   1. A list of vehicles to be used with proof of insurance

   2. Copy of current passenger vehicle permit, which is in good standing and issued in my name or the name of the
      business, by the Ministry of Transportation, for the vehicles being licensed. In the event that a vehicle is owned
      by a person(s) who is not an owner of the business, provide written proof from the owner of the vehicle that the
      vehicle will be used as part of the business along with a copy of the passenger vehicle permit issued by the
      Ministry of Transportation;

   3. Safety standards certificate for each vehicle issued under the Highway Traffic Act

   4. Certificate of Insurance with a third party liability limit of at least $1,000,000.00 exclusive of interest and costs in
      respect to any one accident and the policy shall be endorsed to provide that the City shall be given at least ten
      (10) days notice in writing prior to any cancellation, expiration or change in the amount of the policy

The Licencee agrees that:

a)        I have authority to sign on behalf of the aforementioned business;
b)        I will advise the City of any change(s) of information that has been supplied to the City;
c)        I agree to provide a copy of a current
d)        I will provide a dispatch service which is in service twenty-four (24) hours per day, seven (7) days per week;
e)        I will ensure that the fares charged are consistent with the by-law requirements;
f)        I agree to comply with the provisions of the Taxi-Limousine Licensing By-law and its amendments;
g)        I agree to keep the vehicles in repair and clean;
h)        I will produce daily trip records, if requested by the City Clerk or designate, which prove that each licensed
          vehicle was in operation for a minimum of one hundred and twenty (120) hours during any thirty (30) day period
          unless there is an acceptable reason provided to the City Clerk or designate;
i)        I will retain records of all calls received or dispatched giving date, time origin and driver’s name;
j)        I will retain the records in an orderly manner filed by date, for twelve (12) months, and ensure they will be open
          to inspection by the City Clerk or designate;
k)        I will prominently display on the rear exterior of the taxi-limousine the numbered metal licence plate provided by
          the City;
l)        I shall upon disposing of a vehicle, within forty-eight (48) hours, advise the City of the replacement vehicle or
          surrender the licence in respect of such vehicle;
m)        I shall ensure each licenced vehicle has an illuminated sign on the roof of the taxi stating that it is a taxi.
n)        I shall ensure that each licenced vehicle, while on duty, has a “No Smoking” sign posted in a prominent place
          within the vehicle.

will abide by all of the provisions of the City of Woodstock Municipal Code Section 643 and amendments thereto and any
other applicable municipal regulations that may apply to the operation of a Taxi-Limousine Broker’s Licence. The licence

WHEREAS Part IV of the Municipal Act, 2001, c. 25 provides that a mu-
nicipality may licence and regulate businesses;
AND WHEREAS the Council of The Corporation of the City of
Woodstock deems it appropriate to licence the business of taxi and limou-
sine services.

                             Article 1
                           SHORT TITLE

643.1.1    Citation
This Chapter may be cited as “Taxi and Limousine Licensing By-law.”

                            Article 2
                        INTERPRETATION

643.2.1    City - defined
“City” means the City of Woodstock.

643.2.2     Cab - defined
“cab” means a motor vehicle which is kept or used for hire for the con-
veyance of passengers with a seating capacity of not more than six per-
sons including the driver.

643.2.3      Call - defined
“call” within the meaning of this Chapter shall include a request or di-
rection for the use of a cab, taxicab, or limousine transmitted by radio
or radio phone or by personal request of a prospective passenger or in
any other manner.

643.2.4    Clerk - defined
“Clerk” means the City Clerk or his/her designate for the Corporation.

643.2.5    Corporation - defined
“Corporation” means The Corporation of the City of Woodstock.

643.2.6    Council - defined
“Council” means the Council of the Corporation.

643.2.7     Driver - defined
“driver” means a driver of a cab, taxicab or limousine who is licensed as
such under this Chapter.

643.2.8       Licence - defined
“licence” means a licence granted by the Corporation under the provi-
sions of this Chapter to own or operate any vehicle used to convey pas-
sengers for hire.

643.2.9     Handicap vehicle - defined
“handicap vehicle” means a van which is wheelchair or scooter accessi-
ble for persons with special needs with a power or manual non-skid
ramp and sufficient wheelchair tie downs to accommodate the number
of persons the vehicle is capable of carrying.

643.2.10 Law enforcement officer - defined
“law enforcement officer” means a person appointed by the Council of
the Corporation to enforce the by-laws of the municipality or a Police
Officer employed by the Oxford Community Police Services Board.

643.2.11 Limousine - defined
“limousine” means a motor vehicle having a seating capacity of more
than six passengers, including the driver, which is used for hire for the
conveyance of passengers for which a fee is charged on an hourly or
mileage rate for transportation to a specific place but shall not include a
van, bus, taxicab or station wagon with extra seating capacity, a vehicle
as defined in the Public Vehicles Act, an ambulance or a funeral hearse.

643.2.12 Owner - defined
“owner” means the registered owner of a cab, taxicab or limousine.

643.2.13 Person - defined
“person” includes an individual, corporation, partnership, firm, associ-
ation, other legal entity or agent thereof.

643.2.14 Taxicab - defined
“taxicab” means the same as cab.

643.2.15 Taxicab/limousine broker - defined
“taxicab/limousine broker” means any person who accepts calls in any
manner for cabs, taxicabs or limousines used for hire. Persons who op-
erate handicap taxi vehicles only shall not be required to purchase a
broker’s licence.

643.2.16 Taxicab/limousine broker licence - defined
“taxicab/limousine broker licence” means a licence issued to a taxi-
cab/limousine broker pursuant to the provisions of this Chapter.

                           Article 3
                      GENERAL PROVISIONS

643.3.1      Exemption - non profit agencies
This Chapter shall not apply to non profit agencies which provide
transportation at cost through their agency.

643.3.2     Non-profit agencies
Non-profit agencies shall be eligible to provide para transit services
only to qualified disabled persons provided that the agency complies
with the provisions of this Chapter with the exception of Sections
643.3.4, 643.3.11, 643.3.12, 643.3.13, 643.4.3, 643.4.8, 643.4.9,
643.4.10 and 643.5.11.

643.3.3    Operation - without licence - prohibited
No owner, taxicab/limousine broker, or driver shall operate as such
who has not obtained a licence thereto pursuant to this Chapter.

643.3.4     Location - restriction
A taxicab/limousine broker shall be located on property that is zoned to
allow such use.

643.3.5      Licence - number - non transferable
The number of taxicab/limousine broker licences that may be granted
by the City shall be limited to 50 licences in any given year and any
such licence is not transferable. Until February 1 in each year, prefer-
ence will be given to applicants who held a taxicab/limousine broker
licence in the previous year. An applicant who did not hold such licence
in the previous year shall not be granted a licence for the current year
until February 1, if the granting of such licence would reduce the num-
ber of licences available to brokers of the previous year. Applicants
who hold a taxicab/limousine broker licence shall be eligible to apply
to obtain additional taxi/limousine broker licences on a first come first
served basis provided that the taxicab/limousine broker provides such
documentation as is requested by the Clerk or his/her designate to
prove that each of the licensed vehicles within the taxicab/limousine
brokers business has operated an average of in excess of ten hours per
day during the past forty-four weekdays (being Monday through Fri-
day) previous to applying. Handicap vehicles shall not be included in
the total number of licensed vehicles available.

643.3.6     Licence - issue - requirements
The Clerk shall not issue a licence unless the following have been pro-
vided:
 (a) all information requested by the City has been supplied;
 (b) the application has been completed, signed and filed with
     the Clerk;
 (c) the licence fee has been paid.

643.3.7     Licence - expiry - December 31 - exception
Every licence issued under the provisions of this Chapter shall expire
on December 31 of the year for which it was issued, unless sooner
revoked.

643.3.8    Licence - displayed - visible
Every licence issued under the provisions of this Chapter shall be
prominently displayed where it is visible to the public and the passen-
gers.

643.3.9      Licence - revocation - circumstances
Every licence shall be subject to revocation should any of the provi-
sions of this Chapter be contravened.

643.3.10 Information changed - notification - seven days
The holder of a licence issued under the provisions of this Chapter shall
notify the Clerk of any subsequent change of information which has
been supplied to the City.

643.3.11 Non-compliance - disputed - referral - to Council
Where an inaccuracy, non-compliance or contravention is disputed in
writing by the licence holder, the disputed matter shall be referred
forthwith by the Clerk to the Council which shall hear representations
from the applicant and determine the matter.

643.3.12 Hours of operation
Taxicab brokers shall maintain a twenty-four hour per day, seven days
per week service with sufficient taxicabs available to service calls un-
der normal circumstances.

643.3.13 Minimum of five licences - retained by the City
The Clerk shall retain a minimum of five taxicab/limousine broker
licences for the purposes of accommodating a new broker after the en-
actment of this Section to be retained until the limit cap has been
reached.

643.3.14 Application - new broker’s licence
Every applicant for a new broker’s licence shall be eligible for a mini-
mum of five and a maximum of 10 taxicab/limousine broker licences, if
available.

                           Article 4
                       BROKER’S LICENCE

643.4.1      Vehicle permit - in good standing
Every applicant for or holder of a taxicab/limousine broker licence
shall hold a current passenger motor vehicle permit which is in good
standing and issued in the applicant’s name by the Ministry of Trans-
portation for the motor vehicle of which he/she is the owner or proof
that he/she has the authority to operate the vehicle as part of his limou-
sine/taxi business from the owner of the vehicle.

643.4.2     Safety certificate - required annual
Every applicant for or holder of a taxicab/limousine broker licence
shall provide a safety standards certificate for each motor vehicle is-
sued under the Highway Traffic Act annually prior to licensing.

643.4.3     Dispatch services - uninterrupted - requirement
Every applicant for or holder of a taxicab/limousine broker licence
shall provide a dispatch service which is in service twenty-four hours
per day, seven days per week.

643.4.4      Insurance - minimum requirement
Every applicant for or holder of a taxicab/limousine broker licence
shall provide proof of insurance with a third party liability limit of at
least $1,000,000 exclusive of interest and costs in respect to any one ac-
cident and the policy shall be endorsed to provide that the City shall be
given at least ten days notice in writing prior to any cancellation, expi-
ration or change in the amount of the policy.

643.4.5     Application - information requirements
Every applicant for or holder of a taxicab/limousine broker licence
shall complete and sign the City of Woodstock taxicab/limousine bro-
ker’s application form which will require that the owner:
 (a) advise the City of any change in a driver’s licence status;
 (b) advise of any change in vehicles;
 (c) ensure that daily trip records are accurately completed,
     filed and are made available to the City if requested;
 (d) ensure that the fares charged are consistent with the Chap-
     ter requirements;
 (e) advise of any address change;
 (f) agrees to comply with the provisions of this Chapter and its
     amendments;
 (g) agrees to keep the vehicles in good repair and clean;

 (h) must provide a minimum of five taxicabs.

643.4.6      Daily trip record - provided - upon request
Every applicant for or holder of a taxicab/limousine broker licence
shall be able to produce daily trip records if so requested by the Clerk or
his/her designate which prove that each licenced vehicle was in opera-
tion for a minimum of one hundred and twenty hours during any thirty
day period unless there is an acceptable reason provided to the Clerk.

643.4.7      Call record - information requirements
Every applicant for or holder of a taxicab/limousine broker licence
shall keep a record of all calls received or dispatched giving date, time
origin, vehicle licence number and driver. Records are to be retained in
an orderly manner filed by date for twelve months and open to inspec-
tion by the Clerk or his/her designate.

643.4.8     Licence plate - displayed on vehicle
Every applicant for or holder of a taxicab/limousine broker licence
shall prominently display on the rear exterior of the taxicab the num-
bered metal licence plate provided by the City.

643.4.9      Vehicle - disposal - replacement - notice
Every applicant for or holder of a taxicab/limousine broker licence
shall, upon disposing of a vehicle, within forty-eight hours advise the
City of the replacement vehicle or surrender the licence in respect of
such taxicab.

643.4.10 Vehicle - roof sign - illuminated
Every applicant for or holder of a taxicab/limousine broker licence
shall ensure each licenced vehicle has an illuminated sign on the roof of
the taxicab stating that it is a taxicab.

                             Article 5
                        DRIVER’S LICENCE

643.5.1     Age - immigration status
Every applicant for or holder of a driver’s licence must be at least 18
years of age and a citizen of Canada, a landed immigrant or produce a
valid work permit to work as a driver, issued by the Government of
Canada.

643.5.2     Valid Class “G” licence - required
Every applicant for or holder of a driver’s licence shall hold a current
valid Class “G” driver’s licence issued by the Province of Ontario
which is in good standing according to the records of the Ministry of
Transportation.

643.5.3      Letter of potential employment - required
Every applicant for or holder of a driver’s licence shall provide a letter
of potential employment from a licenced owner or broker for whom
he/she will be driving.

643.5.4     Police security clearance record check - required
Every applicant for or holder of a driver’s licence shall provide a Police
Security Clearance Record Check.

643.5.5     Photographs - passport size - required
Every applicant for or holder of a driver’s licence shall provide two
passport size photographs.

643.5.6      Application - information requirements
Every applicant for or holder of a driver’s licence shall complete and
sign the City of Woodstock driver’s application form which states that
the driver:
 (a) must advise the City of any change in his/her driver’s
     licence status;
 (b) must advise the City of any medical or eye problems which
     would prevent or impede his/her ability to safely operate a
     vehicle;
 (c) shall accurately complete and file with the broker daily trip
     records;
 (d) shall charge fares consistent with the Chapter requirements;
 (e) shall advise the City of any address change;
 (f) shall be civil and behave courteously when driving a cab or
     limousine;
 (g) shall be properly dressed, well groomed, neat and clean in
     personal appearance when driving a cab;
 (h) shall serve the first person requiring the service of the vehi-
     cle;
 (i) does not have more than nine demerit points recorded on
     his/her driver’s licence in the previous twenty-four months;
 (j) has paid the City of Woodstock licence fee;
 (k) shall drive the taxicab/limousine operated by him/her di-
     rectly to the destination unless the passenger authorizes the
     driver to do otherwise. The driver shall not pick up passen-
     gers from another location unless specifically authorized to
     do so by the passengers in the vehicle;

 (l) shall display his/her photo ID licence issued by the City in
     a prominent place within the vehicle when conveying pas-
     sengers;
 (m) shall supply a signed receipt to the passengers if requested
     to do so;
 (n) shall not convey more passengers at one time than the num-
     ber of available seat belts;
 (o) shall not drive a taxicab/limousine for more than twelve
     consecutive hours within any twenty four hour period.

643.5.6.1 Disqualifications from obtaining a driver’s licence
No person shall be issued a driver’s licence:
 (a) that has been convicted of an indictable offence for which
     he/she was sentenced to imprisonment for three months or
     more in the past five years; or
 (b) that has been convicted of any sexual offence for which
     he/she was sentenced to imprisonment for three months or
     more; or
 (c) that has been convicted of any two of the following of-
     fences in the past five years:
         (i)    impaired driving;
         (ii)   dangerous driving;
         (iii) driving with over 80 mg of alcohol in 100 ml of
               blood; or
         (iv)   criminal negligence involving the use of a motor
                vehicle.

643.5.6.2 Appeal - licence declined - suspended
Applicants, whose licence application has been declined or suspended,
are eligible to appeal the decision in writing within fifteen days after
the issue of the decision of the Clerk and after a period of twenty-four
months from the date of conviction. Such appeal shall be heard by a re-
view panel, comprised of one representative from the Oxford Commu-
nity Police Service, one representative from Council and one
representative from the taxi company sponsoring the applicant. The
taxi industry shall be responsible to appoint a representative within 10
days of being notified in writing. If no representative is appointed
within the time frame, the hearing shall proceed without the taxi
representative.

643.5.7       Information - inaccurate - notice to licensee
The Clerk shall notify the holder of a licence under the provisions of
this Chapter by registered mail when he/she has cause to believe on rea-
sonable grounds that any of the information which an applicant or
holder of a licence is obliged to supply is inaccurate and that, unless the
inaccuracy, non-compliance or contravention is corrected within thirty
days, the licence shall be revoked.

643.5.8      Requirements - non compliance - notice to licensee
The Clerk shall notify the holder of a licence under the provisions of
this Chapter by registered mail when he/she is advised by a law en-
forcement officer or official that the licensee is not complying with all
applicable requirements under a statute, regulation or this Chapter that,
unless the inaccuracy, non-compliance or contravention is corrected
within thirty days, the licence shall be revoked.

643.5.9      Non-compliance - licence revoked - notice
Unless the matter giving rise to the notice has been corrected within the
time allowed, the Clerk shall forthwith revoke the licence and notify
the licence holder of same by registered mail at the licence holder’s last

643.5.10     Licence fees

643.5.11 Fares
The fares to be charged by the owners or drivers of taxicabs or limou-
sines to which this Chapter applies for the conveyance of passengers ei-
ther wholly within the City limits or to any point not more than five
kilometres beyond its limits shall be exactly as shown in Schedule ‘A’.
No higher or lower amount than that contained in the said Schedule
shall be charged or payable.

643.5.12 Fares posted
The fares as set out in Schedule ‘A’ shall be placed in the taxicab visible
to the riders and no person licensed under this Chapter shall use or ex-
hibit any fare card other than that shown on Schedule ‘A’.

                             Article 6
                          ENFORCEMENT

643.6.1      Fine - for contravention
Every person who contravenes any of the provisions of this Chapter is
guilty of an offence and, upon conviction, is liable to a fine or penalty
as provided for in the Provincial Offences Act.

                           Article 7
                     REPEAL - ENACTMENT

643.7.1     By-law - previous
This Chapter repeals and replaces all previous by-laws for licensing,
regulating and governing of owners and drivers of vehicles used for
hire.

643.7.2     Effective date
This Chapter shall become effective upon the third and final reading of
the enabling by-law. By-law 8305-07, 18 January, 2007.

               Schedule ‘A’ - Tariff Charges

Effective October 12, 2004.
Zone A - Commencing at the City Limit on Bower Hill Road travelling
northwesterly to Ingersoll Road, thence northeasterly along the CPR
tracks to Devonshire Avenue, thence easterly along Devonshire Avenue
to Clarke Street North, thence southerly to James Street, thence easterly to
Springbank Avenue, thence southerly to Parkinson Road, thence westerly
to the point of commencement.

 When a passenger requests the use of a handicapped accessible vehicle, the fee shall
 be $11.00 per trip.


All of the above fares include G.S.T. Fare to be charged would be the rate
for the highest zone that is travelled.
NOTE:
Taxicab brokers may negotiate a contract for taxicab fares with corporate
entities at a rate mutually agreed upon provided the rate is not higher than
the above noted fares.
Every owner or operator of a limousine service shall be at liberty to de-
mand or receive any rate or charge as the owner or operator deems appro-
priate to charge and such rate may be determined by distance or time or on
a fixed tariff basis provided that:
 (a) the rate charged is in excess of the taxicab tariff approved
     in this Chapter;
 (b) the rate being charged is made known to the passenger(s) in
     advance of the trip; and
 (c) the minimum charge is $15.00.
