By signing the bottom of this agreement, client agrees that they understand and accept all of the terms and conditions of this
agreement :

  1.   Alexander Inspections has been contracted to conduct a visual, functional, non-invasive inspection of the property identified
       above. In consideration of the services to be provided by Alexander Inspections as set forth herein, Client shall pay Alexander
       Inspections the amount of US$ ___________ (the “Fee”). The Fee shall be paid at the conclusion of the visual inspection.
  2.   The inspection will include the preparation of a home inspection report that summarizes the visual inspection of the readily
       accessible elements of the residential building at the property address listed above including: structural components, exterior
       components, roofing system, plumbing system, electrical system, heating system, cooling system, interior components,
       insulation components and ventilation system, fireplaces and solid fuel burning appliances, excluding recreational facilities and
       outbuildings other than garages and carports. This inspection will be conducted in accordance with N.J.A.C. 13:40-15.16 as set
       forth by the New Jersey Home Inspection Advisory Committee, failure of Inspector to comply with the rules may subject
       Inspector to disciplinary action.
  3.   Inspector is conducting this inspection consistent with the provisions of N.J.A.C. 13:40-15.19, and will disclose any potential
       conflict of interest if known. Inspector will not accept any additional compensation other than the agreed fee for this
       inspection.
  4.   A visual inspection is limited to conditions that are visible and readily accessible on the date and time of the inspection. Client
       understands that the Inspector cannot identify and / or assess concealed conditions or latent defects. Damage to the property
       could be concealed within enclosed spaces or as a result of the placement or storage of personal effects and may not be
       reasonably visible or accessible.
       a. Client acknowledges that he/she has been previously advised to ensure full access within the structure (s).
       b. Client acknowledges that the Inspector is not permitted to use tools or any other means to dismantle any structure or
            system.
       c. Inspectors may not activate any system including but not limited to the: furnace, hot water heater, stove, outlet (s), garage
            door opener, etc. that has been disconnected or shut down including but not limited to lighting pilot lights or reestablishing
            electrical connections that have been broken.
       d. Any area that may be deemed inaccessible (including but not limited to attics, crawl spaces, basements, spaces crowded
            with personal belongings) or unsafe will be noted as inaccessible and fall outside the scope of this inspection. Due to time
            constraints, Inspector will not request that personal effects be moved and / or removed. If desired, a follow up visit can be
            requested prior to closing and scheduled at the discretion of the Inspector for an additional fee.
       e. Any area that is concealed (including areas behind furniture, or beneath wall, ceiling or floor coverings) will not be
            inspected.
  5.   Client has requested the following components be excluded from the inspection:

  6.   This home inspection is designed to observe the major structural and / or mechanical systems within the residential building at
       the property address listed above, only. No guarantee or representation of past or future condition is expressed or implied.
       Any damage that was concealed but then uncovered including but not limited to the removal of: storage items, insulation, walls
       or wall coverings, ceiling or floor coverings or as a result of remodeling activities, moving in or out, or rehabilitation of the
       structure is specifically excluded from the Inspector’s responsibility.
  7.   Client has specific contractual requirements as part of this Agreement including but not limited to:
      a.   Client will read the Inspection Report provided by Alexander Inspections and contact the Inspector for additional
           explanations as necessary, then take appropriate action on each item identified, which may include engaging the services of
           a qualified or licensed professional in the specific field noted prior to closing on the inspected property.
      b. Client will conduct a final, pre closing walk through to assess the condition of any item noted by Inspector as being
           inaccessible due to obstructions that reasonably should have been removed by seller. Inspector will, for an additional fee,
           at Inspector’s discretion, return and participate in the final walk through inspection upon Client’s request.
      c. Execute an annual service agreement with the appropriate utility to provide maintenance and repairs to all appliances as
           well as heating and air conditioning equipment and hot water heaters. Client acknowledges that Alexander Inspections
           would not have agreed to perform the inspection of this property if Client had not agreed in advance to execute a
           preventative maintenance agreement.
    8. Client acknowledges that Alexander Inspections is not providing a building code inspection or a zoning inspection. Local
        Building Officials and Code Enforcement Officials should be contacted to confirm that all appropriate permits and approvals
        are on file for the property.
    9. Client acknowledges that an appraisal is not being performed by the Inspector.
    10. Specific Exclusions: This Inspection will not include: testing air quality including tests for mold, testing for or locating
        underground oil tanks, identifying abandoned fuel lines, identifying septic systems or cesspools (active or abandoned),
        validating the presence of toxic substances including: asbestos, mold, urea formaldehyde insulation, the chemical
        composition of pressure treated lumber, measuring the presence of pesticides, identifying the presence of lead in paints or
        plumbing components, testing the quality or purity of the water supply, etc.
    11. A report identifying the Inspector’s findings will be provided to the Client within 72 hours of the completion of the
        Inspection at the address provided by the client above. This report is non-transferable, although the Inspector will provide
        additional copies upon the direction of the client to Client’s Attorney and Realtor. The report remains the property of
        Alexander Inspections and may not be copied or further distributed without express written agreement from Alexander
        Inspections.
    12. Dispute Resolution – In the event of any dispute, interpretation or claim of any kind (including but not limited to breach of
        contract, malpractice, any form of negligence, fraud or misrepresentation) relating to or arising out of this contract (any and
        all such matters collectively “Dispute”), Client agrees to allow a representative from Alexander Inspections or its authorized
        agent the right to re-inspect the problem areas and take any pictures or evidentiary action as Alexander Inspections deems
        reasonable. All Disputes arising from or relating to this contract shall be resolved by a single arbitrator in binding arbitration
        in accordance with the applicable rules of the American Arbitration Association. Client and Alexander Inspections expressly
        agree that arbitration is the only dispute resolution alternative available to either party.
    13. CLIENT AGREES THAT ALEXANDER INSPECTIONS SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES,
        FOR ANY CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES. CLIENT FURTHER AGREES THAT THE
        MAXIMUM AMOUNT THAT ALEXANDER INSPECTIONS SHALL EVER BE LIABLE IS AN AMOUNT EQUAL TO
        THE ACTUAL AMOUNT PAID BY CLIENT TO ALEXANDER INSPECTIONS FOR THE SERVICES PROVIDED
        HEREUNDER. ANY AND ALL CLAIMS BY CLIENT MUST BE MADE WITHIN 12 MONTHS FROM THE DATE OF
        THE INSPECTION.
    14. This contract shall not be assignable without the written consent of both parties.
    15. Client and Alexander Inspections agree that if any portion of this contract is determined or declared void, invalid, or
        unenforceable, the remaining provisions and portions shall remain in full force and effect.

I have had the opportunity to review this agreement, have consulted my attorney or other advisors as I deemed necessary and
understand all terms and conditions as documented in this Home Inspection Contract.
