                        NOTICE OF PUBLIC AUCTION
                               BY SEALED BID
                       EXCHANGE LE-0403, 70.54+/- acres

                                  Torrance County, New Mexico

       In response to a proposal submitted pursuant to Rule 19.2.21 NMAC to exchange land for
the purpose of building a crosswinds airport runway, the Commissioner of Public Lands
(“Commissioner”) gives notice that pursuant to the New Mexico Enabling Act (36 Stat. 557),
NMSA Sections 19-7-1 and 19-7-2, and the auction process described in this Notice, he is offering
to exchange state trust land for other land, or a combination of land and cash. The exchange will be
conducted by sealed bid as set forth in the Bid Information Packet described below. The state trust
land being offered (the “Land”) is located just East of Moriarty, New Mexico, and further described

       Pt. SE¼SW¼ (±0.29 acres) and Pt. SW¼SW¼ (± 9.35 acres) of Section 21, Pt.
       NW1/4NW1/4 (± 10.20 acres), Pt. SW1/4NW1/4 (± 25.77 acres) of Section 28, Pt.
       NW1/4NW1/4 (± 24.93 acres) of Section 33, Township 9 North, Range 9 East,
       N.M.P.M., Torrance County, New Mexico, containing 70.54 acres, more or less,

       as more particularly described in the Bid Information Packet discussed below.

1. The Land is offered “AS IS”; the Commissioner does not make any representations or provide
any warranties regarding title to the Land or its condition or fitness for any purpose. The Land is
offered as a single tract; bids for less than the entire tract will not be considered. The Commissioner
reserves the right to reject all bids submitted.

2. Details of this offer, applicable rules, bidding instructions and forms are set forth in the Bid
Information Packet, which can be obtained by writing the State Land Office, P.O. Box 1148, Santa
Fe, NM 87504, Attention: Tisa Gabriel, Project Manager (505-827-5094), in person at 310 Old
Santa Fe Trail, Santa Fe, NM 87501 or by e-mail to The Bid Information
Packet is part of this Notice and is incorporated herein by reference. The Packet should be
reviewed in detail before submitting a bid.

3. The Minimum Bid is $148,200.00. The land offered in exchange must have appraised value
equal to or greater than this minimum bid set for the Land.

4. Bids must be accompanied by the Transaction Deposit in the amounts set forth below. Deposits
must be in the form specified in the Bid Information Packet. Failure to include the required
Deposits will result in disqualification. The successful bidder will be required to pay all other costs
associated with the transaction. Except for the non-refundable $500 Exchange Proposal Fee, the
Transaction Deposits of unsuccessful bidders will be refunded. See Bid Information Packet for
additional information and requirements regarding the required Transaction Deposit.

5. Transfer of the Land will be subject to all valid easements and other encumbrances (collectively,
“encumbrances”) shown in the records of the State Land Office and the Torrance County Clerk’s
Office. Bidders are responsible for verifying encumbrances and their effect on the Land.

6. The Land will be conveyed by a single patent, reserving to the State all minerals of whatsoever
kind, geothermal resources, and certain water rights, together with rights of access and surface use
necessary for or incident to exploration for and extraction and removal of such minerals, geothermal
resources, and water rights.

7. Bids, made in strict conformity with the requirements set out in the Bid Information Packet,
must be submitted in a sealed package marked “Land Exchange LE-0403” and addressed to the
Commissioner, c/o Dennis Garcia, Deputy Commissioner, at the State Land Office address provided
above by 4:00 p.m. on December 11, 2008
