									Art in the Park
Terms and Conditions


The terms and conditions set out below detail the necessary terms by which we, the Council,
give you the exhibitor, in-order to take part in ‘Art in the Park’ on Sunday 2nd July 2006 at
Caldecott Park, Rugby.



1.      Particulars
1.1     Parties
        The Council - Rugby Borough Council of the Town Hall, Rugby, Warwickshire.

        The exhibitor or exhibitor group -



1.2     The Venue
        Caldecott Park, Rugby.

1.3     Period of Event

        Sunday 2nd July 2006
        Set up stands:           8am – 9.45am
        Open to the public:      10am – 4pm
        Dismantle stands:        4.00pm - 5.30pm


1.4     Fee
        For Market stalls
        Public liability insurance (£5million)     £5.00
        Exhibiting Art in the Park (including charitable donation of £5.00). £10.00



        For performance artists and musicians
        Public liability insurance (£5million) £5.00

        All monies must be paid by 31st May 2006



      2. Your obligations to us

        You agree to adhere to the following statements:

        Fee             1. To pay the Fee set out in clause 1.4 without any deductions.

        Electrical      2. That any electrical equipment you provide which will be connected
                        into our mains supply must be P.A.T. tested and evidence of testing
                supplied. Anything that the organiser considers could be unsafe
                must not be used. You must not overload the electrical system.

Damage          3. You will not cause any damage or make any alterations to any
                provided structures, equipment or any other areas of Caldecott Park.

Tidiness        4. You must keep your exhibiting area tidy and free from rubbish at
                all times.

Installation    5. You are responsible for the installation and removal of all
                equipment and exhibits including the provision of fixtures and fittings.

Public Liability
Insurance        6. You must have Public Liability Insurance to the minimum value of
                 £5 million. Insurance cover is included in your entrance fee but if you
                 have your own policy, it must be produced to and satisfy the Director
                 of Corporate Services prior to the event.

Use             7. You may use the event to exhibit or demonstrate, visual art, craft
                and performance art. Visual artists are permitted to sell their work.

Council’s
Inspection and
Approval       8. You must not display any exhibits, artwork or notices of a political,
               sexual, racial or offensive nature anywhere in Caldecott Park. All
               exhibits shall be inspected by and approval of the Council obtained
               prior to opening. Should the Council require the removal of any
               exhibit or artwork by reason of its nature, or upon health and safety
               grounds, such decision shall be final.

Reinstate       9. At the end of the one day event, all items that you bring into the
                park, must be removed at the end of the event. You must make
                good any damage you have caused during the event, returning it to
                its original condition
Default
Powers:         10. If you do not make good all damage you cause to the Park and
                structures provided or do not reinstate it properly, we may do the
                work ourselves. You must then pay our costs for doing so.

Insurance:      11. You are responsible for insuring all artworks included in the
                event. Neither the Council nor its employees accepts liability for loss
                or damage during the event.

Sale of
Exhibits:       12. You must take responsibility for the administration of all sales.

Entrances:      13. The exhibitor shall use only those entrances and exits as
                prescribed by the Council. The exhibitor shall not park or obstruct the
                access ways.

Event closure: 14. The exhibitor must ensure that they have left the event no later
               than the times stated in the exhibitor pack.
   3. Our Obligations to you

   Structures:       1. To provide covered market stalls for visual artists and suitable
                     display areas for performance artists.

   Marketing:        2. To undertake all marketing and advertising of the event.

   Staffing:         3. To provide event organisers, Emma Ward and Becca Wall to
                     oversee all activities on the event day.



   4. Cancellation of the event

   Weather:          1. The Council reserve the right to cancel part or the whole of the
                     event without warning, if they judge the weather conditions to be too
                     adverse.

   Refunds:          2. In the event of the cancellation of the event, the Council reserve
                     the right to refund in full or part, the participation fee.
