We recently received a report and verified on June 23, 2008 that your property is in violation of the Portland Zoning Code. Please review your options for correcting the zoning violation(s) and call me, Michelle Seward, at 503-823-0623 to discuss resolution of your case. CITED VIOLATION(S): 1. 1Violation: Conditions of approval and exhibits from LU 02-157573 DZ have not been met for the OHSU . Patient Care Facility) Kohler Pavillion. (Portland Zoning Code Section 33.700.005)1 Correction of violation: a. Install the bike gutters from the 7th floor terrace to Sam Jackson Park Road as required by exhibit C.11. The bike gutters have not been installed down the stairs to Sam Jackson Park Road. See enclosed exhibit. b. Provide screening for the garage lighting so the lights cannot be seen from Terwilliger as required by Exhibit C.36. See LU 02-157573 DZ, decision page 24 for findings for C1 and C2. c. Provide documentation that the Transportation Development Matrix is being met as required by Exhibit G.35 by installing directional signs that meet T7 and developing a freight/service access and circulation plan that meets T8. See attached Transportation Development Matrix. d. Provide documentation that the Campus Drive Access Limitations are met in accordance with Exhibit C.69. See enclosed exhibit. Provide the additional plantings that are required by the Technical Memo E-zone mitigation and monitoring report from January 11, 2008 for the plantings that have died. Violations - It is unlawful to violate any provisions of the Portland Zoning Code, a land use decision, or conditions of a land use approval. This applies to any person undertaking a development or land division, to the proprietor of a use or development, or to the owner of the land underlying the development or land division. Portland Zoning Code Section 33.700.030 1 Page 2 of 3 3181 SW SAM JACKSON PARK RD July 2, 2008 ENFORCEMENT PENALTIES IMPORTANT Portland City Code Chapter 3.30 directs the Bureau of Development Services to impose civil penalties for noncompliance (unless violation(s) are corrected before reinspection). Enforcement penalties are assessed each month as follows: 1) Monthly enforcement penalties:  $90.00 1 – 2 dwelling units  $195.00 3 – 10 dwelling units  $300.00 11- 19 dwelling units  $450.00 20 or more dwelling units  $450.00 Residential Properties with Any Non-Residential Use  $450.00 Properties With Only Non-Residential use 2) A 10% Auditor's fee and other Auditor’s charges are added to the monthly enforcement penalty. 3) Doubling of monthly enforcement penalties if violations(s) are not corrected within six (6) months from the initial notice of violation. 4) $265.00 additional penalty will be imposed if a code enforcement proceeding is initiated before the Code Hearings Officer. 5) Hearings Officer may impose fines levied up to $1,000.00 per day of violation per City Code 22.05.010. NOTE: The above penalties are made a lien against the property. Penalties will continue until the violation(s) are corrected, a reinspection is requested and city staff verifies correction of cited violations. Page 3 of 3
