                                   Meeting Minutes
                             Wednesday, September 26, 2007

CALL TO ORDER/ROLL CALL/APPROVAL OF AGENDA:
Those members present and answering Roll Call were Mayor Dave Koop, Council Members
Peggy Long, Kevin McDonald, Vince Lanuza, Rosanne Shaw, Stuart Richardson and Steve
Swanson. Vince Lanuza absent. Staff members present were Town Manager Kevin
Batchelder, Attorney Jerry Dahl, Chief Joe Russell, Revenue Administrator Kathy Marshall,
Administrative Services Director Donna Braun, Recreation Director Tammy Jamieson, Public
Works Director Bill Linfield, Community Development Director Mark Leidal, Planner I Susan
Lee, Ryan Hyland Assistant to Town Manager, and Town Clerk Michele Karlin.

STAFF COMMENTS:
Linfield updated Council on construction and paving of Stephens Way.

COUNCIL COMMENTS:
Long complemented Mike Bittner and Matt Smith for receiving a perfect score from the EPA
for the 15th year in a row.
Zac Margolis reviewed the process and the fifteen years of perfect scores. This translates into
savings and credibility for the Town.

CONSENT CALENDAR:
THE CONSENT CALENDAR INCLUDING THE MINUTES FROM SEPTEMBER 12, 2007,
RESOLUTION 2007-22 AWARD OF WORKERS COMPENSATION INSURANCE,
RESOLUTION 2007 - 23 - JSA HEAT RECOVERY AND VENTILATION SYSTEM BID AWARD
WAS PASSED.

CITIZEN COMMENTS:
Marcus Winter, 137 Woodchuck, requested a reimbursement from the Town on the water line
repair in front of his house. He submitted a letter to Council to consider his request.
Koop referred Winter to Town staff.

PUBLIC PRESENTATIONS:
None

LIQUOR BOARD:
A.   7-Eleven, Inc. dba 7-Eleven Store 39033A – Request for Temporary Liquor Permit
MCDONALD MOVED TO APPROVE THE TEMPORARY LIQUOR PERMIT APPLICATION
FOR 7-ELEVEN, INC. MOTION SECONDED. MOTION PASSED BY COUNCIL PRESENT.
LANUZA ABSENT.

B.   Suncor Energy Sales, Inc. dba Phillips 66 – Renewal of 3.2% Beer Retail License
RICHARDSON MOVED TO APPROVE SUNCOR ENERGY SALES, INC. DBA PHILLIPS 66
– RENEWAL OF 3.2% BEER RETAIL LIQUOR LICENSE. MOTION SECONDED. MOTION
PASSED BY COUNCIL PRESENT. LANUZA ABSENT.

PUBLIC HEARINGS:
A.     Ordinance 2007 -11 - Willow Grove Pond Fishing Regulations – Second Reading
Public hearing opened.
Tammy Jamieson Recreation & Culture Director presented Ordinance 2007-11 on second
reading for Council’s consideration. She reviewed her staff memo dated 9-17-07 and
requested approval.
No members of the public were present to testify.
Richardson asked about the south pond and who owns it. Can we regulate that too?
Staff stated we own half of the south pond shoreline. The south pond has never been stocked
and not subject to regulations.
Public hearing closed.
SWANSON MOVED TO APPROVE ORDINANCE 2007-11 ON SECOND READING, AN
ORDINANCE REGULATING FISHING ON WILLOW GROVE OPEN SPACE POND.
MOTION PASSED BY COUNCIL PRESENT. LANUZA ABSENT.

B.     Ordinance 2007-13 - Comcast Franchise Extension, Second Reading
Public hearing opened,
Ryan Hyland, Assistant to the Town Manager, Presented Ordinance 2007-13 on second
reading for Council’s consideration. He reviewed his 9-18-07 staff report and requested
approval.
No members of the public were present to testify.
Public hearing closed.
SHAW MOVED TO APPROVE ON SECOND READING ORDINANCE 2007-13 AN
ORDINANCE AUTHORIZING AN EXTENSION AND AMENDMENTS TO THE FRANCHISE
AGREEMENT BETWEEN THE TOWN OF SILVERTHORNE AND COMCAST OF
COLOARDO V, LLC. MOTION PASSED BY COUNCIL PRESENT. LANUZA ABSENT.

C.     Ordinance 2007-15 - Customer Service Standards Governing Cable Television,
       Second Reading
Public hearing opened.
Ryan Hyland, Assistant to the Town Manager, Presented Ordinance 2007-15 on second
reading for Council’s consideration. He reviewed his 9-18-07 staff report and requested
approval.
Richardson asked if there is a local number to contact for service.
Hyland stated there are customer service phone numbers provided.
No members of the public were present to testify.

RICHARDSON MOVED TO APPROVE ON SECOND READING ORDINANCE 2007-15 AN
ORDINANCE REPEALING AND REENACTING CUSTOMER SERVICE STANDARDS
GOVERNING CABLE TELEVISION OPERATORS IN THE TOWN OF SILVERTHORNE.
MOTION PASSED BY COUNCIL PRESENT. LANUZA ABSENT.

Susan Lee. Planner I presented Ordinance 2007-16 to Council for consideration on first reading.
She reviewed her staff reported dated 9-19-07 and requested approval. The Town Attorney has
suggested using today’s date to define a cutoff date for existing non conforming light fixtures.
Richardson asked about municipal compliance.
Staff stated most municipal buildings are under commercial zoning.
McDonald asked about height requirements.
Staff will address wording changes to the compliance section for clarity.
McDonald asked if there are any businesses currently looking to change their fixtures.
Leidal stated there not a lot of businesses out of compliance. Once this ordinance is in place
there will be an effort to education our citizens.
MCDONALD MOVED TO APPROVE ORDINANCE 2007-16 AN ORDINANCE AMENDING
CHAPTER 4, ARTICLE VI, SECTION 4-6-16(i) CONCERNING LIGHTING STANDARDS ON FIRST
READING, WITH THE TWO AMENDMENTS AS OUTLINED BY STAFF. MOTION PASSED BY
COUNCIL PRESENT. LANUZA ABSENT.

B.      Ordinance 2007-17, An Ordinance Amending the Silverthorne Town Code Sections 4-11-
168 and 4-11-169, Concerning Nuisances, First Reading
Gerald Dahl, Town Attorney, presented Ordinance 2007-17 for Council’s consideration. He reviewed his
staff report and ordinance and requested approval on first reading.
Shaw stated the old ordinance is poorly written. She reviewed the language in Section 1 and requested
some clarification.
Dahl reviewed the proposed wording changes.
Long asked if we are over regulating, are we clustering up the nuisance section of the Code
Book with weed and tree issues.
Dahl reviewed the nuisance process in the Code Book. He discussed different options for
placement.
Long asked staff to review the ordinance and current Town Code and make it flow smoothly.
SHAW MOVED TO APPROVE ORDINANCE 2007-17 AN ORDINANCE AMENDING TOWN
CODE SECTIONS 4-11-168 AND 4-11-169 AND ENACTING NEW SECTION 4-11-170
CONCERNING NUISANCES ON FIRST READING WITH AMENDMENTS DESCRIBED BY
THE TOWN ATTORNEY. MOTION PASSED BY COUNCIL PRESENT. LANUZA ABSENT.

C.      Ordinance 2007-14, An Ordinance to Authorize Sales Tax Vendors to use the
Colorado Department of Revenue Address Database – First Reading
Kathy Marshall, Revenue Administrator Presented Ordinance 2007-14 to Council for their
consideration on first reading. She reviewed the staff report and requested approval.
McDonald asked how the Town finds out about errors in sales tax reporting.
Marshall stated we only know of errors by conducting audits.
Koop asked Marshall if she has confidence in the data base.
Marshall stated she does because it reviewed periodically.
Richardson asked about sales tax collection when items are sent to PO boxes vs. physical
addresses.
Marshall stated merchandise delivered by common carrier is not charged Silverthorne sales
tax.
Koop asked if this will make it easier for staff.
Staff feels it will.
Long how do vendors access this information?
Marshall stated there are two vendors currently that offer the data base and in the future it
could be accessed by the Town’s website.

LONG MOVED TO APPROVE ORDINANCE 2007-14 AN ORDINANCE AMENDING THE
SILVERTHORNE TOWN CODE, CHAPTER ONE, ARTICLE TEN, SECTION 1-10-87 TO
AUTHORIZE VENDORS USE OF AN ELECTRONIC DATABASE CERTIFIED BY THE
STATE DEPARTMENT OF REVENUE ON FIRST READING. MOTION PASSED BY
COUNCIL PRESENT. LANUZA ABSENT.

SWANSON MOVED TO GO INTO EXECUTIVE SESSION AT 7:06 FOR A CONFERENCE
WITH THE TOWN ATTORNEY, TOWN MANAGER AND APPROPRIATE STAFF UNDER
CHARTER SECTION 4.13(c ) AND SECTION 24-6-402(4) (e), C.R.S. SPECIFICALLY TO
INSTRUCT NEGOTIATORS CONCERNING THE SOUTH MARYLAND CREEK RANCH
ANNEXATION AGREEMENT.

SWANSON FURTHER MOVED TO ADJOURN THE COUNCIL MEETING AT THE
CONCLUSION OF THE EXECUTIVE SESSION. MOTION SECONDED. MOTION PASSED
BY COUNCIL PRESENT. (LANUZA ABSENT)
