MECHANICS LIEN TITLE (A Mechanics Lien may be filed if a vehicle has been in the business’ possession for at least 90 days, and at the owner’s consent or request work was performed or repairs made to the vehicle and payment for said services was not received.) 1. Business owner must mail a verification request to the Department of Motor Vehicles in Topeka to obtain proof of the last registered owner(s) and last known address. 2. After completing the notification and sale requirements on the attached affidavit, the business owner or successful buyer will bring the following information to the Sedgwick County Tag Office to process the title application: a. DMV’s response to verification letter. b. Itemized statement of repairs on company letterhead. c. The returned registered letter or a receipt from the Post Office indicating notice of sale was mailed to last known address of registered owner. d. Full page of newspaper ads, where applicable. e. The pink copy of an MVE-1 inspection performed by the Kansas Highway Patrol. Inspections are done at 200 N. Murdock, Monday through Friday from 8:00 a.m. to 4:30 p.m. The fee is $10.00. f. Completed odometer disclosure statement, signed by both buyer and seller. g. Completed, signed and notarized Mechanics Lien Affidavit. There are four options listed on the Affidavit. Follow the instructions given for the option that pertains to you. 3. If the owner of the business desires to retain the vehicle, a title only or a tag and title may be purchased with no sales tax charged. 4. If the vehicle is sold, the purchaser must apply for a title and tag or a nonhighway title and pay the appropriate sales tax within 30 days from the notary date of assignment. Notice should be published at least once a week for a period of three weeks successively in the county where the sale is advertised to take place. Should there be no newspaper in the county, notice shall be published in a newspaper of general circulation. (2) Verification of last registered owner. C. Vehicle owner not known. (Vehicle value does not exceeds $100.00.) (1) Notice of public sale may be given by written or printed handbills posted in 5 public places within the township or city where bailee resides or the sale is to take place. One handbill shall be posted in a conspicuous part of the bailee's place of business. (2) A copy of the posted sale notice must be attached to this affidavit. (3) Verification of last registered owner. D. Vehicle owner known, affiant chooses to retain vehicle in full satisfaction of obligation, pursuant to K.S.A. 1986 Supp. 84-9-505(2). (1) Registered mail return receipt(s) as proof of written notice to last registered owner and lienholder(s), indicating vehicle will be retained in full satisfaction of obligation. (2) No written objection received from owner or lienholder(s) within 15 days of notice being sent (if objection received, vehicle must be disposed of at public auction). (3) Verification of last registered owner. I, the undersigned, hereby certify that I am a mechanic or vehicle repair service, located and doing business in the State of Kansas at the address shown above. The vehicle listed on this affidavit has remained in my possession since the above listed date of completed repairs to the present time. The charges are of reasonable value for services performed, including the reasonable value of all materials used. Therefore, I claim a lien on said vehicle based on services, repairs, or improvements made (KSA 58-201). Notice was given that the vehicle was to be sold at public auction on the date listed. To obtain registered owner of record and lienholder information, placed an "X" by "Verification of Title" space on TR-18 Verification Request form, attached, and submit for processing to the Kansas Department of Revenue, Title and Registration Bureau, Topeka, Kansas 66626-0001. Registered mail return receipt will serve as notification proof to last registered owner and lienholder(s) disclosed on vehicle information provided by the Kansas Department of Revenue. If the verification does not indicate the vehicle was last titled and registered in Kansas, an MVE-1, Vehicle Identification Number verification form issued by the Kansas Highway Patrol, or their designee, is required.
