This is a document that provides legal notice to a tenant that he or she is in violation of
one or more terms of the lease agreement and the landlord demands that the tenant
vacate the premises. The notice provides the date by which the tenant must vacate the
premises and return possession to the landlord. This document should be used by
landlords, property owners, or property management companies to demand that their
tenants vacate the property due to a violation of the lease agreement.
NOTICE TO QUIT
I, ____________________, (hereinafter “Landlord”) do hereby give you notice that you are in
default of your obligations under the Lease/Rental Agreement dated __________ __________,
_____ for the following reason(s): ____________________________________ (state the
reason(s), e.g., non-payment of rent, breach of a material obligation, etc.)
Because of the default mentioned above, your tenancy of the Premises is hereby terminated as of
__________ __________, _____ and you must quit possession or occupancy of the Premises
now occupied by you at _______________ [NAME OF BUILDING], ________________
[ADDRESS] __________________ [CITY, STATE, ZIP] (hereinafter “the Premises”) on or
before __________ __________, _____ and deliver me the possession of the Premises. Failing
such vacating, legal action shall be commenced to evict you.
Any monies tendered by you and accepted by Landlord or its agent after the receipt of this notice
will be accepted for the use and occupancy only, not as rent, and such acceptance shall not, in
any way, waive any rights under this notice to quit and termination notice. Landlord reserves the
right to accept such monies without establishing a new tenancy. You will in any event, be
responsible for use and occupancy charges for the time you occupy the Premises.
Per the Lease/Rental Agreement, please note that on the day you vacate the Premises, it will be
necessary for Landlord to undertake an initial inspection, check the condition of the premises,
and record the utility meter readings. Landlord therefore requires you to contact Landlord’s
office, _____ (____) days in advance of the vacation date, to book an appointment therewith.
If your account is up to date, the Premises are not damaged or destroyed beyond normal wear
and tear, and you have complied with all the terms of the Lease/Rental Agreement, your security
deposit will be sent to you at your forwarding address (you must provide Landlord with such an
address on the day you vacate the Premises). Please note Landlord does attempt to return all
deposits within __________ [AMOUNT IN WORDS] (___) [AMOUNT IN NUMERALS] days.
FAILURE TO RESPOND TO THIS NOTICE SHALL RESULT IN COMMENCEMENT OF
LEGAL PROCEEDINGS AGAINST YOU FOR PURPOSES OF EVICTION, COLLECTION
OF AMOUNTS DUE, AND FOR OTHER REMEDIES AVAILABLE TO LANDLORD, FOR
WHICH YOU WILL BE RESPONSIBLE FOR COSTS AND ATTORNEY FEES.
