hereafter referred to as "the Company" Represented by xxx tel. /fax : The following agreement is concluded, laying down the relations between the parties just as their respective rights and obligations regarding their participation in the placement/exchange programme, as per decision of the Council no. 94/819 EG and according to the contract of the Contractor. 1) THE OBJECTIVE OF THE CONTRACT: This agreement is between Western Norway TP, the university, the company and the student regarding the practical placement, which the student/graduate agrees to follow in the company, - in accordance with the EU guidelines in the framework of the Leonardo da Vinci programme, for a period of xxx(xxxx) months starting from 00/00/2001. 2) THE OBLIGATIONS OF THE STUDENT: The Student undertakes to: • duly perform the placement which is the objective of the present contract; • make and deliver to WNTP - a final report on the placement within a period of 4 weeks (one month) after the completion of the placement, - according to terms of Contract between Leonardo da Vinci Norge NA and Western Norway TP; • not benefit simultaneously from other grants of the Commission of the European Communities; • conform to the rules of the Company and the directives given by its management; • refrain from divulging any information on the Company or its activities without prior written authorisation;
The student must • provide an internationally valid health and accident insurance for the whole duration of her/his stay abroad. (European international health form), • ensure that he/she is covered by private/group insurance for leisure time activities in the host country, • provide an insurance that protects third parties against damages,. 1/3
In the case whereby the Student does not or is unable to satisfy the above undertakings, He/She formally engages him/herself to reimburse Western Norway TP the total sum of money received. 3) THE OBLIGATIONS OF THE UNIVERSITY (Sending organisation) : The University will (if necessary) : • assure the monitoring and evaluation of the placement. This will be carried out by xxx deliver an academic recognition (if appropriate) of the placement and send a copy to WNTP.
4) THE OBLIGATIONS OF THE COMPANY: The Company agrees to: • receive and welcome the Student for the LEONARDO placement which is the objective of the present contract; • provide the Student with all possible help and assistance to carry out a successful LEONARDO placement; • provide the Student with appropriate work insurance as required by local legislation; • deliver to the student two copies of a certificate indicating the nature and the duration of the placement, indicating the starting and finishing dates; • provide a short report on the placement according to terms of Contract between Leonardo da Vinci Norge and Western Norway TP; • pay the student a scholarship /an allowance of NOK................. on a monthly basis. Any additional benefits, bonuses and reimbursements for expenses to the Student are at the sole discretion of the Company.
5) THE OBLIGATION OF WESTERN NORWAY TP: • provide the Student with a LEONARDO placement in ................., relevant to the educational background of the Student. • provide the Student with all possible help and assistance in to carry out a successful LEONARDO placement; • pay the Student, with help of the Commission of the European Union, a LEONARDO grant consisting of: - travel allowance of 000,- EURO, (NOK 0000,-), which is a one time payment, - subsistence cost of 000,- EURO (0000,- NOK) per month during the placement; - allowance for language/cultural praparation (upon proof) In addition WNTP will give the Student all logistic assistance within its capabilities. 6) LIABILITIES. Western Norway TP and the University decline all responsibilities regarding social and fiscal liabilities and any other detrimental eventualities which may occur throughout the LEONARDO -placement, whether they arise in the sending or the receiving country. 7) TERMINATION OF THE AGREEMENT

In case of non-fulfilment of the contractual obligations, this agreement can be cancelled by either contracting party, regardless of the consequences provided for him by current law. In such case, the contractor may terminate the agreement with full right and without having to observe any other legal formalities, after having sent to the parties a written exhortation by registered mail to which no appropriate reply has been given within a period of one month.
If the student/graduate terminates the practical training before its official end, or if he/she fails to follow it in accordance with the LEONARDO criteria (see paragraph 2), he/she will have to pay back the total amount of the financial support. In case of termination happening through no fault of his/her own (disease, breach of contract by the foreign employer), the remaining amount of the supportive funds will have to be refunded immediately, with the months completed up to the point of termination being taken into account. The student/graduate must inform the contracting parties without delay. 8) RESPONSIBILITY Each of the contracting parties discharges the other party from any responsibility of civil liability in case of damages, which the contracting party or their staff incur as a result of the execution of this agreement, unless such damages are not due to a serious and intentional fault on the part of the other contracting party or its staff. The Contractor will protect the European Commission, the NA and their staff from any actions for damages claimed in connection with those injuries which third parties (including the project staff) might incur in the framework of the execution of this agreement, unless those injuries are due to a severe and deliberate fault on the part of one of the parties, the Commmission, the NA and their staff. 9) COURT OF JURISDICTION Where an amicable solution cannot be found, the Court of Bergen shall have the sole jurisdiction in any dispute between the contracting parties concerning this agreement. The laws applicable to the present agreement are the laws of Norway, 10) ADMINISTRATION/MONITORING AND AMENDMENTS AND ADDENDA TO THE AGREEMENT All correspondence on the performance of this agreement should be addressed to the signatories, and where necessary to the NA of the Promoter/Contracter Any modifications of this contract must be compatible with the LEONARDO Manual of Procedures, the LEONARDO Contract No. N/02/A/STU/58 , and has to be agreed in writing between all parties.
