VUKOVAR DECLARATION

									                                 "VUKOVAR DECLARATION"
We, participants at a public forum organised by the Centre for Peace, Legal Advice and
Psychosocial Help - Vukovar on the 13th June 2002 in Bobota, adopt the following document

With regard to:
           Constitution of the Republic of Croatia.
           Constitutional Law on Human Rights and Freedoms, Article 1 and Article 2 lj.(m)
           Universal Declaration on Human Rights.
           Document on Acceptance of Conditions for Admission to the Council of Europe, signed by the
            President of the Republic of Croatia and the President of the Croatian Parliament.
           Opinion of the Council of Europe 195 (1996) on the occasion of the admission of the Republic of
            Croatia to Council of Europe.
           Resolution 1089 (1996) and 1096 (1996) of the Council of Europe.
           European convention on human rights.
           European Social Charter;

We accept and support in its entirety:

           Declaration on the Restoration and Protection of Ownership, 6th and 7th November 2000.
           Zagreb Declaration, 4th and 5th December 2000.
           Initiative for penalisation of all activity with direct or indirect violation of the Constitution on the
            basis of Article 20 of the Constitution.

We request:
       1. Natural restitution in its entirety of forcibly dispossessed, legally acquired property, i.e. return of
            adequate property of equal value, or in accordance with an agreement, payment of its market value
            in cash or first-class securities, within a reasonable period.
       2. Revision of the Laws and by-laws, contrary to Article 2 of the Constitutional Law for Enforcement
            of the Constitution of the Republic of Croatia NN 56/90,.....
       3. Revision of the Laws and by-laws, contrary to the Constitution of the Republic of Croatia NN
            56/90,....
       4. Right of everyone to submit a claim for revision of the Ruling and/or any other legal act, court
            ruling etc, and in connection with the application of unconstitutional legal provisions and/or by-
            laws, with regard to Items 1 and 2.
       5    Official announcement in the Official Gazette of the Republic of Croatia of the original text of the
            institute on human rights according to Article 1 of the Constitutional Law on Human Rights....,
            European Social Charter, etc, by which the Republic of Croatia assumed international obligation.
       5. Exemption from payment of all legal expenses with regard to the realisation of right under Item 1.

Finally, we wish to point out that,
            Since 3lst December 1997 the Constitution of the Republic of Croatia has been in force without
             any restriction and that it is counter-constitutional any application of the provisions of the
             Constitution, laws and by-laws of the Socialist Federal Republic of Yugoslavia (SFRJ)/ Socialist
             Republic of Croatia (SRH), legal provisions and legal acts which refer to the constitutional-judicial
             system of the Republic of Croatia, of non-existent institutions and judicial categories, which are
             not in agreement with the Constitution, i.e. the constitutional-judicial system of the Republic of
             Croatia, as cited in the introduction.
            The constitutional law for enforcement of the Constitution of the Republic of Croatia NN ../01 can
             refer exclusively to new provisions introduced with the alteration of the Constitution of the
             Republic of Croatia NN../01.

The Centre for Peace, Legal Advice and Psychosocial Help - Vukovar and SUVLAH - Zagreb, are authorised to
forward this document to the President of the Republic of Croatia, presidents of legislative, executive and
juridical authorities, and competent bodies of government administration.
