SUMMARY OF REPORT:
Proposed construction of a farm shed and carport on Lot 391 DP 1087524, Rileys Road, Limeburners Creek. The
enclosed farm shed size proposed is 12 metres x 6 metres x 3 metres in height with a carport 4 metres x 6 metres
attached to the southern side. The proposed development is not in accordance with the Council Occupation of
Outbuildings and Temporary Structures Policy.
SUMMARY OF RECOMMENDATION:
That the application be refused.

BACKGROUND

THE PROPOSAL
To construct a farm shed and carport on Lot 391 DP 1087524, Rileys Road, Limeburners Creek.
SUBJECT SITE
SITE DESCRIPTION
The building location is on the north western corner of the property. The building is to be located 22m from the
front boundary fronting Rileys Road and about 98m from the western side boundary. The topography of the site is
flat and is clear of any vegetation.

REPORT
The following matters as listed under Section 79C of the Environmental Planning and Assessment Act, 1979, are
relevant in considering this application:

The provisions of any environmental planning instrument that is or was on public exhibition and which has
been notified to the consent authority; any DCP; any matters prescribed by the regulations that apply to the
Development Application on the subject land

Local Environmental Plan
The land is zoned 1(a) Rural under Great Lakes LEP 1996. The proposal is permissible within this zone.

Development Control Plan
There are no Development Control Plans applicable to this proposal.

Likely impacts of development including environmental impacts on both natural and built environments
and social/economic impacts in the locality

Context and Setting
The proposal is generally considered to be satisfactory having regard to the relationship to the regional and local
context.

Site design and internal layout
The positioning of the building is considered to be appropriate and will not unreasonably impact upon
surrounding properties.

Occupation of Outbuildings and Temporary Structures Policy
The Occupation of Outbuildings and Temporary Structures Policy states that approval cannot be given unless
approval for a dwelling is obtained simultaneously and construction first commences on the dwelling. There is no
dwelling approved or proposed on this property, therefore the shed does not comply with the Occupation of
Outbuildings and Temporary Structures Policy. Council has granted variations to this Policy in the past, where the
property is vacant, there are no sanitary facilities within the building and the applicant has demonstrated the need
for the building.

In this case, however, existing sheds are located on the property, including a hay shed and a five bay garage. The
applicant stated that the proposed shed is to be used for storage of machinery equipment, workshop, restroom,
carport and water tanks.

The proposed shed is enclosed and has a concrete floor and toilet facilities proposed. A site inspection revealed
that a caravan was stored on-site.

Submissions made in accordance with the Act or regulations
The application was notified to adjoining owners in accordance with Council’s Policy and no submissions were
received.

The public interest
There are no issues that would unreasonably impact upon the public interest.
CONCLUSION
Even though Council has varied this policy in the past, the proposed shed is fully enclosed, has a concrete floor,
toilet facilities and two existing sheds are installed on the property. There is no dwelling approved or proposed on
this property and therefore this proposal does not comply with the Occupation of Outbuildings and Temporary
Structures Policy and should be refused.

RECOMMENDATION: DIRECTOR PLANNING & ENVIRONMENTAL SERVICES

It is recommended that DA 584/2006 for the construction of a Farm Shed and Carport on Lot 391 DP 1087524,
Rileys Road, Limeburners Creek be refused for the following reason:

1.      The construction of a shed does not comply with the Occupation of Outbuildings and Temporary Structures
        Policy.
