CONTRACT of borrowing
concluded in accordance with paragraph no. 659 and the following of the Civil code

Jiří Jirka, on one side and
concluded this contract:
I. Subject of the contract
1. The lender has the ownership and disposition right to a plastic chip non-contact identification card (hereinafter the ”identification card” or ”IC”). This IC is provided with personal data of the borrower and the logo of the Palacky University (UP), thus becoming a student’s identification card (hereinafter PS). The lender provides this IC to the borrower for the reason of his personal identification and making use of the services supplied within a uniform identification system in the facilities and other premises of the lender. When furnishing services by the Library of IC UP, the lender undertakes to provide the borrower with documents in form of electronic borrowing service under the conditions stated by the Borrowing regulations. The borrower declares that he/she considers the electronic borrowing system evidence as binding and is responsible for any losses recorded in the evidence. The borrower can be acquitted of the obligation mentioned in the previous sentence only if he/she proves a mistake in the mentioned electronic system. The borrower can be a student of UP, employee of UP, or another person who has a contractual or other similar relation to UP. Lending of the IC (PS, PZ) to the borrower is free of charge, with the condition of making a deposit of 200.- CZK. This deposit will be used to cover partially the harm that could be suffered by the lender when the IC (PS, PZ) is stolen, destroyed, damaged or not returned. When the IC (Ps, PZ) is properly returned, the deposit will be returned to the borrower in full, when ISIC student’s identification card is concerned, the deposit will be reduced by the price of first validation token. By a proper returning, it is understood that the identification card is returned functioning, in a proper condition, with the grade of wear resulting from an ordinary use. The borrower pays the deposit prior to signing this contract in the treasury of UP, by a postal money-order or to the account of UP; the number of the account can be obtained from IC-CVT UP (Information Center- Center of. Computing Technology). Upon signing the contract, the borrower will prove payment of the deposit by presenting relevant proof of payment.

II. Period of borrowing
1. The identification card specified in the previous article is borrowed by the borrower from the lender under the conditions specified below, for the determined period which is specified as follows: to the ”borrower – student” for the time of his/her studies at UP. By an end of the borrowing period, for this purpose, it is understood a completion or interruption of the studies at UP, to the ”borrower – employee” for the time of duration of his/her work engagement at UP. By an end of the borrowing period, for this purpose, it is understood a date of termination of the work engagement by an agreement, notice or within a trail period, or the day when the decision of an immediate cancellation of the work engagement becomes valid, to the ”borrower – others” for the time of contracted relation or other agreement with the lender. The borrower – student can return the IC within 14 days after termination of the studies and in case he/she fails to do so, he/she will not receive back the deposit, see article II. paragraph 4 of this contract. The borrower (employees and others) is obliged to return the IC within 3 days after the lapse of the period of borrowing specified in the above-mentioned cases and if he/she fails to do so, a provision of article II. paragraph 4 of this contract will be enforced. The place of rendering the IC is the workplace of the IC-CVT department of the lender.

III. Conducting the subject of the contract

The lender is obliged to introduce the IC into the Uniform Information System (JIS) system within 24 hours after the issue of the IC and to ensure its functionality in a given system of provided services. The borrower is responsible for the entrusted IC, which he/she will use only for the purposes set by this contract in accordance with the enclosed directions and he/she will take proper care of the IC as of any other important personal document for the entire period of borrowing.

The ways of handling and maintenance of the IC are stated in the enclosed directions, which were read by the borrower, who agrees to follow these directions. The borrower is aware that he/she is not allowed to manipulate with the IC in any other way than stated in the directions. If any such manipulation is proven, it will be considered as intentional damage and misuse of the uniform identification system of the lender, who is in such case authorised to request an immediate return of the IC and to draw other legal consequences. If the IC is lost, stolen, damaged or if it loses its functionality during the period of borrowing, the borrower is obliged to report this event to the IC-CVT department of the lender immediately. This does not reduce the lender’s right for compensation of the harm. If a certain borrower reports repeated losses of the IC, or repeated or intentional damage is recorded, the lender reserves the right to exclude this borrower from the JIS system. If the IC loses during the period of borrowing its functionality spontaneously, without apparent or provable misdeed of the borrower, the lender will replace a new IC immediately, without any obligation to make further deposit, by means of the IC-CVT department. However, in disputable cases, the lender reserves the right to his own technical judgement of the cause of non-functioning of the IC and if it is found that the loss of functionality was caused intentionally or by negligence of the borrower, this IC is considered as destroyed and the deposit forfeits to the account of the lender. The lender undertakes to block the functionality of the IC within 24 hours after it is reported by the borrower as lost or stolen.

IV. Other provisions
1. It is expressively stipulated that in case the IC is lost or damaged by improper manipulation or in case the IC is stolen, the deposit made by the borrower forfeits in full to the account of the lender. This does not reduce the lender’s right for full compensation of the damage. The borrower is aware of the necessity to make a new deposit of 200.- CZK when another IC has to be issued for the reasons mentioned in the previous point. The borrower undertakes to store and handle the lent IC in such way as to prevent if from being stolen, damaged or misused by a third person. If this obligation is not fulfilled, the borrower is fully responsible for the arisen damage and bears further possible legal consequences. By signing this contract the borrower certifies that he/she was made aware of the function, purpose and the way of using the entrusted IC. The borrower certifies that on this day, he/she received the IC from the lender in a proper condition.

V. Final provisions
1. 2. 3. 4. 5. Legal relationships that are not expressively stated in this contract are subject to the corresponding provisions of the Civil code. The directions for the use and maintenance of a non-contact IC form an inseparable part of this contract and will be handed over on signing the contract. This contract is drawn in 2 copies of equal validity, where each contracting party receives one copy. This contract comes into force on the day of signing by both contracting parties. Salary deductions agreement
The above mentioned, lender and borrower, have within the contract of borrowing agreed as follows: The borrower – employee agrees to pay for his/her meals in the board system in form of salary deductions, for a given calendar month in the amount computed by a given system. Both parties identically declare that they consider the data computed by the board system as binding. Directions for the use and maintenance of a non-contact chip identification card for a uniform identification system (JIS) at Palacky University in Olomouc Description of the identification card A non-contact identification card is made of high-quality PET/PVC materials and it more than sufficiently meets the mechanical, chemical and thermal conditions during its ordinary use. This identification card (hereinafter the IC) operates on the principle of radio-frequency non-contact communication with a scanner. The IC has standard dimensions of 54 x 86 mm. The IC contains a built-in microchip with an antennae, that ensures communication, authentication and transfer of necessary data when the IC is inserted into the electric field of the scanner. The microchip also sufficiently ensures the security of the transferred authorization data. The surface of the IC is imprinted with the user’s personal data and bears a logo of Komerční banka. The technology of imprinting and lamination ensures sufficient resistance against normal mechanical wear. The imprint and the card sustain ordinary cleaning and washing agents. Use and maintenance Your identification card is designed using modern high-tech technologies that ensure its high dependability and security. By inserting the card into the scanning field of the JIS scanner within the distance of approximately 10 to 50 mm from its surface, a short mutual communication between the card and the sensor is performed. It is recommended that you insert your IC into the scanning field in such way that the two surfaces are approximately parallel. The identification area of the scanner field is always clearly marked by a red arrow indicating the area where the IC is to be placed. The communication is raised and the IC is verified within a short time (approximately 0,5 to 1 second), which is documented by acoustic or optical confirmation on the scanner. The card is then removed from the scanning field. It is recommended to perform the placement of the IC into the scanning field by a quick, not slow, motion. If the verification is not completed, it is necessary to take the IC out of the scanning field and insert it again. The identification card is destined for various services and personal identification. The user is therefore obliged in his/her own interest to handle this card carefully, in the same way as any other similar identification document. Do not expose your IC to extreme thermal and mechanical wear. In order to ensure trouble-free functionality of the IC, it is explicitly forbidden to bend or break, drill, grind, cut or otherwise depreciate the card unnecessarily or intentionally. Also, do not expose the card to an influence of other aggressive environments (long-term or excessive amounts of microwave, ultraviolet, heat or radiation radiating emissions or intensive electromagnetic field). Breaching of these principles will result not only in loss of functionality of the IC but also in ending of the guarantee conditions in accordance with the contract. Damage of the IC in such way can be proven and will therefore be considered as intentional. A polluted card can be cleaned and washed by hot water using ordinary detergent or washing agents, that is such agents, that are commonly used for cleaning similar materials. Problems and complaints If you have any problems with the IC within any established subsystem, or if the card seems not to function, please, contact the CVT UP department. In case the card is lost, stolen or misused, contact immediately the CVT department of UP Olomouc. Uniform identification system JIS at UP User’s instructions
Palacky University is introducing the uniform identification system JIS within an information system IS. The system’ s users are students and employees of UP. The users will receive an identification card (IC) with an imprint, equipped with a non-contact electronic chip. This card will contain name and surname, birth identification number and the user’s photograph. The IC can be used by the user for various services within UP. These include mainly registration during boarding and accommodation in the facilities of SKM, borrowing services of the UP library, admission to specified rooms and buildings of UP. These services will be gradually extended. UP guarantees the protection of users’ personal data that are recorded in the enclosed application form in accordance with the law no. 256/1992 of the Collection of Laws in its valid version.
