PROPERTY LEASE FOR TOURIST ACCOMMODATION (pursuant to article 1, para 2, lett. C) of law n° 431 of 9 December 1998) Tosca srl, with offices at via Andreuzzi, 12, Udine, owner of the property located in Bad Kleinkirchheim (Austria) hereinafter referred to as “Landlord”, tax code 02466800303. The lease shall be stipulated for a maximum of _____ (say:_____________________) nights, namely from ___________ to ______________. 2. The property shall be used only for tourist accommodation. 3. The total number of people staying shall be _____ ( ____________________). The tenant is aware that if there are more people than the number indicated herein, this lease contract shall cease to be valid and all payments made shall not be refunded. 4. The property shall be available from 03:00 p.m. to 06:00 p.m. on the expected date of arrival. Departure shall take place by mid-day on the departure date (as indicated in point 1 of this contract). 5. The rent shall be € ___________ (say:_______________________________), which the tenant shall pay as follows: 30% deposit € _____________ (say:_________________________) by bank draft or money order, proof of which is given in the attached copy, within 7 (seven) days from Internet or telephone booking and the balance shall be paid upon arrival and collection of the keys to the property. 6. When the tenant collects the keys, an additional amount of € 180.00 (say: one hundred and eighty/00) shall be paid as caution money, which shall be returned at the end of the lease period, after having made sure that the property, furniture, kitchen, kitchenware and any other item that is part of the property is in sound condition. 7. The tenant shall advise the landlord of any defects of problems to the property within 24 hours from collection of the keys. 8. Electrical power, water and gas are at the expense of the landlord. 9. Should the tenant cause any damage to the property and/or furnishings or should the kitchen not be left clean and tidy, expenses for repair work or cleaning shall be deducted from the caution money and/or a supplement shall be requested to cover such expenses at the time of refund. 10. At the end of the lease period, the tenant shall clean the cooker, as well as cutlery, dishes, glasses, pots and pans and any other kitchenware. The kitchen must be left as clean and tidy as it was at the start of the lease period. The same applies for the bathrooms. 11. Any cancellations or modifications must be confirmed in writing by the tenant. Moreover, for cancellations of bookings made by the tenant the following penalties, calculated on the entire amount for the lease period shall apply: a. Cancellations made more than 90 days prior to arrival: no penalty shall be applied; b. Cancellations made between the 90th and the 21st day prior to arrival: a penalty of 30% of the total amount shall be applied; c. Cancellations made between the 21st day and the day prior to arrival: a penalty of 80% of the total amount shall be applied. Should the customer, for any reason whatsoever, fail to arrive within 24 hours from the date on which the lease commences without giving any prior notice, the landlord shall be released from any commitment. 12. The landlord and the tenant mutually agree to provide their personal data to third parties to fulfil the conditions of this lease pursuant to law n° 675 of 31/12/1996. 13. To complete the documentation, Tosca srl reserves the right to request a copy of the identification document of the other guests who will be staying at the property with the tenant. These documents must be sent in a closed envelope to Tosca srl at the headed address. 14. For any other issue not contemplated for in this contract, reference to the provisions of the Italian Civil Code, and however, to the current laws on the use of leased properties shall be made. 15.
