The Selectmen held a meeting on Tuesday, November 18, 2008 at 7:00 p.m. at the Town
Hall, 11 Lincoln Street.

CALL TO ORDER
Vice Chairman Malaguti called the meeting to order at 7:05 p.m. and led the Pledge of
Allegiance.


SWEARING-IN CEREMONY: NEW POLICE CHIEF
Town Manager Mark Sylvia was pleased to introduce the swearing-in ceremony for
Plymouth’s newly-appointed Police Chief, Michael Botieri. He elaborated upon Chief
Botieri’s educational background and history with the Plymouth Police Department and
then invited the Town Clerk, Larry Pizer, to preside over the swearing-in ceremony.

Following the ceremony, Vice Chairman Malaguti welcomed Chief Botieri and wished
him well. Chief Botieri addressed the Board and shared some of his ideas for moving
Plymouth’s Police Department forward in a positive way.


TOWN MANAGER’S REPORT
Nelson Park and Lout Pond Grants – Mr. Sylvia reported that the Town of Plymouth
recently received a $500,000 State PARC (Parkland Acquisition and Renovations for
Communities) grant award for the rehabilitation of Nelson Park (a recommendation within
the Public Space Action Plan). The Town, he said, hopes to utilize Community
Development Block Grant and 40R funds as matching contributions to the project.

In addition, Mr. Sylvia noted, the Town received a $500,000 State LAND (Local
Acquisition for Natural Diversity) Grant for property abutting both Lout Pond and
Billington Sea, which will help the Town to protect the Zone II well at Lout Pond. He

thanked Town’s Environmental Manager, David Gould, for his efforts in securing both the
PARC and LAND grants, and he recognized Environmental Technician Kim Michaelis,
Conservation Agent Liz Sullivan, and Senior Planner Valerie Massard for their work on
the LAND grant.

Wellingsley Brook – Mr. Sylvia was happy to report that Plymouth’s Environmental
Manager, David Gould, and Conservation Agent, Liz Sullivan, have successfully come to
an agreement with resident and property owner Jeffrey Fischer regarding the fish passage
at the Wellingsley Brook site. Under agreement with Mr. Fischer, he explained, the
Town’s Environmental Management Division has removed the weir boards as of
November 13, 2008 and will monitor the water flow to ensure fish passage through the
month of February. Mr. Sylvia added that the Town will continue to work on a longer-
term solution with the interested parties and the State to restore this area.

Plymouth Featured on WBZ Channel 4 – Mr. Sylvia announced that WBZ Channel 4
and Upstream Magazine recently featured Plymouth’s Town Brook within a story on dam
removal initiatives. The Town’s projects along the brook (the 2002 removal of the
Billington Street Dam and the planned removals of the Off Billington and Plymco dams),
he said, represent proactive approaches to addressing dam safety concerns and restoring
waterway habitat in Plymouth.

Cordage Park Growth District Initiative – Mr. Sylvia reported that Governor Deval
Patrick was recently in Plymouth to designate the Cordage Park development as a Growth
District project under the State’s Growth Districts Initiative (“GDI”). The GDI, he
explained, is a new program offered through the Massachusetts Permit Regulatory Office,
and projects designated under this program will receive assistance from the
Commonwealth of Massachusetts in areas including state permitting, technical assistance
and marketing to make the sites “development ready.”

Free Electronics Recycling Day – Mr. Sylvia provided information on the Town’s first
Free Electronics Recycling Day to be held at the DPW Annex on December 6, 2008 from
9:00 a.m. to noon. Made possible through collaboration between the Town and Waste
Management, he said, this event will provide Plymouth residents with the opportunity to
properly recycle their old electronic equipment at no charge.

1820 Court House – Mr. Sylvia informed the Board, with regret, that the Town and
County were not able to reach a final agreement on the Purchase & Sales Agreement for
the 1820 Courthouse, County Commissioners Building, and Memorial Courtyard located
in downtown Plymouth. Mr. Sylvia outlined the items raised by the Commissioners that
the Town ultimately considered fatal to the original agreement, and he expressed his
disappointment that the County has recently chosen to change course after nearly a year of
negotiations into which both parties invested much time and effort. Mr. Sylvia then
referenced correspondence from the Commissioners to the Selectmen that the County plans
to the put the 1820 Court House and adjacent properties out to bid.

Members of the Board discussed the Purchase & Sales agreement and the County’s recent
decision to put its historic downtown properties out to bid. Selectman Tavares noted his

hesitation to believe that the matter is irresolvable and his hope that the Town might have
some influence upon the fate of these important properties, if the County moves forward
with an RFP. Selectman Mahoney speculated that the County’s decision to sell the
property is likely tied to its budgetary challenges, considering the significant downturn in
revenues collected through real estate transactions at the Registry of Deeds.

Mr. Sylvia noted that, while the Board might find it worthwhile to meet with the
Commissioners to discuss the matter further, he does not anticipate that the Commissioners
will budge on their decision to move forward with the RFP process. Mr. Sylvia added,
however, that the County Administer has acknowledged that the Town will be given the
opportunity to influence the RFP.

Members of the Board expressed interest in reaching out to and/or meeting with the
County Commissioners to discuss the matter further. Vice Chairman Malaguti asked Mr.
Sylvia to facilitate this communication.

Meeting Minutes / August 19, 2008 – On a motion by Selectman Machado, seconded by
Selectman Mahoney, the Board voted to approve the minutes from the August 19, 2008
Selectmen’s meeting. Voted 3-0-1, approved. [Note: Vice Chairman Malaguti abstained
from this vote, as he did not attend the August 19th meeting.]

Meeting Minutes / August 26, 2008 – The Board voted to approve the minutes from the
August 26, 2008 Selectmen’s meeting. Voted 3-0-1, approved. [Note: Selectman Tavares
abstained from this vote, as he did not attend the August 26th meeting.]

Committee Appointment – The Board appointed Robert Bradley, Jr. as the Chamber of
Commerce’s designee on the Visitors Services Board, for a term effective through June 30,
2011.

Energy Conservation Policy – The Board adopted the new Energy Conservation Policy
related to all Town of Plymouth buildings effective November 19, 2008, in an effort to
comply with the Board of Selectmen’s “Plymouth 2020 Energy Plan.”

Public Facilities Policy – The Board adopted the modified Public Facilities Policy as of
November 19, 2008. This policy has been updated to include language that addresses the
public accessing areas of the buildings that present a safety problem if they are not
accompanied by a town staff supervisor.

Vehicle Use Policy – The Board adopted the Vehicle Use Policy as of November 19, 2008
with implementation to take immediately except in those instances where there is an
obligation under MGL c. 150E. In that instance, the Town Manager will implement upon
staff completing any bargaining obligation.

Ms. Arrighi outlined the new Vehicle Use Policy and noted that she will be meeting with
the OPEIU union to discuss those staff members who will be affected by the policy when
this is implemented. There are several questions that the union has posed in regards to the
policy, Ms. Arrighi noted, but the Board can implement the policy for non-union
employees immediately.

Discussion ensued amongst the members of the Board regarding the policy. Selectman
Mahoney inquired about those positions that would be affected by the policy, both union
and non-union. Selectman Machado stated his belief that the use of public vehicles for
commuting purposes is wrong, especially during such difficult economic times. Vice
Chairman Malaguti offered his opinion that it seemed illogical to ask the Highway and

Maintenance Superintendents to maintain Plymouth’s roads and facilities on an on-call
basis without the provision of an authorized vehicle.

Vice Chairman Malaguti then made a motion to amend the Vehicle Use Policy to include
the Highway Superintendent and the Maintenance Superintendent to the list of authorized,
on-call commuting vehicles in the policy. Selectman Tavares seconded the motion, and
the Board voted 4-0-0 in favor.

Mr. Sylvia recommended that the Board take a vote to approve the Vehicle Use Policy as
amended. On a motion by Selectman Machado, seconded by Selectman Mahoney, the
Board approved the Vehicle Use Policy as amended. Voted 4-0-0, approved.

PGDC Support for the 2008 Thanksgiving Parade – The Board endorsed the Plymouth
Growth & Development’s intent to provide $5,000 in support of the 2008 Thanksgiving
Parade.

Acceptance of Gift – The Board accepted a gift made to the Town of Plymouth from
Grace W. Coombs, in memory of Melvin G. Coombs. The gift is a signed card from and
photograph of former U.S. President Harry Truman being presented with a Thanksgiving
turkey from Plymouth citizens. The gift will be kept with Plymouth’s historical archives.

PARC Grant Agreement for Nelson Park – The Board will vote to sign the Parkland
Acquisitions and Renovations for Communities Program Project Agreement relative to the
Nelson Memorial Park Rehabilitation Project.

The Pinehills Affordable Housing Trust – The Board acknowledged the commitment
made by The Pinehills to create and fund The Pinehills Affordable Housing Trust.

Permission to File Notice of Intent – The Board granted permission to Joel Finlay of 116
Warren Avenue to file a Notice of Intent with the Conservation Commission regarding a
proposal to construct a pedestrian bridge from his property across Eel River to Plymouth
Long Beach.


PUBLIC HEARING: ALTERATION OF PREMISES
Vice Chairman Malaguti opened a public hearing to consider an application for an
Alteration of Premises from G.L.B.R., Inc. d/b/a The Colonial Tavern, 39 Main Street, 2nd
Floor, George Marinos, Manager, holder of an Annual All Alcohol Restaurant Liquor
License. Notice of this hearing was given in accordance with Chapter 138 of the
Massachusetts General Laws and those wishing to be heard on the matter were encouraged
to attend.

Leon Marinos appeared on behalf of G.L.B.R., Inc. to explain that he and his family have
decided to consolidate The Colonial Restaurant (first floor of 39 Main Street) and The

Colonial Tavern (second floor of 39 Main Street) under one company name, and, as such,
they wish to combine the respective alcohol licenses into one.

Vice Chairman Malaguti opened the hearing to public comment, whether for or against.
No one came forward to address the Board.

On a motion by Selectman Tavares, seconded by Selectman Mahoney, the Board approved
an Alteration of Premises from G.L.B.R., Inc. d/b/a The Colonial Tavern, 39 Main Street,
2nd Floor, George Marinos, Manager to add the first floor of 39 Main Street, currently
under Plymouth Colonial Restaurant Corporation d/b/a Colonial Restaurant, to its Annual
All Alcohol Restaurant Liquor License. Voted 4-0-0, approved.


PUBLIC COMMENT
David Crawley addressed the Board regarding the Wellingsley Brook matte and he thanked
the Selectmen and the Town Manager’s Office for their attention to the concerns raised by
citizens with regards to the flow of the brook. Mr. Crawley said that he was encouraged by
the legal opinion issued by Town Counsel and the recent removal of weir boards that
dammed the brook and prevented fish passage, and he expressed his wish that the natural
habitat connected to the flow of the brook be restored quickly with minimum legal
wrangling.


AFFORDABLE HOUSING AND CHAPTER 40B
Mr. Sylvia noted that members of the Board, as well as some neighborhood groups within
Plymouth, had asked for further discussion on affordable housing and the State’s Chapter
40B legislation.

Lee Hartmann, Director of Planning & Development, provided a presentation in which he
discussed the financial characteristics of affordable housing, based on the median income
of the community ($85,500 annual household income) and the median price of a single
family home in Plymouth ($315,000). Mr. Hartmann then discussed the basic
requirements of Chapter 40B (the State’s affordable housing legislation) and the means by
which the State can overrule Town rules and regulations to ensure that at least 10% of the
Town’s housing is considered affordable. If the Town can demonstrate that at least 10% of
its housing is affordable, it then has the ability to turn away 40B developments, he said.
Mr. Hartmann then illustrated, however, the snags and obstacles within 40B that make it
difficult for municipalities to comply with the 10% requirement.

Bruce Arons, Director of Community Development, discussed the Town’s efforts to
address affordable housing in Plymouth, not only to achieve the State’s 40B mandate, but
for the good of the community. He reviewed several initiatives that the Office of
Community Development has put in place to increase the Town’s number of affordable

units, including the Town’s Affordable Housing Plan, Inclusionary Housing Zoning
Bylaw, Affordable Housing Trust, and Local Site Approval Subsidy Program.

Mr. Hartmann noted that many of Massachusetts’ communities do not look favorably upon
the State’s Chapter 40B legislation. Plymouth’s Planning & Development staff, he said,
will continue make every effort to voice its concerns about 40B and partner in any
endeavor to initiate its reform.

Mr. Hartmann and Mr. Arons responded to questions from members of the Board
regarding Chapter 40B legislation reform and the qualification of mobile home parks and
low-income housing developments. Mr. Hartmann explained that, despite their
affordability, mobile homes do not qualify towards the Town’s affordable housing count; if
they did, he noted, Plymouth would be very close to meeting 40B’s 10% requirement.

Members of the Board shared their frustration with Chapter 40B. Selectman Tavares
recommended that the Board invite Plymouth’s legislative delegation to discuss this
frustration with 40B and make it clear that the community would like to see change at the
State level. Selectman Mahoney referenced correspondence from the Town of Norwell,
whose Selectmen have addressed an emphatic letter to the State, demanding 40B reform.

Mr. Arons explained that there is a myriad of reasons why it will be difficult to repeal
Chapter 40B legislation. In the meantime, he said, a coalition of approximately 40
communities within Massachusetts is seeking and working towards alternatives to Chapter
40B. Plymouth, he noted, intends to bring its Local Site Subsidy Approval Program before
the Department of Housing & Community Development for approval, in an effort to take
back some local control over the projects within its community. Regardless of the
outcome of efforts to reform Chapter 40B, Mr. Arons asserted, the Town of Plymouth will
remain committed to ensuring that affordable housing is available to its residents.

Mr. Sylvia noted that it would be prudent for the Board to hold a constructive conversation
with Plymouth’s legislative delegation on Chapter 40B reform. Mr. Hartmann added that
it would be helpful for him and his staff to know that the Selectmen support their efforts to
advocate for reform of Chapter 40.

Selectman Mahoney made a motion to support the Department of Planning &
Development’s efforts to advocate for reform of Chapter 40B. Selectman Tavares
seconded the motion, and the Board voted unanimously in favor. Voted 4-0-0, approved.

Vice Chairman Malaguti opened the discussion to public comment. He advised those who
wished to speak on the matter to keep their comments limited to Chapter 40B legislation in
general, as opposed to discussing specific 40B development projects.

Robert Materna of the Shallow Pond Homeowners Association addressed the Board and
lauded Mr. Hartmann and Mr. Arons for trying to find alternatives to Chapter 40B. Mr.
Materna shared some of the research he conducted on Chapter 40B issues in other
communities and discussed the Greater Boston Housing Report Card, which concluded
that 40B is failing to provide affordable housing in Massachusetts (now ranked 49th in

affordability, according to Mr. Materna). Chapter 40B exhausts community resources, he
said, and he asked that Plymouth’s leaders rally around any initiatives for its reform.

Tim Shobbrook thanked the Selectmen, Mr. Sylvia, Mr. Hartmann, and Mr. Arons for their
support of Chapter 40B reform.

Bob Bielan referenced the reform proposal made by Norwell’s Board of Selectmen and
recommended that Plymouth follow suit and take its own initiative to enact changes to
Chapter 40B.

Mr. Sylvia acknowledged the challenges and frustration that Chapter 40B has wrought
upon Massachusetts’ municipalities. Plymouth, he said, will continue to work with its
legislative delegation and the Mass. Coalition for Affordable Housing on the most
effective way to reform Chapter 40B.


OLD BUSINESS / LETTERS / NEW BUSINESS
OLD BUSINESS
Transfer Station Violation Notices – Selectman Machado noted that he has received
some comments from citizens regarding the bright orange mailers which carry the violation
notices pertaining to the Town’s transfer stations. Ms. Arrighi explained that the Town
must make it clear to those receiving the notices that the correspondence is a violation that
requires a prompt response, hence the bright orange color.

Veteran’s Day – Selectman Machado expressed his disappointment that so few citizens
turned out for the annual Veteran’s Day Parade. Selectman Tavares echoed Selectman
Machado’s sentiments and noted that part of the problem with low turnout at the parade is
due to the fact that so many have to work on Veteran’s Day.

Plymouth Housing Authority / Cherry Hill II Project – Selectman Mahoney shared
some concerns about the Plymouth Housing Authority’s Cherry Hill II housing project to
expand senior housing on Court Street. He referenced the Plymouth Housing Authority’s
(“PHA”) previous proposal that the Town grant its 130 and 130R Court Street properties
for further expansion of the abutting senior housing campus, noting that he met with Joan
Pimental (director of the PHA) for additional information on the proposal. Selectman
Mahoney stated his support for the PHA’s mission but questioned its execution of the
campus expansion after a recent visit to the worksite. He shared several of the
observations he made during the site visit which shook his confidence in the project, and
he questioned how the use of Community Preservation funds toward the project might
trigger the Town’s Responsible Contractor bylaw.

Vice Chairman Malaguti pointed out that the PHA is a quasi-governmental authority that is
not subject to Town laws. The Town has no ability to dictate how the project is executed,
he said, and he urged the Board and the public to recognize the greater good done by the

PHA’s Cherry Hill II project, which will ultimately provide affordable housing for
Plymouth’s seniors.

Selectman Machado inquired if the Town can require that the PHA adhere to Responsible
Contractor laws if it is using Community Preservation funds. Mr. Sylvia responded that
the Town cannot require this, regardless of the use of Community Preservation funds.

Status of Signal at Mobile Home Estates / Marc Drive – Vice Chairman Malaguti
inquired about the status of the traffic signal planned for Samoset Street at Plymouth
Mobile Home Estates and Marc Drive. Mr. Sylvia answered that, while this project is
included in the Transportation Bond Bill, the funds have not yet been released for its
completion.

Intersection of Federal Furnace and South Meadow Roads – Vice Chairman Malaguti
asked for an update on the request to install a left-turn-only signal at the intersection of
Federal Furnace and South Meadow Roads. Mr. Sylvia responded that Sid Kashi, the
Town Engineer, just recently provided a report on the level-of-service study conducted by
the Old Colony Planning Council, which will be shared with the Board.

Standish Avenue Road Surface – Vice Chairman Malaguti referenced the extensive
construction work done along Standish Avenue and asked if anything can be done to make
the road surface presentable during the winter months, prior to final repair in the spring.

Pavement at Intersection of Court and Samoset Streets – Vice Chairman Malaguti
asked the Town Manager to look into what can be done to fix the rippled pavement at the
intersection of Court and Samoset Streets (Route 44). Mr. Sylvia noted that the Town has
contacted MassHighway (as the State has jurisdiction over Route 44) about this matter, and
he confirmed that he will follow up with the Board with any response.

LETTERS
Correspondence Regarding Chiltonville Traffic Calming Measures – Selectman
Machado referenced correspondence from several citizens regarding the recently installed
traffic calming measures (speed humps) in the Jordan Road / Chiltonville area. Could the
Town, he asked, use more police details to slow traffic and address these issues? Mr.
Sylvia responded that these traffic claming measures are the result of long-standing
concerns that the Town has tried to address regarding speeding and safety along Jordan and
Old Sandwich Roads. Police enforcement was used, Mr. Sylvia noted, and after several
public hearings with the residents of this area, the Town determined that the installation of
speed humps was the best solution.

NEW BUSINESS
Northbound Ramp to Route 3 at South Street – Vice Chairman Malaguti asked if the
lack of a dedicated left-hand signal for westbound traffic to the northbound ramp to Route

3 at South Street has caused any accidents. He suggested that the Town look into the
matter.

On a motion by Selectman Tavares, seconded by Selectman Mahoney, the Board voted to
adjourn its meeting. Voted 4-0-0, approved.
