					This document is an agreement between a daycare provider and the parents or
guardians of a child for the provision of daycare services for the child. This agreement
provides that for a specified price, the home daycare provider will care for the child.
This document in its draft form contains standard clauses commonly used in these types
of agreements. Additional language may be added to allow for customization to ensure
that the specific terms of the parties’ agreement are addressed. Daycare businesses
can use this form when providing daycare services.
                       HOME DAYCARE CONTRACT

THIS HOME DAYCARE CONTRACT (the "Agreement") is made and entered into this
____________________ day of ___________________, 20___ (the “Effective Date”).


By and between

_______ [Day care provider name]________, of ____________[Address]_____________
___________________________________ (the "Caregiver")


And

______[parent/guardian]____________, of    _____________[Address]________________
____________________________________ (the "Parent(s)").


To provide daycare for:

________[name of the child]___________, ______[date of birth]________ (the “Child”)


In consideration of the mutual covenants made herein, caregiver and parent hereby agree as
follows:


1. START DATE & HOURS OF OPERATION

Under this Agreement, the caregiver agrees to provide daycare services for the above named
child commencing from ______[date]_____, Monday through Friday and during ________ am
to_________ pm (the “Business hours”)

Parents should strictly adhere to the Business Hours. If the Parent is late in picking up the Child,
they shall notify the Caregiver as soon as possible so that any extra arrangement can be made.
Any overtime, overnight, or weekend care services (collectively “overtime Services”) will be
provided outside the business hours at the caregiver’s discretion and against an extra charge for
such services.

2. FEES/PAYMENT

(a) Fees:
The parties hereto have agreed upon a fee of $ _____________ per day for daycare services
during the regular Business Hours. Any overtime services provided outside the business hours is
charged at the rate of $_______ per hour.

The Parent agrees to pay the following slot fees for daycare services:

6 weeks up to 12 months: $________

13 months to 24 months: $________

Children 2 years and up: $________

The caregiver reserves the right to change the daycare fees by giving ______ days notice to the
parent.

(b) Registration fees:
The caregiver charges a non-refundable set-up fee of $ ______________ upon registration of
each child in the daycare.

(c) Payment Schedule:
All Fees are payable in advance and payment is due on the first week of every month. All late
fees and other penalties are to be paid on the day that they are accrued.

The Fees is payable regardless of whether the child actually attends the daycare on all the days or
not. No exceptions can be made for absences due to illness, vacation, or other reasons. If the
Fees is not paid within the first week of each month, a late fee of $________per day will be
charged. A penalty fee of $_____ will be assessed for any returned checks

If the parent defaults in payment for two consecutive months, this contract will be automatically
terminated for default.

(d) Extra fees:
From time to time parent may be requested to pay extra fees for Field Trips and/or other special
projects and activities.

3. HOLIDAYS/CLOSURES

Daycare will be closed on the following paid holidays:

        New Years Eve and New Years Day
        Independence Day
        Memorial Day
        Labor Day
        Thanksgiving
        Christmas Eve and Christmas Day
        All Federal Holidays

Caregiver shall be entitled to take __________ days unpaid vacation and ___________ days paid
sick leave per year. If caregiver takes additional days off for vacation, illness, family emergency,
trainings or workshops, etc., parents need not pay for the daycare services. Parents are
responsible to have back-up care available in case of these closings.

4. NO SMOKING POLICY

State licensing regulations prohibits smoking in home daycares during the hours of operation.

[COMMENT: Some State licensing regulations prohibits the use of tobacco products in or
around home daycare establishments. It is recommended that you check with your current
state law requirements to determine whether or not disclosure is necessary.]
