation board for engineering and technology (ABET); (c) graduation from an approved land surveying curriculum of two years from a school or college approved by the board; or (d) graduation from an approved four-year related science curriculum, which may include geology, mathematics, chemistry, or physics; or (e) successful completion of the board’s “land surveying curriculum,” which was approved by the board on December 8, 2006 and is hereby adopted by reference. (Authorized by K.S.A. 2001 Supp. 74-7013 and 74-7022; implementing K.S.A. 74-7022; effective Feb. 22, 1993; amended Feb. 14, 1994; amended Nov. 1, 2002; amended P-_____________.) 66-10-10a. Surveying experience required of an applicant who completes land surveying curriculum or is a graduate of an approved land surveying curriculum. (a) Each graduate of a four-year land surveying curriculum, as described in K.A.R. 66-9-5(b), shall be required to provide documentation of four years of surveying experience, as required by K.S.A. 747022(a), and amendments thereto. The four years of experience shall have been in progressive land surveying, as described in K.A.R. 66-10-12(b)(1). (b) Each person who has successfully completed the land surveying curriculum specified in K.A.R. 66-9-5(e) and each graduate of an approved land surveying curriculum of two years, as described specified in K.A.R. 66-9-5(c), shall be required to provide documentation of six years of surveying experience, as required by K.S.A. 74-7022(a), and amendments thereto. At least four years of experience shall have been in progressive land surveying as described specified in K.A.R. 66-10-12(b)(1), and the remainder shall have been in either progressive land surveying or basic land surveying, as described specified in paragraphs (b)(2), (3), or and (4) of K.A.R. 66-1012. Admission requirements for fundamentals of surveying examination. (a) Each application shall be reviewed by the board to determine whether the requirements for admission to take the fundamentals of surveying examination have been met. Once the board establishes that these requirements have been met, the applicant shall be allowed to sit for the examination. (b) Each applicant shall meet one of the following requirements for admission before taking the examination: (1) Graduation from an accredited land surveying curriculum, as defined in K.A.R. 66-9-5 (b) and (c); (2) successful completion of the land surveying curriculum specified in K.A.R. 66-9-5(e); (3) verification of a combination of education and experience of a character satisfactory to the board. In evaluating an applicant’s record, a determination shall be made by the board of whether, based on the applicant’s educational background, the applicant requires no more than four years of additional progressive land surveying experience to qualify for admission to the practice of surveying examination; or (3) (4) through June 30, 2008, verification of four years of experience of a character satisfactory to the board, of which two years shall be in progressive land surveying as defined in K.A.R. 66-10-12. It is anticipated that very few students will follow this four semester schedule. Many of the students in this program will have other obligations, which would prevent them from relocating for two years to complete this academic work. The courses marked with an * should be available in many locations throughout the State of Kansas. Surveying courses are also offered through distance learning from the Metropolitan State College of Denver and the University of Wyoming. The Board hopes that this academic program leads to a two year associates degree so that the applicant will achieve that level of education. But because of the relocation problems of these students, an associates degree is not required, just the completion of the specified 60 credit hours.

Charles R. Bissey, P.E.
Charles R. Bissey, 72, Professor Emeritus of Architectural Engineering and Construction Science at Kansas State University, passed away November 18, 2006 in the Mercy Regional Health Center, Manhattan. Charles Bissey volunteered his time to the Kansas State Board of Technical Professions as an exam proctor. He proctored the Fundamentals of Engineering exam at Kansas State for 30 years, serving as head proctor for many of those years. Jon Nelson, past president of the National Council of Examiners for Engineering and Surveying and a graduate of Kansas State, said of Professor Bissey, “In a conversation with Charles we did figure out that he most likely proctored the FE exam when I took it in the fall of 1973…. Clearly he was a man of service.” Bissey was born January 9, 1934 in Huntingburg, Indiana, the son of Mike Bissey and Marie Morganthaler Bissey. He grew up in Cheyenne, Wyoming. In 1957, he received his BS degree from Colorado State University and in 1961 received a MS degree from Kansas State University. He continued with his graduate work in Structures and Computer Science at the University of Massachusetts and served as an Assistant Professor from 1961-1969. He returned to K-State in September 1969 to become an Assistant Professor in the Dept. of Construction Science, College of Architecture & Design. He was promoted to Associate Professor in 1971; participated in the transition of establishing the Department of Architectural Engineering and Construction Science in the College of Engineering in 1975 and retired as Professor in December 2002 after 33 years of dedicated service. He was bestowed the title of Professor Emeritus in January 2003. Professor Bissey received the Hollis Award for Excellence in Undergraduate Teaching from the College of Engineering in 1980 and the University Amoco Foundation Award for Excellence in Undergraduate Teaching in 1982. He was active in college and university committee work as well as state and national professional society organizations. He was active in the American Society of Engineering Education (ASEE) and served as the ASEE Campus Activity Coordinator and on the ASEE Awards Committee. In 1983, he won the ASEE Outstanding Zone Campus Activity Coordinator and received the ASEE Western Electric Fund Award for Excellence in Instruction of Engineering Students in 1984. Professor Bissey was a licensed engineer in the state of Kansas and was active in the National Society of Professional Engineers (NSPE), Kansas Engineering Society and the Tri Valley Chapter of the Kansas Engineering Society, where he served as President in 1987 and as secretary/treasurer for many years. He was active in community affairs and even after retirement continued with his private engineering consulting practice. He was a founding member of the Architectural Engineering Institute (AEI) and was designated Fellow by the AEI Board of Governors in 2001. He established the Architectural Engineering Honorary Society, Phi Alpha Epsilon and held honorary memberships in Sigma Lambda Chi, Tau Sigma Delta and Phi Eta Sigma. He was an active member of the First United Methodist Church, Manhattan, and at the time of his death was the District President for the United Methodist Men. On June 27, 1958, in Wichita, Kansas, he was united in marriage to the former Rose Gallemore. She survives of the home (2033 Arthur Dr., Manhattan, KS 66502). Mr. Bissey is also survived by a daughter, Pamela Lowdon, and her husband, Kelly, Lakewood, Colorado; a son, Jeff Bissey, and his wife, Julie, Orlando, Florida; a sister, Marilyn Faust, Cheyenne, Wyoming; and four grandchildren, Brett Bissey, Leah Bissey, Erin Lowdon and Kimberly Lowdon.
