AUCTION CONSIGNMENT CONTRACT
This consignment agreement is between the “Owner” listed below and Affordable eBay Sales acting as an eBay “Trading Assistant”. eBay Trading Assistants are not employees, consultants, or independent contractors of eBay Inc. By affixing Owner’s signature to this contract, Owner agrees to all terms and conditions and fully understands the consignment services as offered by the Trading Assistant. Owner is consigning items to the Trading Assistant to sell at auction on the online website eBay. Details of each individual item auction are outlined and signed for on the Item Detail form. Owner agrees that they have truthfully and accurately described the condition, relevant information, and history of their consignments on the Item Detail form. Owner agrees to pay any and all fees to the Trading Assistant as outlined in the Fee Schedule. Owner attests that none of the items consigned were obtained illegally and that Owner has full rights of ownership or assignment of consignment items. Although most items sold on eBay generate a fair market value, Owner may not receive this amount for any items being offered at auction. Auctions on eBay are legally binding contracts. Trading Assistant and Owner are obligated to complete the transaction by selling to the highest Bidder despite the closing price of an auction. Should the Buyer fail to pay or meet the auction’s terms and conditions, or if Buyer cannot be legitimately confirmed, then Trading Assistant may choose to not sell to this Buyer. In the event Owner sells their consigned items during the course of the auction, Owner agrees to pay Trading Assistant a stop auction fee of $25.00 for each occurrence. eBay forbids Shill bidding. Owner cannot bid on their own item in order to raise the price of their auction. In the event that this happens, Trading Assistant will first ask the Owner to withdraw their bids. If owner does not comply, then auction will be stopped and a stop auction fee of $25.00 will be levied against the owner for each occurrence. There will be many questions from Bidders during the course of the auction. The Trading Assistant will field most questions. Upon occasion, there will be some questions the Trading Assistant will be unable to answer. Owner is obligated to respond to any questions via the Trading Assistant within 24 hours. Failure to respond in a timely manner may result in a lower auction closing price. Trading Assistant will compensate Owner for items, which are lost, stolen, or damaged while in Trading Assistant’s possession, only to the extent that Owner's insurance does not cover. The liability to the Trading Assistant is limited to the current market value that is determined by comparable items that have sold on eBay inc. within the last 120 days. In the rare event that fraudulent payments are received from a Buyer, Owner is aware that they may not receive payment for their consignment item or the return of their consignment item. Owner agrees to reimburse Trading Assistant should discovery of this event happen subsequently of payment to Owner. Forms of fraudulent payment include but are not limited to non-sufficient funds, false credit card charges, stolen checks, and fake money orders or bank checks. We take many precautionary measures to ensure that this event will not happen. If any items do not sell after the second listing, Owner agrees to pick up any unsold items within write number (10) days of auction end, and is aware that after which time storage charges will accrue at a rate of $3.00 per day per item. Any items not picked up after write number (30) days, Owner agrees to surrender all ownership rights of the consigned item and is aware that it will be donated to charity with no additional authorization from Owner.

THE SERVICES PROVIDED UNDER THIS AGREEMENT ARE PROVIDED AS IS AND WITHOUT WARRANTY. Affordable Ebay Sales (Robby Lewis) IS NOT LIABLE FOR ANY DAMAGES THAT MAY ARISE FROM OR IN CONNECTION WITH THIS AGREEMENT, THE PERFORMANCE OF THIS AGREEMENT OR THE CONSIGNMENT OF YOUR ITEMS. THE LAWS OF California WILL GOVERN THIS AGREEMENT, WITHOUT REFERENCE TO RULES GOVERNING CHOICE OF LAWS. ANY ACTION RELATING TO THIS AGREEMENT MUST BE BROUGHT IN THE STATE OR FEDERAL COURTS LOCATED IN THE STATE OF California, AND YOU IRREVOCABLY AND YOU CONSENT TO THE PERSONAL AND SUBJECT MATTER JURISDICTION OF SUCH COURTS. YOU MAY NOT ASSIGN THIS AGREEMENT, BY OPERATION OF LAW OR OTHERWISE, WITHOUT OUR PRIOR WRITTEN CONSENT. THIS IS THE COMPLETE AGREEMENT OF THE PARTIES. THERE ARE NO ORAL TERMS.
