framework contract. The framework contract shall be extended under the same terms and conditions. In any case, extension does not imply any modification or deferment of existing obligations. II.1.5) Short description of the contract or purchase(s): The scope of this procurement procedure is the provision of live plants and planters in leasing — including related services — as specified in section B.1.2 of the tender specifications. Types of plants and their requirements: Eurojust require a variety of live indoor foliage plants in various sizes within a range of 160–250 cm height. Each plant shall have a name tag with its botanical name. Types of planters and their requirements: Eurojust require a variety of planters suitable to the sizes of the plants described in section B.1.2.1 of the tender specifications. The range of planters can include, but not be limited to: — stainless steel planters, — artificial range of planters, — aluminium range of planters, — ceramic planters, — stone planters. All planters are to be provided on wheels which are hidden from view. Core services and their requirements: Eurojust require an all-inclusive lease service package, covering at least the following services: delivery and installation, maintenance services, storage facility service, quality assurance service, and customer service policy. Flexibility requirement: during the implementation of the contract, the tenderer shall be able — at any moment — to meet Eurojust's requests for (a) changing type of plants and/or model of planters already leased to Eurojust, and (b) changing the style of the displays (e.g. composition of plants, decoration in the planter, etc.). Division into lots: No. Variants will be accepted: No. Quantity or scope of the contract Total quantity or scope: Eurojust intends to award a framework contract for the lease of live plants in planters — including related services — for its current premises (Haagse Arc) and for a satellite building which is currently under construction (Haagse Veste). The satellite building is expected to be completed, furnished and ready for occupancy by approximately 100 Eurojust staff in November 2008. At present Eurojust has a lease and maintenance contract for 120 plants in the Haagse Arc: — 33 single plants of 180 cm height, — 80 single plants of 170 cm height, — 7 single plants of 160 cm height. Under the new contract Eurojust expect to lease approximately 160 plants between its 2 buildings: 120 plants for the Haagse Arc building — they will replace the current plants — and 40 plants for the Haagse Veste I building. The envisioned duration of the resulting service contract is 4 years. The tenderer shall provide — in original — a declaration on honour drawn up according to the template found in Annex D of the tender specifications, dated and duly signed by the legal representative of the tenderer. Conditions for participation Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers: Information and formalities necessary for evaluating if requirements are met: Documents to be provided: — a certificate of registration in the relevant trade or professional registers in the country of establishment/ incorporation. If the tenderer is not required or allowed to register in such a register for reasons related to its statute or legal status, Eurojust shall accept, as satisfactory evidence, a sworn declaration or certificate, membership of a specific organisation, express authorisation, or entry in the VAT register. Economic and financial capacity: Information and formalities necessary for evaluating if requirements are met: Documents to be provided: — balance sheets and economic outturn (profit and loss) statements covering at least the last 2 years for which accounts have been closed, — the financial capacity form (Annex E of the tender specifications) duly filled in and signed by a legal representative of the tenderer. Minimum level(s) of standards possibly required: The tenderer must prove that he is in a stable financial position and he has the financial capacity to provide the required supplies and services. Technical capacity: Information and formalities necessary for evaluating if requirements are met: Documents to be provided: — a brief history of the company, including length of time in business, overall size and description of activities relating to the services and supplies of the type required in these tender specifications, — a list of the main contracts achieved in the past 2 years specifying the value, dates and recipients of the services and supplies provided, covering the same kind as requested in the tender specifications. Minimum level(s) of standards possibly required: The tenderer must prove that he has a minimum experience of at least 2 years in providing the supplies and services as stated in the tender specifications.
