					                              MINUTES OF A MEETING
                OF THE ST. LOUIS COUNTY CIVIL SERVICE COMMISSION
                            TUESDAY, OCTOBER 21, 2003


A meeting of the Civil Service Commission was held on Tuesday, October 21, 2003 in the 8 th
Floor Conference Room, beginning at 7:30 a.m. Present for the meeting was Ms. Lillie M.
Thomas, Chairman; Ms. Kathy L. Gibala, Vice Chairman; and Mr. Mitchell A. Margo, Member.
Present from the Division of Personnel were Kirk McCarley, Personnel Director; Fannie Lindo,
Ruth Rollins, Faye Betts, Michelle Bocklage, Kathy Eller, Stephanie Kennedy, Karen Miller,
Debbie DeMatteis, and Sharon McBain. Present from the County Counselor’s Office: Micki
Wochner, Assistant County Counselor. Present from the Department of Highways & Traffic:
Robert Tschopp, Director, Administrative Services; Patrick Palmer, Manager, Operations;
Dennis Harris, Ervin Hupp, Ray McDonald, Pat McInerney, Debbi Derr, and Gerald Kennedy.
Present from the Department of Health: Jacquelynn Meeks, Director; Janet Williams, Joyce
Theard, Don Edwards, Terry Rickard, Pam Howard, Shirley Eisenreich and Carrie Greninger-

APPROVAL OF MINUTES
The Commission approved the minutes of the September 16, 2003 regular Commission
meeting.

HEARINGS SCHEDULED FOR A FUTURE DATE
Alfred Rogers, Department of Highways and Traffic, appeal of dismissal, October 21, 2003,
8:30 a.m. Mitchell Margo will serve as the Hearing Officer.

NEED TO RESCHEDULE HEARING DATES

None as of the date of this meeting.

REQUESTS FOR HEARINGS

   A. Phillip Buttice, Department of Justice Services, appeal of dismissal.      The County
       Counselor’s Office indicated that an agreement between Mr. Buttice’s attorney and the
       County will be forthcoming.
   B. John P. Rowane, Department of Parks and Recreation, appeal of dismissal. A date for
       the hearing has been tentatively scheduled for November 18, 2003. Ms. Lillie Thomas
       will serve as Hearing Officer.


DISCUSSION OF APPEALS HEARD

Irish Jenkins, Department of Highways and Traffic, appeal of his dismissal. Ms. Gibala stated
that based on the evidence presented, she was inclined to uphold the decision of the
Department of Highways and Traffic.       Ms. Gibala moved, Mr. Margo seconded and the
Commission denied Mr. Jenkins appeal. Ms. Thomas abstained from this decision.

HEAR VISITORS
None

OFFICE ADMINISTRATION CLASSIFICATION STUDY APPEALS (material previously sent)

At its September meeting, the Commission requested additional information regarding the
question of consequences if an employee refuses to perform work outside of their job
classification. Micki Wochner, Asst. County Counselor, responded by stating that it must be first
determined that an employee is working out of job class. If so, and an employee refuses to
perform the work that is considered out of their classification, then an employee cannot be
disciplined. The Commission referenced information previously received from Kirk McCarley
regarding considerations and actions the Commission could take regarding this issue.
After discussion, the Commission remanded the issue back to the Division of Personnel who will
prepare formal appeal recommendations for all affected employees. The Commission indicated
they would make a review of those formal recommendations at its next meeting.

STEP 3 OF SUSPENSION GRIEVANCE PROCEDURE FILED BY DAVID HEITKAMP,
PUBLIC WORKS (no agenda material)

The Commission received information on the suspension grievance filed by David Heitkamp at a
previous meeting. Mr. McCarley stated that a related issue had been remanded to the St. Louis
County ADA Coordinator, who, at this time, is not prepared to render a decision. Mr. McCarley
said that the Commission should receive a recommendation regarding this issue in November.

STEP 5 OF GRIEVANCE PROCEDURE FILED BY ERV HUPP, HIGHWAYS & TRAFFIC

At its previous meeting, the Commission received information regarding a grievance filed by
Ervin Hupp, Department of Highways and Traffic. Additional information from the Department
and the Division of Personnel was sent to the Commission at its request at the September
meeting. After a review of all of the information, the Commission unanimously voted to uphold
the decision of the department and denied the appeal.

STEP 5 OF GRIEVANCE PROCEDURE FILED BY RITA WELLS, DEPARTMENT OF
HEALTH

The Commission reviewed information regarding a grievance procedure filed by Rita Wells,
Department of Health, involving seniority within in the work unit. Ms. Wells wanted seniority to
be determined only by the time that an employee worked in that particular unit. Micki Wochner
advised the Commission that the County defines seniority in the Civil Service Rules by the total
time that an employee has worked for St. Louis County Government. She also stated that
seniority for Ms. Wells’ work unit is posted monthly to keep the employees informed.
Based on the information provided, the Commission denied Ms. Wells grievance.

APPEAL OF PERFORMANCE EVALUATION – CARRIE GRENINGER-MILLER,
DEPARTMENT OF HEALTH

Rick Piglowski, a representative for the Teamsters, presented information regarding the
performance evaluation of Carrie Greninger-Miller, Environmental Public Health Sanitarian. As
the Commission had not previously received the information Mr. Piglowski presented, the
Commission moved to table discussion of this issue to its next meeting.

REQUEST FROM DEPARTMENT OF ADMINISTRATION TO AUTHORIZE OVERTIME FOR
10 EMPLOYEES IN THE DIVISION OF FISCAL MANAGEMENT

The Commission received a request from the Department of Administration to authorize
overtime for certain employees in the Division of Fiscal Management. Mr. McCarley explained
that the overtime hours were necessary due to year-end activities and the annual audit. Upon
review, the Commission approved this request and granted overtime at the straight time rate for
certain Fiscal Management employees.

REQUEST FROM DEPARTMENT OF PARKS AND RECREATION TO EXTEND CUTOFF
DATE FOR REDUCTION OF COMPENSATORY TIME BALANCES

The Civil Service Commission received a request from the Department of Parks and Recreation
requesting approval to extend the cutoff date for reduction of compensation balances. Mr.
McCarley advised the Commission that the extension would allow those employees impacted
additional time to reduce their balances due to additional duties regarding holiday events in the
Parks department. The Commission unanimously approved the request to extend the cutoff
date from December 31, 2003, to March 5, 2004.
TEMPORARY ASSIGNMENT PAY (TAP) EXTENSION – JOHN FRIGANZA (FOR
APPROVAL)

The Commission received a request from the Department of Revenue to extend the Temporary
Assignment Pay for John Friganza, Acting Collector of Revenue. Mr. McCarley stated that
approval of the request would provide management continuity in a reassessment year. The
Commission approved this request, to expire April 10, 2004.

2004 LABOR & TRADES MARKET ADJUSTMENT (FOR APPROVAL)

Mr. McCarley requested approval of the 2004 market adjustment for the Labor and Trades job
class series. Mr. McCarley stated that the market is studied annually to determine changes in
pay structure. Mr. McCarley said that as the market has not shifted, no recommendation for
changes to the County’s pay structure is warranted at this time. Upon review, the Commission
approved the 2004 Labor and Trades Market Adjustment report.

REQUEST TO ESTABLISH JOB CLASS P599 - DRUG COURT ADMINISTRATOR AT PAY
RANGE 113 (FOR APPROVAL)

The Commission heard information regarding a request to approve the establishment of a Drug
Court Administrator in the Department of Judicial Administration. This position will provide
oversight to the drug court program that is currently being run with other state judicial agencies.
This position will monitor the program and develop funding sources through grant applications.
Based on the information presented, the Commission moved to establish Job Class P599 –
Drug Court Administrator in Pay Range 113.


REQUEST TO ESTABLISH JOB CLASS T641 – AIRPORT FIREFIGHTER AT PAY RANGE
42
The Commission reviewed a request from the Spirit of St. Louis Airport to approve the new job
class of Airport Firefighter at Pay Range 42. Mr. McCarley stated that the airport is in the
process of operating charter flights from their facility, specifically for the St. Louis Blues. In
accordance with FAA regulation requirements for charter flights, Spirit Airport needs to establish
a firefighter position to provide emergency services including aircraft firefighting and rescue.
Upon review, the Commission unanimously moved to approve job class T641 – Airport
Firefighter in Pay Range 42
REPORT FROM PERSONNEL DIRECTOR (no agenda materials)

Employee Layoffs
Mr. McCarley informed the Commission that due to budget constraints, employee layoffs were a
possibility. Mr. McCarley stated that the Division of Personnel is working to place affected
employees either internally or externally.
Market Studies
Mr. McCarley stated that at this time, discussion is being held regarding the future of market
based pay studies. He said that this issue is also tied to budget concerns.
Performance Evaluations
Mr. McCarley advised the Commission that modifications will be made to the performance
management document and that there will be adjustments made to merit increases in light of
budgetary constraints. He stated that the Commission would be kept informed regarding the
status of these issues.


ADJOURNMENT
There being no further business before the Civil Service Commission, this meeting was
adjourned at 8:05 a.m.
