					This is an agreement entered into between a videographer and a client for wedding
recording services. This agreement can be customized to include the date of the
wedding, ceremony location, reception location, production time, payment terms,
payment method, cancellation terms, travel time, and description of the services that will
be rendered. This agreement can be used by small businesses that offer videography
services, or by engaged couples looking to hire a videographer for their wedding.
                            WEDDING VIDEO CONTRACT

This Wedding Video Contract (the “Contract”) is made and entered into this ___________ day
of __________________, 20____ [Instruction: Insert contract date.] (the “Effective Date”), by

name. Although the goal is always to have a great shoot and perfectly happy clients, the
Studio also wants to be paid for its work in any event, whether the shoot goes perfectly, or
the wedding is cancelled or there is a dispute regarding the work done. Careful
consideration should be given when determining the client, and therefore, who is
responsible for payment under the contract, regardless of the outcome. Considerations
may include the bride, groom, parents of either, some other individual or a combination of
all parties. Whoever is listed should sign this contract.] (the “Client”)


                                               RECITALS:

1.      Client wishes to hire the Services of the Studio to videotape and to create a video
playback program on DVD videodisc (the “Production”) to be shot on the wedding day of the
client and other agreed upon dates in connection with the wedding; and

2.       Studio agrees to videotape the wedding on the terms and conditions as set forth herein.

IN CONSIDERATION of the mutual benefits and covenants set forth below, the sufficiency of
which is acknowledged by the parties, and with the intent to be legally bound by this Contract,
the parties expressly agree as follows:

[Comment: Videographer may want to have Bride and Groom initial which party will be
the main contact. If so, the contract should contain a sentence that says same.]


2.   PRODUCTION TIME

The Production shall begin upon the commencement of video coverage i.e. bride’s preparations,
etc., or one hour prior to the scheduled ceremony i.e. when Studio setup cameras, microphones,
etc., whichever is earlier, and it shall run continuously until departing the event location.

Time allotted is up to ______________ consecutive hours of Production. If the total job time
exceeds the time contracted for, extra charges will apply at $ __________. [Instruction: Insert
applicable terms.]

Studio attends rehearsals (1hr) at no charge, if they are held the day of or the day prior to the
wedding day. [Instruction: Insert amount of time videographer will attend rehearsal without
charge, or strike if inapplicable.] If the rehearsal exceeds the time contracted for, extra charges
will apply at $ _____. [Instruction: Insert applicable terms.] In the event the rehearsal exceeds
the time contracted for and Studio has other obligations or commitments which would conflict
with the excess rehearsal time, Studio, in its sole decision, shall have the right to leave the
rehearsal and discontinue videotaping the rehearsal and Client shall have no further right or
claim with respect to such decision.


3. CANCELLATION

If Client gives thirty days’ notice of cancellation to the Studio, Client shall receive a refund of
any funds on deposit, less 50%. Any cancellations beyond this time will be considered non-
complying cancellations, and therefore Client will not be entitled to any refund amount. Studio
cancellations always require a 100% refund of all funds paid by Client, except in the event of a
cancellation pursuant to Paragraph 19 of this Agreement. [Comment: Videographer may
negotiate the above terms, and therefore, same may be changed to conform to policy or
specific negotiations.]
In the event of postponement of the Wedding or cancellation prior to thirty days’ before the
Wedding [Instruction: Conform to notice required in paragraph above.], the deposits paid
may be used for any future event up to one year past the date of this contract, provided Studio
has no other obligations or commitments for the future date. After that time, all deposits will be
forfeited to Studio.


4. FINAL PRODUCT
Studio will make best efforts to give the client the best photos and videos possible, but makes no
guarantee, in regards to the quality of the photographs, sound quality or video tapes which are
influenced by many factors sometimes beyond Studio’s control. The Studio also reserves the
right to edit and delete photos as it deems fit for the benefit of the client or those which it deems
inappropriate or illegal. Studio does not guarantee that everyone in the event will be

photographed or included in the final edited photographs, or that any particular shot, effect or
interview will be included, including any or all of those which may be specifically requested by
the client.


5. DVD COMPATIBILITY

Studio makes no guarantee that photo or video DVD’s provided will function in all computers or
DVD players.


6. CHANGES

Client may request one set of changes, upon receiving his approval copy. If such changes require
more than one hour of editing time, such extra time shall be billed at $________ per hour. Such
change requests must be made by email or other written form. When requested changes are
completed, the final DVD copies will be produced. No additional Approval Copies will be sent.

7. FILE STORAGE

Studio cannot keep huge video files on its computer for a period longer than ___________ days
from the delivery of the Approval Copy, so if changes are requested after that time, extra editing
charges will apply. If no changes are received by this date, it will be assumed that the client is
satisfied with the DVD “AS IS” and NO changes will be made to the final copy. [Instruction:

8.   LIABILITY

Studio takes utmost care with respect to the exposure, sound capture, editing, duplication and
delivery of the video products and services offered. However, in the unlikely event all of the
photos or video tapes should be lost, stolen, damaged, or destroyed, for reasons beyond our best
efforts, Studio’s liability is limited to the return of all payments received for photography and
video services. The Studio’s liability hereunder is limited to the refund of monies paid to Studio.


9. DAMAGE TO EQUIPMENT

In the event any of the Studio's equipment is damaged or destroyed, either accidentally or
intentionally, by the Client, wedding guests and attendants, or employees of the Client, the Client
is fully responsible for the equipment's replacement at current new market prices. If an identical
replacement model is unavailable, Client will be fully responsible to replace the equipment with
the current industry comparable model with respect to make, model and equipment grade.

10. PRODUCTION MATERIALS

If Client wants any photos, invitations, music, checklists, and any other materials to be used in
this production, he shall deliver the same by wedding day, other than perishable items, which
shall be produced on wedding day. Production will proceed without such materials if not
supplied by this time. Studio shall have no further liability with respect to any photos or video of
any or all of such items which are not videotaped and/or photographed as a result of Client’s
failure to produce any or all of such items.


11. MODEL RELEASE

The Client hereby grants to Studio and its legal representatives and assigns, the irrevocable and
unrestricted copyright to use and publish photos/videos of the Client. Studio reserves the right to
use the Production for commercial, promotion, display, competition or other purposes in any
manner or medium, without compensation or liability. It is the responsibility of the client to
advise all participants/ attendees that the event will be videotaped and photographed. All parties
attending the event will be considered as consenting to be included in any lawful use of the
copyrighted materials.


12. RIGHTS

Client warrants that he/she has the legal rights, including intellectual property rights, over
anything which the Studio will videotape, including photos, music or other materials supplied by
the client for use in this video, and that client’s use will be limited to viewing by friends and
family.

Studio reserves the right to remove themselves and all equipment at any time there appears to be
a potential danger to themselves or equipment (belligerent or rowdy, intoxicated people;
improper fireworks; careless discharge of firearms; etc.). No refund or other consideration shall
be given in such cases and Studio shall have no further obligation to continue or restart
videography in such instance. Also, Studio agrees to work only in non-smoking environments.
For outdoor weddings studio utilizes proper equipment to reduce wind noise (fur muffs) and
utilizes camera rain covers in the case of a drizzle or light rain. However, Studio reserves the
right to immediately remove all equipment to an indoor location in the event of weather that may
be hazardous to equipment or persons like lightning, strong wind, hard rain, etc. No refund or
reduction in price shall occur in this event and Studio shall have no further obligation to continue
or restart videography in such instance, but, hopefully, the event would be moved indoors where
video could be continued or restarted, in Studio’s sole discretion.

13. LOCATION

It is the responsibility of the client to secure permission of the church, synagogue or venue to
videotape and/or photograph the event. The Studio shall put its best efforts to abide by the rules

of the church/synagogue as provided by Client. In the event Studio shall put forth such best
efforts, no refund or other consideration shall be given in cases where the church, synagogue or
venue refuses to permit Studio to videotape and/or photograph the event, and Studio shall have
no further obligation to continue or restart videography in such churchy, synagogue or venue in
such instance.


14. TRAVEL

No travel fee is charged for the purpose of attending rehearsal and the wedding day, if the
production is within the State of ______________ and certain areas near the State border.

For all other travel, a mileage fee of ______________ per mile will be prepaid by the Client for

17. PAYMENT METHODS

18. VIDEOGRAPHY PERSONNEL

Studio shall make best efforts to ensure that scheduling permits the head videographer chosen by
Client to be the one at the Wedding. However, in the event such person shall be unavailable,
unable or unwilling to perform the services pursuant to this contract, Studio shall provide
competent videography staff to perform the contract services. In such event, Studio shall have
no further obligation, other than to fulfill the terms of this contract with alternative videography
staff, chosen by Studio in its sole and absolute discretion and no refund or reduction in price
shall occur in this event.

19. FORCE MAJEURE

If the Studio is delayed at any time in the commencement or progress of its work by an act or
neglect of Client or any other vendor hired specially by Client, or of an employee of either, or by
changes ordered in the Production, or by labor disputes, fire, unusual delays in deliveries,
unavoidable casualties or other causes beyond the Studio’s control (including but not limited to
acts of God, total or substantial destruction of any or all of the Wedding ceremony or reception
location through no fault of Studio, acts of war, actual or threatened acts of terrorism,
insurrection or hostilities, acts of a public enemy, epidemics or quarantines or other causes
similar to those enumerated) or by delay authorized by Client’s pending mediation or arbitration
or by other causes which the Studio determines may justify delay, then Studio shall have no
further obligation under this Agreement other than to make best efforts to perform hereunder to
the best of its ability, given the circumstances.

20. GOVERNING LAW

This Agreement shall be governed by the laws of the State of _______________.

21. ARBITRATION

All disputes arising under this Agreement shall be submitted to binding arbitration before a

22. WAIVER

Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent

This agreement contains the entire understanding between the Studio and the Client. It
supersedes all prior and simultaneous agreements between the parties. Any modifications to this
Agreement must be in writing and signed by both parties.
